Tenancy law in Hungary
Where Hungarian tenancy disputes are decided
Tenancy problems in Hungary — unpaid rent, a withheld deposit, repairs nobody carries out, or pressure to leave before the term ends — rarely look dramatic on paper, yet they can disturb your home or your income for months. Because Hungarian private law is codified, the answers are found mainly in the Civil Code (Act V of 2013) rather than in earlier rulings. Knowing which court hears your case, what the court fee will be and how long you have to act shapes the options open to you. A lawyer tenant law in Hungary who works with tenancy files can read your contract and correspondence and tell you where you stand. It costs nothing to ask: describe your situation once, and we match you with a Hungarian attorney who handles tenancy matters.
Hungary in practice
How tenancy matters work in Hungary
Hungary’s courts are organised in four tiers and its private law is codified, so a tenancy file moves through predictable channels. The points below explain who may represent you, what a case costs to start and where help is available when money is short.
Where tenancy cases are heard
Hungary has 158 courts in a four-tier hierarchy: district courts (járásbíróság), administrative and labour courts, regional courts (törvényszék) and regional courts of appeal, headed by the Curia (Kúria) in Budapest. There is no subordination between the levels — higher courts cannot issue instructions to lower ones — and judges decide independently, although Curia decisions bind all courts.
Must you be represented by an attorney?
Legal representation is mandatory in litigation unless an Act provides otherwise, but it is not required in actions falling within the jurisdiction of the district courts (járásbíróság), including appeals and retrial procedures (Civil Procedure Code, Act CXXX of 2016, Section 72). Only attorneys-at-law, law offices and registered in-house legal counsels may act as agents, so professional assistance becomes essential before the regional court and above.
Who may practise as an attorney in Hungary
An attorney-at-law may carry out the professional activities only as a member of a regional bar association, and those bodies are themselves members of the Hungarian Bar Association (Magyar Ügyvédi Kamara) seated in Budapest. Once admitted, a person entitled to practise may act throughout the whole territory of Hungary. The profession is regulated in detail by Act LXXVIII of 2017, with an oath, registration, continuing training and mandatory guarantee and indemnity insurance.
What a civil case costs to start
Court fees in civil proceedings follow a tiered scale that replaced the former 6% flat rate in January 2025. Where the claim concerns residential property and its value is between HUF 10,000,001 and HUF 250,000,000, 50% of the amount calculated is payable, with a minimum of HUF 489,500. Other non-contentious proceedings carry 3% of the subject-matter value, between HUF 5,000 and HUF 250,000.
Legal aid when money is tight
Act LXXX of 2003 on legal aid provides state support for legal advice, the drafting of documents and representation in civil, labour and administrative matters, together with exemption from or deferral of procedural costs in certain cases. Eligibility turns on the social reference base, whose forint value is set each year in the central budget act, so the thresholds move annually.
How lawyers’ fees are agreed
There is no binding statutory tariff for attorneys-at-law in Hungary. Fees are freely agreed between lawyer and client by mandate, and the framework of that agreement — including the professional guarantee and indemnity insurance that attorneys must maintain — is set out in Act LXXVIII of 2017.
All country-specific statements on this page are drawn from official Hungarian sources — the courts of Hungary, the Civil Code and the related Acts published in the Hungarian legal database (njt.jog.gov.hu) — consulted in 2025.
Typical situations
What brings clients to us
These are the tenancy problems people most often describe when they ask for a Hungarian attorney.
A deposit that is not returned
Your lease ends, you hand back the property in good order, and the deposit is still not paid. Hungarian civil proceedings can be used to recover money owed under a contract.
Rent arrears and growing pressure
You have fallen behind, or your tenant has, and messages about leaving have started. Before a district court the procedural route and the documents you hold make the difference.
A lease whose terms are disputed
The written lease, a later amendment and the correspondence do not say the same thing, and neither side accepts the other’s reading of the Civil Code rules on obligations.

Questions and answers
Tenancy law in Hungary: frequent questions
When should I instruct a lawyer tenant law in Hungary rather than handle a dispute alone?
You may act in person before a district court (járásbíróság), because representation is not mandatory in actions within its jurisdiction, including appeals and retrial procedures. Before the regional court (törvényszék) and the higher courts an attorney-at-law is required, and only attorneys-at-law, law offices and registered in-house legal counsels may act as agents.
Which courts decide tenancy disputes in Hungary?
Hungary’s judiciary consists of 158 courts in four tiers: district courts, administrative and labour courts, regional courts and regional courts of appeal, headed by the Curia in Budapest. A tenancy case normally starts at first instance and may be reviewed at a higher level; the levels do not instruct one another and judges decide independently.
How much does it cost to start a civil claim over a tenancy in Hungary?
Court fees follow a tiered scale introduced in January 2025. Where the claim concerns residential property valued between HUF 10,000,001 and HUF 250,000,000, half of the calculated fee is payable, with a minimum of HUF 489,500. Lawyers’ fees are freely agreed, as there is no binding statutory tariff for attorneys-at-law.
Can I obtain legal aid for a housing or tenancy matter?
Act LXXX of 2003 on legal aid covers legal advice, the drafting of documents and representation in civil, labour and administrative matters, and can also bring exemption from or deferral of procedural costs. Eligibility depends on income measured against the social reference base, whose forint value is set each year in the central budget act.
How long do I have to claim unpaid rent in Hungary?
The general limitation period for debt recovery in Hungary is five years, which frames how long a money claim arising from a contract can be enforced. Other situations carry far shorter periods — 30 days, for instance, to challenge a company resolution or to bring a community action on personality rights — so dates should be checked early.
Can an attorney from Budapest represent me if the property is elsewhere in Hungary?
Yes. Practising as an attorney-at-law requires membership of a regional bar association, and those associations are members of the Hungarian Bar Association seated in Budapest. Once admitted, a person entitled to practise may carry out the professional activities of an attorney throughout the whole territory of Hungary, so location is a matter of convenience.
