Tenant law in Austria
Why the right lawyer changes the picture
Renting in Austria raises questions that are hard to settle alone: a deposit that is not returned, an unexpected rent increase, damp walls the landlord does not repair, or a notice you doubt is valid. When a tenancy dispute reaches a district court (Bezirksgericht), the proceedings are conducted in German and the written submissions have to be precise. When you search for a lawyer tenant law in Austria, what you need is a Rechtsanwalt who handles tenancy matters every day — someone who can read your contract, put your position in writing and, if necessary, represent you. Describe your case in a few minutes and we match you, free of charge and with no obligation.
Austria in practice
How tenancy disputes actually work in Austria
Austria is a civil-law country: the General Civil Code (ABGB) of 1811 is still in force, and the ordinary courts are arranged in four tiers. Tenancy matters are heard at first instance by the district courts (Bezirksgerichte). The points below explain what that means in practice if you rent or let property in Austria.
Tenancy cases begin at the district court
Austria’s ordinary courts have four tiers: 113 district courts (Bezirksgerichte), 20 regional courts (Landesgerichte), four higher regional courts (Oberlandesgerichte) and the Supreme Court (Oberster Gerichtshof, OGH) in Vienna. Tenancy disputes, together with family and probate matters, start before a district court, while larger civil claims are heard by a regional court.
When representation by a lawyer is compulsory
Representation by a lawyer is mandatory before the regional courts and all higher courts, and before a district court whenever the value in dispute exceeds €5,000 (section 27 ZPO). Below that threshold you may appear in person. An Austrian Rechtsanwalt is entitled to appear before every court and authority in the country.
Who is allowed to practise as a lawyer
Practising as a Rechtsanwalt requires entry in the list of lawyers kept by a regional Bar association (Rechtsanwaltskammer), so Bar membership is compulsory. The route involves an Austrian law degree, five years of practical training including time at a court, the bar examination, mandatory training events and professional liability insurance. The title is protected by law.
What a tenancy case is likely to cost
Court fees under the Gerichtsgebührengesetz are generally payable when a claim is filed and, in civil proceedings, are calculated as a staggered percentage of the value in dispute; an official fee calculator is available on the JustizOnline portal. As a general rule the losing party bears the court fees and reimburses the winner’s costs (sections 40 ff. ZPO).
Legal aid for tenants on a tight budget
Verfahrenshilfe is granted by the court on application if you cannot meet the costs of proceedings without impairing the necessary maintenance of yourself and your family, provided the case is not frivolous or without prospect of success. It covers exemption from court fees and, where representation is required, the free provision of a lawyer. It must be repaid if your financial situation improves.
Limitation periods and how the law is interpreted
Rent and other recurring payments fall under a three-year limitation period, as do damages claims and trade receivables, while general contractual claims can be pursued for 30 years. Austria is not a common-law precedent system, yet decisions of the Supreme Court guide the uniform interpretation of the law across all courts.
Key time limit — Property & Real Estate Law
Recurring payments (rent, interest, maintenance arrears) — 3 years. Covers arrears of rent and comparable periodic payments, so unpaid rent should not be left to accumulate.

Common difficulties
What tenants in Austria are up against
Three problems come up again and again when people contact us about a tenancy in Austria.
Correspondence arrives in German
Court and landlord letters are written in German and follow formal patterns. Missing a point in a submission can weaken an otherwise strong position, particularly in a tenancy file before a Bezirksgericht.
Costs feel impossible to predict
Court fees under the Gerichtsgebührengesetz are calculated as a percentage of the value in dispute, and the losing party generally pays both sides’ costs. Without a lawyer, exposure is hard to estimate.
Deadlines pass unnoticed
Rent arrears, damages claims and trade receivables fall under a three-year limitation period, while other Austrian time limits are counted in weeks. Delay can turn a recoverable claim into one a court will refuse.
Why use our matching
Matched with a lawyer who handles Austrian tenancy files
You explain the situation once; we do the searching.
A tenancy-focused practitioner
We look for a Rechtsanwalt whose work covers tenancy, rent and property disputes, so your file is not the first of its kind that your representative has seen.
Your situation described in plain English
You do not have to draft anything in German. Tell us what happened in your own words, and the lawyer takes over the formal German correspondence from the start.
Costs clarified before you commit
Austrian lawyers’ fees follow the Rechtsanwaltstarifgesetz and the general fee criteria, or a separate written agreement. You can ask about the basis of billing before instructing anyone.
One file, the right forum
Tenancy cases begin before a district court, and larger civil claims go to a regional court. Matching you with a lawyer in Austria means proceedings are run in the correct forum and language.
Cross-border situations
If your tenancy touches another country
Tenancy rules and court procedure differ from one jurisdiction to the next. If your dispute has a cross-border element — a landlord abroad, a flat in another country, a deposit held elsewhere — tell us and we will look for a lawyer in the relevant country.
Questions and answers
Tenancy law in Austria: what clients ask
Do I need a lawyer for a tenancy dispute in Austria?
Not always. Before a district court (Bezirksgericht) you may appear in person where the value in dispute does not exceed €5,000. Above that threshold, and before regional courts and all higher courts, representation by a Rechtsanwalt is mandatory under section 27 ZPO.
What does it cost to find a lawyer tenant law in Austria through your platform?
Nothing. Describing your situation and being matched is free, and there is no obligation to instruct anyone. You pay the lawyer’s fees only if you decide to proceed; those fees follow the Rechtsanwaltstarifgesetz and the general fee criteria, or a separate written fee agreement.
Which Austrian court hears a tenancy case?
Tenancy disputes are dealt with at first instance by the district courts (Bezirksgerichte), of which Austria has 113. Larger civil cases go to the regional courts (Landesgerichte). Appeals go to the higher regional courts (Oberlandesgerichte), and the Supreme Court (Oberster Gerichtshof) in Vienna is the highest civil instance.
My deposit has not been returned — is there a deadline to act?
Austrian limitation periods depend on the nature of the claim: general contractual claims can be pursued for 30 years, while recurring payments, trade receivables and damages claims are subject to a three-year period. A lawyer can establish which of these applies to your deposit claim and whether the time limit is still running.
Can I get legal aid for a tenancy case in Austria?
Verfahrenshilfe may be granted by the court under sections 63 ff. ZPO if you cannot meet the costs of proceedings without impairing the necessary maintenance of yourself and your family, and the case is not frivolous or without prospect of success. It covers court fees and, where representation is required, a lawyer.
In which language are Austrian tenancy proceedings conducted?
German. The ordinary courts, including the district courts that hear tenancy matters, operate in German and written submissions must be drafted in that language. You can explain your situation to us in English, and the lawyer handles the German side of the case.
