How it works

Technology disputes in a small EEA state

If your business runs on software, data or digital platforms, a dispute can arrive quickly: an unfinished development project, a licence that no longer fits the product, a competitor copying your code, or an authority asking how you handle personal data. Liechtenstein is a small civil-law jurisdiction inside the EEA, and the route from a disagreement to a hearing follows its own rules. Our service helps you find a technology lawyer in Liechtenstein who already works with these questions. You describe your situation once, we compare it with the specialisations of registered lawyers and match you with counsel who handles the relevant matter. The first matching step is free, and you decide whether to instruct.

Liechtenstein in practice

What shapes a technology matter in Liechtenstein

Liechtenstein is a civil-law principality whose private law was received from the Austrian Allgemeines Bürgerliches Gesetzbuch and whose procedural rules follow its own Zivilprozessordnung. As an EEA member it applies internal-market law as well. These features decide how a software, licensing or data disagreement is prepared and heard.

Three instances of ordinary jurisdiction

Ordinary jurisdiction runs through the Fürstliches Landgericht in Vaduz as the first instance, the Obergericht as the second instance and the Oberster Gerichtshof as the third. The Oberster Gerichtshof also sits as the Administrative Court, while the Staatsgerichtshof is a separate constitutional court hearing constitutional complaints.

Who may act as your lawyer

Only persons entered in the Liechtenstein lawyers’ list kept by the Liechtensteinische Rechtsanwaltskammer may practise as Liechtenstein lawyers. The RAG requires, among other things, EEA or equivalent nationality, a bar examination or three years of regular practice, a domestic office and professional indemnity insurance. Lawyers qualified elsewhere in the EEA may provide services under the free movement of services.

No general obligation to be represented

The Zivilprozessordnung contains no general Anwaltszwang, and section 33(1) ZPO expressly permits a party to grant a power of attorney to persons who are not lawyers. Whether representation is required in a specific high-value or higher-instance matter should be checked case by case before the proceedings begin.

EEA law and the EFTA Court

Because Liechtenstein belongs to the European Economic Area, a technology matter can raise both national and EEA questions. The Oberster Gerichtshof has confirmed that national rules binding courts to rulings of a higher instance cannot prevent a court from requesting an advisory opinion from the EFTA Court, the judicial body for EEA matters involving Liechtenstein.

German as the language of the case

Proceedings and legal advice are conducted in German, and submissions are drafted in that language. In simple cases, court interns give free oral legal advice and may draft claims and other filings by telephone, subject to prior appointment. No written opinions or expert reports are provided through that route.

Costs, fees and legal aid

Court fees follow the Gerichtsgebührengesetz, are normally measured by the value in dispute and are payable in Swiss francs, with foreign-currency amounts converted at the SIX AG reference rate. Lawyers charge according to the statutory Rechtsanwaltstarif. Verfahrenshilfe under section 63 ZPO may be granted where paying the costs would impair the party’s necessary livelihood.

Common situations

Where technology matters usually go wrong

Most disagreements do not begin in court. They begin in wording, timing and assumptions that nobody wrote down.

01

Contracts written for a different industry

Software, cloud and licensing arrangements rarely fit a template built for the sale of goods. When the wording is vague about deliverables, acceptance or liability, the disagreement moves from the project team to the courts.

02

Deadlines that cannot be extended

An appeal on the merits against a first-instance judgment must be filed within four weeks, and a recourse within fourteen days. Neither period can be extended, so a slow reaction can end a case regardless of its merits.

03

Data, EEA rules and two legal orders

Liechtenstein applies EEA internal-market law alongside its own civil-law tradition, so a technology matter can raise national and EEA questions at once. Who you instruct, and in which language the case runs, shapes how it is prepared.

Why use the matching service

What you get when we match you

A short description of your matter is enough for us to identify the right specialisation.

Matched to the right specialisation

We compare your matter with the practice areas of lawyers on the Liechtenstein list, so you speak with counsel who already handles software contracts, licensing, IT projects or data questions rather than a generalist.

Lawyers registered in Liechtenstein

Only persons entered in the Rechtsanwaltsliste kept by the Liechtensteinische Rechtsanwaltskammer may practise as Liechtenstein lawyers, while lawyers qualified elsewhere in the EEA may also provide services in the country.

Clear information about costs

Court fees are value-based and calculated under the Gerichtsgebührengesetz, and lawyers charge according to the statutory Rechtsanwaltstarif. Your matched lawyer explains what your particular matter is likely to involve.

Cross-border awareness

Liechtenstein sits inside the EEA and its courts can seek an advisory opinion from the EFTA Court. If your counterparty, your servers or your staff sit abroad, that context forms part of how the matter is assessed.

Questions

Technology law in Liechtenstein — frequently asked questions

How do I find a technology lawyer in Liechtenstein?

You describe your matter to us in a short form. We compare it with the specialisations of lawyers entered in the Liechtenstein lawyers’ list and propose counsel who handle technology-related work. The matching step is free, and you decide afterwards whether to instruct the lawyer.

May a lawyer from another EEA state advise me on a Liechtenstein technology matter?

Yes. Lawyers qualified in other EEA states may provide services in Liechtenstein under the free movement of services set out in Art. 78 RAG. Only persons entered in the Rechtsanwaltsliste may practise as Liechtenstein lawyers, so the basis on which your adviser acts is worth clarifying at the outset.

Do I have to be represented by a lawyer in Liechtenstein proceedings?

The Zivilprozessordnung contains no general obligation of representation. Section 33(1) ZPO expressly allows a party to grant a power of attorney to persons who are not lawyers. For specific high-value or higher-instance matters, the requirements should be checked case by case for your individual situation.

How long do I have to bring a technology-related claim?

Damages claims where both the damage and the wrongdoer are known follow a three-year period from knowledge. Many commercial and professional claims fall under a five-year period, and the general limitation period is ten years following the 2026 reform. The result depends on how your claim is characterised.

In which language does a case in Liechtenstein run?

German is the language of the courts and of legal advice in Liechtenstein, and submissions are prepared in German. In simple cases, court interns give free oral legal advice and may draft claims and other filings by telephone, subject to prior appointment.

What costs should I expect in a Liechtenstein technology dispute?

Court fees are governed by the Gerichtsgebührengesetz, normally assessed on the value in dispute and payable in Swiss francs. Lawyers charge according to the Rechtsanwaltstarif. Verfahrenshilfe under section 63 ZPO may be available if meeting the costs would impair your necessary livelihood.
