Consumer rights in Albania

A consumer dispute in Albania: what you are actually dealing with

A dispute over a faulty appliance, a service you paid for and never received, or a clause buried in an online contract rarely stays small: the money at stake may be modest, but the paperwork, the correspondence and the legal framework are not. Albania follows the continental civil law tradition, and the ordinary courts sit at first instance in each judicial district, with courts of appeal and the High Court in Tirana above them. Because Albanian law attaches statutory limitation periods to different types of claim, the first practical question is often how much time is left. A consumer rights lawyer in Albania can review your documents, assess what is realistically recoverable and tell you which route fits your case. Our free matching service puts you in contact with a specialist — no charge, no obligation.

Albania in practice

How consumer complaints work in the Albanian system

Consumer disputes in Albania are handled against the background of a continental civil law system that has been reshaped by the 2016 justice reform. Two things decide most cases before they start: which court can hear the matter, and whether the claim is still within its limitation period.

Where a claim is heard

Albania follows the continental civil law tradition. Under Law no. 98/2016 the ordinary judiciary comprises courts of first instance — one per judicial district, which may cover one or more municipalities — and courts of appeal. The High Court in Tirana reviews matters through its Civil, Criminal and Administrative Chambers, while administrative disputes belong to the Administrative Court of First Instance and the Administrative Court of Appeal, both seated in Tirana.

Who may act for you

The profession of lawyer (avokat) is regulated by Law no. 55 of 23 July 2018. It is a free, independent and self-regulated profession, and membership of the National Chamber of Advocacy is compulsory in order to practise. To qualify, a candidate must hold the integrated Master degree in law, complete a one-year internship as an assistant lawyer, pass the bar qualification examination and be registered in the Chamber’s register.

Representation and powers of attorney

Under the Code of Civil Procedure the parties may defend themselves personally, except where the law requires mandatory representation, and are otherwise free to be represented by a lawyer or another authorised representative. Representation by a lawyer is required before the higher courts. A power of attorney authorising a representative to act before the courts must, as a rule, be made by notarial act under Article 72 of the Civil Code.

Court fees and legal fees

Judicial tariffs are governed by Law no. 98/2017 and are calculated on the value of the claim, subject to statutory minimum and maximum amounts that differ by instance; the fee is normally paid on filing the claim or appeal. Lawyers’ fees, by contrast, are freely agreed between lawyer and client in a written contract, as Albania has no binding official tariff for private legal services. The losing party may be ordered to reimburse the successful party’s procedural costs.

State-guaranteed legal aid

Law no. 111/2017 created a state-guaranteed legal aid system with two levels: primary legal aid covering information, advice and assistance outside court, and secondary legal aid covering representation by a lawyer in court. Beneficiaries are also exempted from court fees and from enforcement costs. The system is administered by the Free Legal Aid Directorate under the Ministry of Justice and targets people lacking sufficient means as well as specific vulnerable groups.

Why timing is decisive

Albanian civil claims are subject to statutory limitation periods that vary sharply with the type of matter — from one year for non-property damage to ten years for general contractual claims. A lawyer can check the relevant period, preserve evidence and, where the file is still fresh, take a formal step early so that correspondence does not quietly run the claim out of time.

All country information on this page is drawn from official Albanian and European sources — the Ministry of Justice, the National Chamber of Advocacy, WIPO Lex and the Council of Europe (CEPEJ) country profile for Albania — as published in 2026.

Typical situations

What clients bring to us

Consumer files are usually small in value and heavy in frustration. These are the three patterns we see most often.

01

The seller stops replying

You have written, called and sent photographs, and the answer is silence or a template email. Without a formal step, the file drifts on until it reaches the point where pursuing it is no longer worth the effort.

02

You do not know the deadline

Albanian limitation periods differ by type of claim — one year for non-property damage, two for insurance compensation, three for tort, up to ten for general contractual claims. Guessing wrong can end a good case before a court looks at it.

03

Costs feel unpredictable

Albania has no binding official tariff for private legal services, so fees depend on the written agreement you reach with your lawyer, while the court fee follows judicial tariffs based on the value of your claim.

Why use the matching service

What you get before you commit to anything

Matching is free, discreet and designed to give you a clear picture of your options first.

Matched to a consumer specialist

We look at your documents and the nature of the dispute — faulty goods, a paid-for service, insurance or contract terms — and put you in contact with a lawyer whose practice covers that area.

Free and without obligation

Matching costs you nothing and does not commit you to instructing anyone. You decide whether to go ahead after you have spoken to the lawyer and understood both the approach and the fees.

Fees agreed in advance

Legal fees in Albania are freely agreed between lawyer and client by written contract. Before signing anything, you can ask how the fee is calculated, when it falls due and what it covers.

Legal aid flagged early

Where your means are limited, state-guaranteed legal aid under Law no. 111/2017 can cover advice and court representation, plus exemption from court fees and enforcement costs. We tell you when it may apply.

Questions and answers

Consumer rights in Albania — FAQ

What can a consumer rights lawyer in Albania help me with?

A consumer rights lawyer in Albania can review the contract, invoice or correspondence behind your complaint, explain which limitation period applies to your type of claim, draft a formal demand, and represent you before the ordinary courts where the matter is not settled out of court. We match you with a lawyer whose practice covers your kind of dispute.

How much does it cost to instruct a lawyer in Albania?

Lawyers’ fees in Albania are freely agreed between lawyer and client by written contract, because there is no binding official tariff for private legal services. To start proceedings you also pay a court fee under Law no. 98/2017, calculated on the value of the claim. Where you win, the losing party may be ordered to reimburse your procedural costs.

Can I get legal aid for a consumer dispute?

State-guaranteed legal aid is regulated by Law no. 111/2017 and administered by the Free Legal Aid Directorate of the Ministry of Justice. Primary legal aid covers information, advice and assistance outside court; secondary legal aid covers representation by a lawyer in court. It is available to people lacking sufficient means under income thresholds and to certain vulnerable groups.

Do I have to appear in court myself?

Under the Code of Civil Procedure the parties may defend themselves personally, except where the law requires mandatory representation, and are otherwise free to be represented by a lawyer or another authorised representative. Before the higher courts, representation by a lawyer is required. A power of attorney to act before the courts must, as a rule, be made by notarial act.

How long do I have to bring a claim?

It depends on the type of claim. Albanian law sets ten years for general contractual and civil claims, three years for rent arrears, tort and unjust enrichment, two years for insurance compensation, one year for non-property damage such as reputation, and 180 days for an unlawful-dismissal claim. A lawyer can confirm which period applies to your file.

Which courts deal with disputes in Albania?

The ordinary judiciary comprises courts of first instance, one per judicial district, and courts of appeal, with the High Court in Tirana reviewing matters through its Civil, Criminal and Administrative Chambers. Administrative disputes go to the Administrative Court of First Instance and the Administrative Court of Appeal, both seated in Tirana.
