Armenia-specific legal facts

How legal practice works in Armenia

Armenia has a civil law system with a unified bar. Only advocates admitted to the Chamber of Advocates may represent clients in court. Below you will find key deadlines, costs, and requirements that affect legal matters in the country.

Court system and language

Armenian courts operate exclusively in Armenian, the sole official language. Foreign parties are assisted by interpreters. The system includes first-instance courts, appellate courts, and the Court of Cassation as the highest instance.

Advocate regulation

Since 2004, the Chamber of Advocates is the only nationwide bar. To practise as an advocate, one must hold higher legal education, pass the qualification examination, and be listed in the chamber’s register. Only members may appear before courts.

Notarial formalities

Key real-estate transactions – mortgage, pledge, usufruct, servitude, acquisition of development rights, and transfer of immovable property – require notarial certification. Failure to observe the notarial form makes the transaction null and void, and rights must also be state-registered.

Costs and fees

Court fees are set by the Law on State Duty, with a base duty of AMD 1,000. For civil monetary claims, the fee is 3% of the claim value (min AMD 6,000, max AMD 25,000,000). Lawyer fees are freely negotiated between advocate and client; no official tariff exists.

Limitation periods

The general civil limitation period is three years, but specific claims have shorter or longer periods. Importantly, Armenian courts apply limitation only upon a party’s request, not on their own motion. This means you must actively raise the defence.

Matrimonial property

During marriage, property acquired by spouses is common joint ownership unless a contract provides otherwise. Property owned before marriage or received as gift or inheritance remains separate. This default regime affects divorce property division.

Common challenges

Legal hurdles in Armenia

Many clients face these obstacles when dealing with Armenian legal matters.

01

Language barrier in court

All Armenian court proceedings are held in Armenian. Without a fluent advocate, foreign parties may struggle to understand filings, hearings, and judgments, risking procedural missteps.

02

Strict deadlines and formalities

Many legal actions have short limitation periods or notarisation requirements. Missing a one-month appeal deadline or forgetting a notarial certification can invalidate your case.

03

Complex regulations and costs

Court fees and advocate fees vary. Understanding the applicable state duty or negotiating a fair lawyer contract without local guidance can be overwhelming.

Frequently asked questions

FAQ about lawyers in Armenia

How do I find a reliable lawyer in Armenia?

Our platform matches you with licensed advocates who are members of the Chamber of Advocates of Armenia. We verify their credentials and specialisation, and you receive suggestions within 24–48 hours at no cost.

Can a foreigner have a lawyer in Armenia?

Yes. Foreign nationals can engage Armenian advocates. Since court proceedings are in Armenian, your lawyer will handle language issues, including interpreters if needed.

What are the typical court fees in Armenia?

Court fees vary. For a monetary civil claim, the state duty is 3% of the claim value, with a minimum of AMD 6,000 and maximum of AMD 25,000,000. Lawyer fees are negotiated separately.

How long do I have to appeal a court decision?

You have one month to appeal a first-instance judgment to the appellate court. For cassation appeals, the deadline is before the appellate act enters into force, so act quickly.

Do I need a notary for property transactions in Armenia?

Yes, for key real-estate deals like mortgages, pledges, usufruct, servitude, acquisition of development rights, and transfer of immovable property, notarial certification is mandatory; otherwise the transaction is null and void.

Is legal aid available in Armenia?

Armenian law provides for legal aid in certain cases. State-funded legal aid may be available for those who qualify, and advocates may also offer pro bono services. Contact us to discuss your options.
