Find a mediation lawyer in Romania who negotiates before you litigate
Romanian civil disputes are decided on the codes rather than on binding precedent, so predicting a judgment is rarely straightforward. A lawyer who negotiates can test the other side’s position, watch your deadlines and put a workable settlement in writing. If the talks fail, the same lawyer can take the case to the competent court.

Mediation in Romania
What a mediation lawyer in Romania actually does for you
Mediation is a structured negotiation in which a neutral third party helps the people in a dispute reach their own agreement instead of asking a judge to decide for them. In Romania, a mediation lawyer combines two roles: adviser on the substance of your case — a contract, a divorce, an inheritance, a company conflict — and strategist for the negotiation itself. Romanian courts follow the continental civil-law model and decide on the codes rather than on binding precedent, so the outcome of litigation is often difficult to predict; that is one reason parties increasingly prefer a settlement they control. A lawyer registered with a Romanian Bar can assess your position, draft and check the agreement, and represent you in court if the talks fail. We match you with a mediation lawyer in Romania who handles exactly this work.
Country notes
How disputes and settlements work in Romania
Romania is a continental civil-law jurisdiction: the codes set the framework, and most court decisions are not a source of binding law. Settlement talks therefore run alongside a legal landscape that a specialist lawyer needs to read for you, including mandatory forms, registration duties and strict time limits.
A civil-law system without binding precedent
Romanian courts apply comprehensive codes — the Civil Code (Law No 287/2009), the Civil Procedure Code (Law No 134/2010) and the Companies Law (Law No 31/1990) — and court decisions are not, as a rule, a source of law. Only Constitutional Court rulings and certain decisions of the High Court of Cassation and Justice bind the lower courts. That makes litigation outcomes less predictable and a negotiated settlement correspondingly more attractive.
Who may represent you
Practising law in Romania requires membership of a Romanian Bar (barou), and all bars are united in the National Association of Romanian Bars (UNBR). In civil and commercial cases the parties may appear in person, but representation by a qualified lawyer is required before the courts of appeal and the High Court of Cassation and Justice. Only lawyers registered with a Romanian Bar may act before the Romanian courts.
Court fees and lawyers’ fees
Claims assessed in money carry a judicial stamp fee (taxă judiciară de timbru) under Government Emergency Ordinance No 80/2013, calculated on a degressive sliding scale and payable in advance for both first instance and appeal. Lawyers’ fees are freely negotiated — there is no binding official tariff — although the losing party may be ordered to pay the winner’s costs, court fees included, subject to the court’s assessment of reasonableness.
Time limits keep running whatever route you choose
The general limitation period for debt and contractual claims is three years, an action to recover immovables may be brought within ten years, the option to accept or renounce an inheritance must be exercised within one year of the succession opening, and a dismissal may be challenged within 45 calendar days. Your lawyer will check the calendar before negotiations start rather than after.
Family and succession conflicts
The default matrimonial regime is the legal community of property: property acquired during the marriage is presumed common, and the regime dissolves on death, divorce or annulment, so two liquidations may be needed. On death, Romanian forced heirship (rezerva succesorală) reserves half of each forced heir’s legal share, leaving only a disposable portion. These rules set the boundaries within which anything can be negotiated.
Property deals and the Land Book
Under Article 1244 of the Civil Code, conventions transferring or constituting real rights intended for Land Book entry must take authentic notarial form, on pain of absolute nullity, and registration in the cartea funciară is as a rule constitutive. A settlement touching property or construction rights may therefore need a notary and a registration before it fully protects you.
Key time limit — Litigation & Dispute Resolution
General limitation period (debt and contractual claims) — 3 years. Covers most contractual and debt claims and frames how long you can negotiate before filing.

Common situations
What usually brings people here
Three starting points we see most often when someone searches for help with a Romanian dispute.
You are unsure whether court is the right route
Litigation in a civil-law system can be slow and hard to predict, and stamp fees are payable up front. You want to know whether a negotiated settlement would protect your position better before anything is filed.
The other side has stopped talking
Correspondence has stalled or turned hostile. A lawyer who negotiates for a living can reopen the channel, set the terms of the discussion and keep the limitation calendar in view while talks proceed.
You need an agreement that actually holds
An exchange of emails may not be enough where a notarial deed or a Land Book registration is needed. You want the settlement drafted, checked and, where the law requires it, formalised properly.
How matching works
A short route to the right Romanian lawyer
We do not decide your case and we do not give advice; we put your matter in front of lawyers who handle it.
Country-specific screening
We look for lawyers who work on Romanian civil, commercial, family or property disputes and who understand the codes, the court hierarchy and the formalities a settlement may require.
One conversation, no cost
Tell us what the dispute is about and what you want to achieve. Matching is free and does not commit you to instructing anyone.
Fee transparency from the start
Romanian lawyers’ fees are freely negotiated rather than fixed by tariff, so we put you in front of professionals who explain their basis of charging before you decide.
The court option stays open
If negotiation fails, the same lawyer can advise on the competent court — judecătorie, tribunal or court of appeal — and on the stamp fee your claim would attract.
Cross-border matters
Disputes we route beyond Romania
Romanian parties are often on one side of a dispute and a company or individual elsewhere in Europe on the other. Where your matter has a foreign element, we can look for lawyers equipped to handle it alongside Romanian counsel.
Questions
Mediation and Romanian practice, answered
What does a mediation lawyer in Romania do that I cannot do myself?
A lawyer assesses your position under the Romanian codes, identifies the deadlines that apply, drafts and checks any settlement wording, and negotiates with the other side on your behalf. Where the subject matter demands it — for instance a transfer of real rights, which requires an authentic notarial deed — the lawyer makes sure the agreement is formalised correctly.
Will a settlement be legally binding in Romania?
It depends on the subject matter and the form used. Romanian law requires authentic notarial form, on pain of absolute nullity, for conventions transferring or constituting real rights that are to be entered in the Land Book, and registration is as a rule constitutive of the right. A lawyer checks what form your particular agreement needs before you sign.
Which courts would hear the case if the negotiation fails?
The judecătorii (local district courts) are the first instance for most civil, criminal and commercial claims below statutory value thresholds. The tribunale hear larger first-instance cases and appeals against the judecătorii, the fifteen curţi de apel hear appeals against tribunal decisions, and the High Court of Cassation and Justice sits at the apex in Bucharest.
How are lawyers’ fees set, and can I recover them?
Fees are freely negotiated between lawyer and client; there is no binding official tariff. If you win, the losing party may be ordered to pay your costs, including court fees and lawyer’s fees, subject to the court’s assessment of reasonableness. Public legal aid exists under GEO No 51/2008 for applicants whose average net monthly income per family member falls below the statutory threshold.
Which deadlines matter while we negotiate?
Time limits remain relevant whichever route you take: three years for most debt and contractual claims, ten years for recovering immovables, one year for the succession option and 45 calendar days to challenge a dismissal. Your lawyer will check how those periods affect your negotiating position before the first meeting.
Can you help with a dispute that has a foreign element?
We can look for lawyers who handle matters with a cross-border dimension. Two Romanian points frequently arise: land may be acquired by non-EU/EEA nationals only under international treaties and reciprocity, while buildings may be owned by any foreigner; and non-residents are taxed in Romania on Romanian-source income at the flat 10% rate, subject to any double-taxation convention.
Next step
Tell us about your dispute and we will match you
Describe the situation in a few lines — what the disagreement is about, who is on the other side and what you would like to achieve. We will match you with a lawyer who handles Romanian disputes of that kind. No cost, no obligation, and you decide whether to instruct.
