How tenant disputes work in Croatia, and where a lawyer fits in
If you rent a home or business premises in Croatia and something has gone wrong — unpaid rent, a withheld deposit, repairs that are never done — the practical question is who can act for you and how quickly. Croatia is a continental, civil-law jurisdiction built on codified legislation such as the Civil Obligations Act (ZOO), so your contract is read against the statute rather than against earlier judgments. Timing matters: claims for rent arrears prescribe in three years, while some procedural steps must be taken within days. Finding a lawyer tenant law in Croatia specialist who already knows the municipal and county courts, the fee rules and electronic filing saves time and money. Tell us what happened and we match you with a Croatian lawyer, free of charge.
Croatia in practice
Key facts that shape a tenancy dispute in Croatia
Croatian tenancy problems are decided inside a continental court system and a codified legal framework. These are the practical features that most often shape how a case is run.
Codified law, not case law
Croatia follows the continental tradition: the primary source of law is codified legislation, and the system is close to the German and Austrian models. Lease and contract disputes are argued from the Civil Obligations Act (ZOO) and the other codes rather than from earlier rulings, so the wording of your contract and of the statute carries most of the weight.
Which court decides your case
Croatia has 34 municipal courts (općinski sudovi) and 15 county courts (županijski sudovi). Civil proceedings at first instance are normally brought before a municipal court, and an appeal is decided by the county court. A lawyer who appears regularly in these courts knows the local practice and the filing requirements.
Rent arrears: three years, not five
Under the Civil Obligations Act, rent is treated as a periodic payment, and claims for periodic payments prescribe in three years, while general contractual claims prescribe in five. That difference matters in practice: time spent waiting before instructing a lawyer narrows what remains open to you.
Who may represent you
Membership of the Croatian Bar Association (Hrvatska odvjetnička komora) is compulsory in order to practise as an odvjetnik, and the Bar both represents and regulates the profession under the Attorneys Act. In civil proceedings you may in principle act in person at first instance, but a lawyer is mandatory for extraordinary legal remedies before the Supreme Court and for certain other steps prescribed by the Civil Procedure Act.
Costs, fees and electronic filing
Court fees follow the Court Fees Act and the Court Fee Tariff, and a submission filed electronically through the court’s information system is charged at half the prescribed fee where the conditions are met. Lawyers’ fees are set by the Croatian Bar Association’s Tariff in tariff points, plus VAT and expenses, and the losing party may be ordered to reimburse the other side’s costs.
Free legal aid for those who qualify
The Free Legal Aid Act provides a two-tier system: primary aid covers legal information, advice and the drafting of submissions, while secondary aid covers representation in court, including exemption from costs. Applications are handled by the administrative bodies of the counties and of the City of Zagreb, which assesses whether the applicant is socially or economically disadvantaged.
Key time limits — Property & Real Estate Law
| Matter | Deadline | Note |
|---|---|---|
| Periodic payments (interest, maintenance) | 3 years | Recurring sums fall under the shorter period rather than the general one. |
| Rent arrears recovery | 3 years | Rent counts as a periodic payment, so the shorter limitation period applies. |

Common situations
What clients bring to a Croatian tenant law lawyer
Most tenancy files in Croatia begin with one of these three problems.
Arrears that grow quietly
Unpaid rent is a periodic payment in Croatian law, so the limitation period is shorter than for ordinary contracts. Delay narrows your options, and the file is far easier to act on while the tenancy is still running.
A deposit held without explanation
Deposit disputes usually turn on the written contract and on what was agreed about wear and tear. A lawyer reads the paperwork, identifies what is genuinely arguable and sets out the claim before positions harden.
Repairs you have asked for repeatedly
Where a landlord ignores requests for repairs, the answer lies in the contract and in the Civil Obligations Act. A lawyer can put the request in writing, document the damage and advise on the appropriate court route.
Why use the matching service
How we help you find the right Croatian lawyer
Four practical reasons clients use us instead of searching alone.
Croatian-qualified lawyers only
Every lawyer we introduce is registered with the Croatian Bar Association (HOK) and entitled to practise as an odvjetnik, so you are dealing with a professional bound by the Attorneys Act and by the Bar’s own rules.
A first reading of your contract
Bring the lease, the correspondence and any notices. The lawyer reviews the documents against the Civil Obligations Act and tells you where you actually stand before you commit to anything further.
Fees you can see in advance
Lawyers’ charges in Croatia follow the Bar’s Tariff, calculated in tariff points plus VAT and out-of-pocket expenses. The lawyer explains the basis of the fee and the risk of a costs order from the outset.
Help with filing and deadlines
Court filings, service and time limits are handled by the lawyer, including electronic submissions through the court’s information system, which attracts a reduced court fee where the statutory conditions are met.

Questions and answers
Tenant law in Croatia: what clients ask us
Do I need a lawyer tenant law in Croatia specialist for a housing dispute?
Not always at first instance: in civil proceedings a party may in principle act in person before a municipal court. Representation by a lawyer is, however, mandatory for extraordinary legal remedies before the Supreme Court and for certain other steps prescribed by the Civil Procedure Act. A lawyer tenant law in Croatia specialist also handles electronic filings and service.
How long do I have to claim unpaid rent in Croatia?
Three years. Rent is treated as a periodic payment under the Civil Obligations Act, and claims for periodic payments prescribe in three years, whereas general contractual claims prescribe in five. What has happened between the parties can affect how the period is calculated, so take advice early rather than counting the years yourself.
Which Croatian court hears landlord and tenant cases?
First-instance civil proceedings are normally brought before one of Croatia’s 34 municipal courts (općinski sudovi). An appeal is decided by the relevant county court (županijski sud), of which there are 15, and the Supreme Court of the Republic of Croatia is the court of last instance.
How are lawyers’ fees calculated in Croatia?
Lawyers’ fees are governed by the Tariff on Remuneration and Reimbursement of Costs for Lawyers’ Work (NN 138/2023), in force since 25 November 2023 and adopted by the Croatian Bar Association with the consent of the Minister of Justice. Fees are calculated in tariff points whose value is published in the Official Gazette, and the client’s cost is increased by VAT and out-of-pocket expenses.
Can I get free legal aid in Croatia for a tenancy matter?
The Free Legal Aid Act provides primary aid, covering legal information, advice and the drafting of submissions, and secondary aid, covering representation in court proceedings including exemption from costs and court fees. Applications are handled by the administrative bodies of the counties and of the City of Zagreb, and the right is granted to socially and economically disadvantaged citizens.
Does the land register matter in a tenancy dispute?
It can, where the dispute also concerns ownership of the property. In Croatia ownership of immovable property passes only by registration in the land register (zemljišna knjiga) kept by the municipal court, and since 10 February 2023 applications must be filed electronically through a notary public or lawyer as mandatory users of the shared ZIS system.
