The problem
Removal cases in Austria move fast and turn on detail
A removal order, a rejected residence application or an entry ban puts everything you have built in Austria into question. The difficulty is rarely the facts alone: it is knowing which authority decided, which court reviews that decision and what the file needs next. A deportation lawyer in Austria works inside this system every week, reads the decision in German and knows which points a court will examine. Through our free matching service you describe your situation once, in confidence, and we put you in touch with a lawyer whose practice covers removal, residence and asylum matters. You then decide whether to proceed, with a clear view of scope and cost.
Austria in practice
How removal and residence cases work in the Austrian system
Austria is a civil-law country whose courts, authorities and procedural rules are codified, and the language of every filing is German. The notes below set out the structures that matter when a residence or removal case moves through the Austrian system, and the table shows statutory time limits that apply to common proceedings. The periods shown are general Austrian periods; the deadline that applies to your own case is fixed by the statute governing that procedure.
Administrative courts, not the ordinary courts, decide migration disputes
Austria separates administrative justice from the ordinary judiciary. Disputes over administrative decisions, including migration and asylum matters, go to the Landesverwaltungsgerichte in the nine Länder or to the Bundesverwaltungsgericht at federal level, while the Bundesfinanzgericht hears tax cases. Above them sit the Verwaltungsgerichtshof, which reviews points of law, and the Verfassungsgerichtshof, which examines constitutional questions.
Only a registered Rechtsanwalt may practise as a lawyer in Austria
Practice as a Rechtsanwalt requires entry in the list of lawyers (Liste der Rechtsanwälte) kept by one of the nine regional Bar associations, whose umbrella body is the Österreichischer Rechtsanwaltskammertag in Vienna. The title is protected by law, professional liability insurance is mandatory, and a registered lawyer may appear before all courts and authorities in Austria.
Everything is filed in German
German is the language of the Austrian courts and authorities, so decisions, submissions and hearings are in German. A lawyer who works in your language as well as German can translate each step, check that the decision has been correctly understood and prepare submissions in the form the court expects.
Where the ordinary courts come into play
Some removal cases sit alongside criminal or family files. In Austrian civil litigation, representation by a lawyer is mandatory before the regional courts and all higher courts, and before district courts where the value in dispute exceeds €5,000. The ordinary courts run in four tiers: 113 district courts, 20 regional courts, four higher regional courts and the Supreme Court in Vienna.
What Austrian proceedings cost and when legal aid applies
Court fees are levied under the Gerichtsgebührengesetz and generally become payable when a claim is filed; in civil proceedings the losing party bears the court fees and reimburses the winner’s costs. Lawyers’ fees follow the Rechtsanwaltstarifgesetz, although written agreements and hourly rates are possible. Verfahrenshilfe may be granted where a party cannot meet costs without impairing necessary maintenance and the case is not without prospect of success.

The problem
What makes a removal case in Austria so time-sensitive
The decision is written in German, it names the authority and the date of service, and the period for a remedy starts running from there. Acting on the wrong assumption costs options.
A decision you cannot read fast enough
A ruling on your residence or removal arrives with periods and references you have not seen before. Without a lawyer who reads Austrian procedure daily, it is easy to lose the chance to have the decision reviewed.
Work, family and housing at risk
Removal affects your job, your tenancy, your children’s schooling and your ability to stay near your family. The choices made in the first days shape how the whole file develops.
Generalists miss the decisive detail
A removal file turns on specifics: which authority decided, which court reviews it and what the file already contains. A lawyer who handles these cases knows where to look and what to prepare.

Questions
Deportation and residence cases in Austria: common questions
How quickly should I contact a deportation lawyer in Austria?
There is no single answer that fits every procedure: the periods that apply depend on the statute governing your case and on the decision you have received. Because the period for a remedy runs from the date the decision is served, it is safest to have the document read by a lawyer as soon as it reaches you.
Which Austrian courts deal with removal and asylum appeals?
Administrative disputes in Austria are handled outside the ordinary courts. They go to the Landesverwaltungsgericht in each Land or to the Bundesverwaltungsgericht at federal level, with the Verwaltungsgerichtshof as the supreme administrative court and the Verfassungsgerichtshof as the constitutional court.
Do I need an Austrian Rechtsanwalt, or can a lawyer from my home country help?
Practising as a lawyer in Austria requires entry in the list of lawyers kept by a regional Bar association, and the title Rechtsanwalt is protected by law. A registered Austrian lawyer is entitled to appear before all courts and authorities in Austria, so local representation is normally the practical route.
Can I get financial help with the cost of Austrian proceedings?
Austrian law provides for Verfahrenshilfe, which a court may grant to a party who cannot meet the costs of proceedings without impairing the necessary maintenance of themselves and their family, where the case is not frivolous or without prospect of success. Whether it is available in your procedure depends on the statute that governs it, and a lawyer can assess this for you.
What if my case also involves criminal, divorce or custody issues?
Removal matters can overlap with criminal charges, divorce, custody or maintenance. Austria’s ordinary courts run through 113 district courts, 20 regional courts, four higher regional courts and the Supreme Court in Vienna, and a lawyer can coordinate what has to be filed where.
Does it cost anything to be matched with a lawyer?
No. You describe your situation, we look for a lawyer who handles this kind of case in Austria, and you decide whether to instruct them. Matching is free, confidential and places you under no obligation, and you agree the fee arrangement directly with the lawyer.
