Adoption in Hungary

How an adoption-related file is handled in the Hungarian system

Adoption changes a family’s story, and in Hungary it sits within the family-law provisions of the Civil Code (Act V of 2013), in force since 15 March 2014. Because the rules are codified rather than built on case law, the outcome of your matter depends on how carefully the file is prepared and how closely the procedure is followed. Adoption lawyers in Hungary work inside this codified framework every day: they know which court handles which step, what documentation is expected and how a child’s interests are weighed. Our service is free for you. You tell us about your situation, we compare the profiles of Hungarian attorneys who handle family matters, and we introduce you to counsel who can take the case forward.

Country focus

Adoption and family law in Hungary: what the framework looks like

Hungary is a continental civil-law country: its private law is written in codes, and the courts apply those codes rather than binding precedent. The Civil Code (Act V of 2013) has governed persons, family law, property, obligations and succession since 15 March 2014. Here is how that system shapes a family-law file.

Where adoption sits in Hungarian law

Adoption is part of family law, which the Civil Code (Act V of 2013) unifies with the law of persons, property, obligations and succession in a single instrument of eight Books. The code replaced the 1959 Civil Code on 15 March 2014, so the rules you rely on are written and codified rather than drawn from precedent.

Which courts may hear your case

Hungary’s judiciary consists of 158 courts in a four-tier hierarchy: district courts (járásbíróság), administrative and labour courts, regional courts (törvényszék) and regional courts of appeal, headed by the Curia (Kúria) in Budapest. There is no subordination between the levels, so higher courts cannot instruct lower ones and judges decide independently.

Who may represent you in Hungary

Practising as an attorney-at-law requires membership of a regional bar association, and the regional chambers are themselves members of the Hungarian Bar Association (MÜK), seated in Budapest. An admitted attorney may practise throughout the whole territory of Hungary. Representation is mandatory in litigation unless an Act provides otherwise, though parties may act in person before district courts.

How court fees and lawyers’ fees are set

Court fees follow Act XCIII of 1990 on Duties. After the reform of 28 January 2025, first-instance contentious claims use a tiered scale, while other non-contentious proceedings carry a fee of 3% of the subject-matter value, with a minimum of HUF 5,000 and a maximum of HUF 250,000. Lawyers’ fees are freely agreed by mandate; there is no statutory tariff.

Legal aid for families with limited means

Under Act LXXX of 2003 on legal aid, the state may bear the cost of legal advice, the drafting of documents and representation in civil matters for people without sufficient means. Eligibility is tied to the social reference base and to an assessment of assets, and the forint value of that base is set each year in the central budget act.

When a family file also touches property or succession

Hungarian succession law limits testamentary freedom: a descendant, spouse or parent may claim a compulsory share (kötelesrész) of one-third of what they would have received as intestate heirs, and that claim lapses after five years. Unless the spouses agree otherwise, a matrimonial community of property applies. Both rules can matter when family assets are reorganised.

Common concerns

What families ask us before they instruct anyone

Adoption touches documentation, competence and money at the same time. These are the three points where people most often get stuck.

01

The paperwork is unfamiliar

Adoption files move through a codified system with specific forms, translations and certifications. Without someone who works with these documents regularly, it is easy to lose weeks to corrections and requests for further information.

02

You are not sure which court is competent

Hungary has 158 courts in four tiers, from district courts up to the Curia in Budapest. Working out where a family-law file belongs is the first practical step, and getting it wrong delays everything that follows.

03

Costs feel unpredictable

Lawyers’ fees in Hungary are freely agreed by mandate, with no statutory tariff, and court fees follow a tiered scale for contentious claims. A clear fee agreement before work begins removes most of the uncertainty.

Questions

Adoption lawyers in Hungary: common questions

How do I choose among adoption lawyers in Hungary?

Start with the regulated basics: practising as an attorney-at-law in Hungary requires membership of a regional bar association, and an admitted attorney may practise throughout the whole country. Look for someone who regularly handles family-law matters under the Civil Code, and ask how they intend to prepare your file.

Which courts deal with family-law matters in Hungary?

Hungary has 158 courts in four tiers: district courts (járásbíróság), administrative and labour courts, regional courts (törvényszék), regional courts of appeal, and the Curia (Kúria) in Budapest. There is no subordination between the levels, so higher courts cannot instruct lower ones and judges are independent.

Do I have to be represented by a lawyer in Hungary?

Legal representation is mandatory in litigation unless an Act provides otherwise, but it is not required in actions within the subject-matter jurisdiction of the district courts, where parties may appear in person. Before the regional court and the higher courts, an attorney-at-law is required.

How are lawyers’ fees set in Hungary?

Fees are freely agreed between the lawyer and the client by mandate; there is no binding statutory tariff for attorneys-at-law. Fee agreements and remuneration are governed by Act LXXVIII of 2017, which also regulates the professional guarantee and indemnity insurance that attorneys must maintain.

What does legal aid cover in Hungary?

Under Act LXXX of 2003 on legal aid, the state may cover legal advice, the drafting of documents and representation in civil matters for people without sufficient means. Eligibility is tied to the social reference base, whose forint value is set annually in the central budget act, so the threshold moves each year.

Why does codification matter for a Hungarian family-law file?

Hungarian private law is codified: the Civil Code (Act V of 2013) has been in force since 15 March 2014 and replaced the 1959 code. Judges are bound by the law and their own conviction, and although the Curia issues uniformity decisions that bind the lower courts, precedent is not the primary source of law.
