Overview
Mediation in Italy: when the first meeting is compulsory
Mediation in Italy is not always optional. Under art. 5 of Legislative Decree 28/2010, a first mediation attempt is a condition of admissibility (condizione di procedibilità) for a list of civil and commercial matters, and that condition is met once the first meeting takes place, even if the parties do not settle. If your dispute falls into one of those categories, a mediation lawyer in Italy prepares the file, protects your position and keeps your court options open. europeanlawyerfinder.com is a matching platform: you describe the case in a few minutes, and we connect you with a lawyer registered with an Italian Ordine degli Avvocati who works in mediation and in your field. Being matched is free.
Italy in practice
How mediation and civil claims work in Italy
Italy combines a codified civil-law system with a mandatory mediation step for many types of claim. The points below set out how that step fits with the courts, who is allowed to act for you, what it costs and which time limits run in parallel.
Mediation as a condition of admissibility
Under art. 5 of Legislative Decree 28/2010, a first mediation attempt is required before bringing certain civil and commercial claims, including condominium, real rights, division, inheritance, family covenants, leases, medical and healthcare liability, insurance, banking and financial contracts, and defamation via the press. The condition is satisfied once the first meeting takes place, even if the parties do not settle.
The lawyers who can act for you
Practising as an avvocato requires registration in the albo kept by the territorial Consiglio dell’Ordine, under the national Consiglio Nazionale Forense. Admission under Law 247/2012 requires a laurea magistrale in giurisprudenza, an 18-month pratica forense and the State examination. Under art. 82 of the Code of Civil Procedure, personal appearance is allowed before the Giudice di Pace only in claims up to EUR 1,100.
The courts behind the mediation
If mediation does not settle the dispute, civil first instance is heard by the Giudice di Pace for minor claims or by the Tribunale ordinario, sitting as a single judge or a three-judge panel. Appeals on the merits go to the Corte d’Appello, and the Corte Suprema di Cassazione in Rome reviews questions of law only. Administrative disputes start before the TAR and are appealed to the Consiglio di Stato.
What it costs and who pays
Court proceedings attract the contributo unificato, scaled by the value of the claim from EUR 43 to EUR 1,686, increased by half on appeal and doubled before the Court of Cassation; a EUR 27 marca da bollo is also due. Lawyers’ fees are freely agreed and, absent agreement, the court applies the ministerial parametri forensi. Legal aid may cover fees where taxable income does not exceed EUR 12,838.01.
Time limits that run in parallel
Two different clocks can matter. Prescrizione is limitation: ten years for ordinary contractual claims, five years for tort claims and for periodic payments, interest and rents; it may be interrupted or suspended. Decadenza is forfeiture: the term is strict and cannot be interrupted, which is why many procedural challenges are drafted quickly with a lawyer.
Language and regional practice
Judicial proceedings in Italy are conducted in Italian, and pleadings and mediation files are prepared in that language. German is co-official in Trentino-Alto Adige/Südtirol and French in Valle d’Aosta, which matters if your dispute concerns property, family or business interests in Bolzano/Bozen or Aosta. When matching, tell us which languages you and your witnesses work in.
Key time limit — Litigation & Dispute Resolution
Debt claim (general contract) — 10 years (ordinary limitation). The ordinary prescription period under the Civil Code for contractual debt; shorter special terms apply to specific claims.

Common problems
Why people hesitate before contacting a lawyer in Italy
The rules are precise and the consequences of getting them wrong are real, but the first step is simpler than it looks.
Not sure whether mediation is required?
In Italy it depends on the subject matter of your claim: art. 5 of Legislative Decree 28/2010 lists the categories where a first mediation meeting is a condition of admissibility. Misreading that list can delay your case.
Deadlines that decide cases
Some Italian time limits are forfeiture terms (decadenza) that cannot be interrupted: 60 days to challenge a dismissal in writing and 60 days to seek annulment of an administrative act before the TAR. Others are limitation periods (prescrizione) that may be interrupted.
Choosing a lawyer from abroad
Italian civil procedure generally requires a qualified avvocato, and lawyers are registered with a territorial Ordine degli Avvocati supervised by the Consiglio Nazionale Forense. Distance, language and unfamiliar fee structures make it hard to compare names without help.
What you get
A shortlist built around your Italian dispute
We are a matching service, not a law firm. Our job is to put the right Italian lawyer in front of you, quickly and without charge.
Lawyers admitted in Italy
We match you with avvocati registered in an Italian albo degli avvocati, the register kept by each territorial Consiglio dell’Ordine under the Consiglio Nazionale Forense.
Mediation and court experience
Your lawyer should know both sides of the process: the mandatory mediation stage under Legislative Decree 28/2010 and the court that would hear the case if no settlement is reached.
Fee transparency from the start
Italian lawyers’ fees are freely agreed; where there is no agreement, the court refers to the ministerial parametri forensi. Ask about phase-by-phase costs before you instruct anyone.
Support in your language
Proceedings are in Italian, with German co-official in Trentino-Alto Adige/Südtirol and French in Valle d’Aosta. We look for lawyers who can work in the language you are comfortable with.

Questions
Mediation in Italy: frequently asked questions
Is mediation compulsory in Italy?
For the matters listed in art. 5 of Legislative Decree 28/2010 — including condominium, real rights, division, inheritance, family covenants, leases, medical and healthcare liability, insurance, banking and financial contracts and defamation via the press — a first mediation meeting is a condition of admissibility. It is satisfied once that meeting takes place, even without a settlement.
What does a mediation lawyer in Italy actually do?
The lawyer checks whether your dispute falls within the mandatory list, prepares the mediation file, advises on the strengths and weaknesses of your position, and represents you at the session. The same lawyer can explain how the claim would run before the Giudice di Pace, the Tribunale or, in administrative matters, the TAR.
Do I have to be represented by an Italian lawyer?
In civil proceedings other than small claims, yes: under art. 82 of the Code of Civil Procedure parties may appear in person before the Giudice di Pace only where the value does not exceed EUR 1,100, and elsewhere assistance or representation by a qualified avvocato is mandatory. In criminal proceedings a defence lawyer is always required.
Which deadlines should I diarise?
Watch the forfeiture terms: 60 days to challenge a dismissal in writing, then 180 days to file before the labour judge or start conciliation, and 60 days to seek annulment of an administrative act before the TAR. Limitation periods are longer — ten years for ordinary contractual debt and five years for tort claims, rent arrears and other periodic payments.
How much will an Italian mediation lawyer cost?
There is no binding statutory tariff: since minimum fees were abolished in 2006, fees are agreed freely with the client, and where there is no agreement the court liquidates them using the ministerial parametri forensi (D.M. 55/2014). Legal aid (patrocinio a spese dello Stato) is available for civil and administrative cases where annual taxable income does not exceed EUR 12,838.01.
Can I run an Italian mediation in another language?
Proceedings are in Italian, but German is co-official in Trentino-Alto Adige/Südtirol and French in Valle d’Aosta. If your documents, witnesses or counterparty work in another language, tell us when you submit your request so that we look for a lawyer who can handle the file in that language.
