Why use our matching service?
The right divorce lawyer in the Netherlands
Going through a divorce is one of the most difficult legal transitions a family can face. In the Netherlands, divorce proceedings are heard by the district courts, and the rules on the division of assets follow the default limited community of property introduced in 2018. That means assets acquired before the marriage and inheritances generally remain private, while assets accumulated during the marriage are divided equally. Understanding these rules, and how they apply to your pension, children and home, requires careful advice. Our platform helps you compare and contact divorce lawyers in Netherlands without cost or obligation. We match you with a registered advocaat who is familiar with Dutch family law, can explain the likely costs and the possibility of subsidised legal aid, and will represent your interests at every stage.
How divorce law works in the Netherlands
Dutch divorce procedure, costs and legal aid
Divorce in the Netherlands is part of private law and is decided by professional judges within the continental civil law system. The following points summarise how the courts, lawyers, property rules and legal aid operate, based on official Dutch sources.
Divorce is heard by the district court
In the Netherlands, first-instance civil, criminal and administrative cases are heard by one of the eleven district courts (rechtbanken). Appeals in divorce matters go to one of the four courts of appeal (gerechtshoven). There is no jury: all cases are decided by professional judges, and the Hoge Raad reviews only questions of law.
Default matrimonial regime: limited community of property
Since 1 January 2018, the statutory default matrimonial property regime is the limited community of property (beperkte gemeenschap van goederen). Assets and debts acquired before the marriage, and inheritances or gifts received before or during the marriage, remain the private property of the spouse who received them. Only assets acquired jointly during the marriage fall into the community and are divided 50/50 on divorce.
Who may practise as a lawyer in the Netherlands
The professional title ‘advocaat’ is legally protected. Only a person registered on the official register (‘tableau’) may practise as an advocate. Qualification requires a Dutch law degree, a three-year professional traineeship and taking the oath before the court. Every registered advocate is a member of the Nederlandse Orde van Advocaten and is subject to its disciplinary supervision.
Subsidised legal aid through the ‘toevoeging’
Divorce falls within family matters for which subsidised legal aid is available under the Wet op de rechtsbijstand. If your income and assets are below statutory thresholds, an advocate can apply for a ‘toevoeging’ (grant) to the Raad voor Rechtsbijstand. The State then pays part of the costs, while you pay a means-tested own contribution (eigen bijdrage).
Legal fees and court costs
Advocates’ fees in the Netherlands are freely agreed between the client and the advocate; there is no binding statutory tariff. In civil proceedings, a court fee (griffierecht) is payable; for natural persons the 2026 rates range from EUR 341 to EUR 2,803 depending on the value of the claim. Indigent parties may pay a reduced rate of EUR 93.
Data verified from official Dutch sources: the judiciary (Rechtspraak), the central government (Rijksoverheid) and the official Dutch legislation database (wetten.overheid.nl), reviewed in 2026.
Common concerns
Divorce is hard enough without legal uncertainty
A Dutch divorce brings specific questions about property, children and costs. We help you address them with confidence.
Uncertainty about asset division
The limited community of property means only assets acquired during the marriage are divided 50/50. Sorting out premarital assets and inheritances is often harder than expected.
Concern about children and parenting
Child arrangements, parental responsibility and child support are part of the divorce process. A lawyer helps you understand how the Dutch district court approaches these sensitive issues.
Worry about legal costs
Advocate’s fees are freely agreed, but subsidised legal aid may reduce the cost if your income is low. We match you with a lawyer who can explain your options.
