Ukraine Legal Landscape

How Legal Services Work in Ukraine

Ukraine follows the continental civil law model, with justice administered only by courts established under the Constitution. The legal profession is regulated, and only advocates admitted to the Bar may represent clients in higher courts and in criminal matters. Below are key aspects you should know when seeking legal assistance in Ukraine.

Court System and Jurisdiction

Ukrainian courts are organised in three tiers: local general courts, appellate courts, and the Supreme Court, which acts as the court of cassation. Specialised commercial and administrative courts exist, and the High Anti-Corruption Court handles top-level corruption cases. Litigation is based on codified legislation, not precedent, and the state language is Ukrainian.

Who Can Practise Law

The title ‘advocate’ is protected. An advocate must hold a full higher legal education, have at least two years of legal experience, pass a qualification exam, complete a six-month traineeship, and be entered in the Single Register of Advocates of Ukraine. Representation before the Supreme Court and in criminal defence is reserved exclusively to advocates.

Deadlines You Must Not Miss

Limitation periods vary greatly. Civil claims generally have a three-year window, but unfair dismissal claims must be filed within one month, and unpaid wage claims within three months. Administrative challenges against public authorities must be lodged within six months. Seeking advice promptly is crucial to avoid losing your right to claim.

Court and Legal Fees

Court fees are regulated by law and depend on the claim value and type. For property claims before general courts, natural persons pay 1% of the value (with minimum and maximum caps). Lawyers’ fees, however, are freely agreed between client and attorney with no statutory tariff. Free legal aid is available for vulnerable categories through the Coordination Centre for Legal Aid Provision.

Notarial and Registration Requirements

Contracts for the sale, exchange, or gift of real estate must be in writing, certified by a notary, and registered in the State Register of Real Property Rights. Notaries verify identity, capacity, and transaction legality. Without notarisation, such agreements are unenforceable. Always use a notary for property transactions in Ukraine.

Digital Justice and Remote Access

Ukraine has a well-developed electronic court system through the Unified Judicial Information and Telecommunication System (UJITS). The Electronic Court and videoconferencing subsystems allow documents to be filed online and hearings to be held remotely. The Unified State Register of Court Decisions publishes anonymised decisions, enhancing transparency.

Key time limits in Ukraine

Matter Time limit What it means
General limitation period for civil claims 3 years The general limitation period (pozyvna davnist) is three years, running from the day the person became aware, or should have become aware, of the infringement of their right and of the person who infringed it (Articles 257 and 261 of the Civil Code). It was suspended during the pandemic and martial law and restored with effect from 4 September 2025 by Law No. 4434-IX.
Claims for penalties (fines) and refutation of defamatory information 1 year A special one-year limitation period applies to certain claims, including claims for the recovery of penalties (fines), and claims to refute false information placed in the mass media (Article 258 of the Civil Code).
Challenge of unlawful dismissal 1 month An employee must challenge a dismissal in court within one month of receiving a copy of the dismissal order or of the employment record book (Article 233 of the Labour Code of Ukraine). This is a short, strictly applied time limit for reinstatement claims.
Claim for unpaid wages and other payments due to the employee 3 months Following the July 2022 amendment to Article 233 of the Labour Code, a three-month period was introduced for an employee to sue for unpaid wages and other payments. However, by Decision No. 1-p/2025 of 11 December 2025 the Constitutional Court of Ukraine declared this three-month limit for wage claims unconstitutional, so its continued application is uncertain.
Administrative claim challenging a decision, action or omission of a public authority 6 months The general time limit for filing an administrative claim against a decision, action or omission of a state authority, body of local self-government or official is six months from the day the claimant learned or should have learned of the violation of their rights, freedoms or interests (Article 122 of the Code of Administrative Procedure of Ukraine). Shorter periods apply where a prior administrative appeal was used.
Disciplinary liability of an attorney 1 year An attorney may be brought to disciplinary liability within one year from the date of committing the disciplinary offence (Article 35 of the Law of Ukraine ‘On the Bar and Practice of Law’).
Renewal of limitation periods suspended during martial law From 4 September 2025 Limitation periods were suspended for the duration of martial law (introduced on 24 February 2022). Law No. 4434-IX ‘On Amendments to the Final and Transitional Provisions of the Civil Code of Ukraine regarding the renewal of the limitation period’, effective 4 September 2025, restores the general limitation rules: claims whose period began before the suspension continue running from that date, and claims arising during the suspension begin on that date.

FAQ

Frequently Asked Questions About Lawyers in Ukraine

How can I find trustworthy lawyers in Ukraine?

Use our free matching service. We connect you with advocates who are members of the National Bar Association of Ukraine and are listed in the Single Register of Advocates. You can then discuss your case and fees directly.

Do I need a lawyer for all court cases in Ukraine?

No. In civil and administrative proceedings, you can act in person at first instance. However, before the Supreme Court only advocates may represent you, and in criminal cases a defence counsel is often mandatory. We recommend legal advice for any complex matter.

What are the typical lawyer fees in Ukraine?

There are no statutory tariffs for lawyers’ fees. Remuneration is freely agreed in the contract between you and your advocate. Court fees, on the other hand, are regulated and depend on the claim type and value.

How long do I have to file a civil claim in Ukraine?

The general limitation period is three years, but many claims have much shorter deadlines. For example, unfair dismissal claims must be filed within one month, and unpaid wage claims within three months. Always check with a lawyer immediately.

Can I file a claim against Russia for war damage in Ukrainian courts?

Yes. The Supreme Court of Ukraine has ruled that the aggressor state does not enjoy judicial immunity in cases related to armed aggression. Victims can bring civil claims for war-related damage before Ukrainian courts.

Are notarial services mandatory for real estate transactions in Ukraine?

Yes. Contracts for the sale, exchange, or gift of real estate must be in writing, certified by a notary, and registered in the State Register of Real Property Rights. Without notarisation, such agreements are unenforceable.
