Tenancy law in Bosnia and Herzegovina

What a lawyer tenant law in Bosnia and Herzegovina does for you

Renting in Bosnia and Herzegovina rarely creates a problem until something goes wrong — a landlord who keeps the deposit, a tenant who stops paying, a building that is not maintained, or a lease signed without reading it properly. Because private law here is made at entity level, the same dispute can follow different rules depending on whether the flat sits in the Federation of BiH, the Republika Srpska or the Brčko District. A lawyer tenant law in Bosnia and Herzegovina knows which statute applies, which court has jurisdiction and which time limits are running, and can draft a demand, negotiate a settlement or represent you in proceedings. Our role is simpler: we listen to your situation and match you, free of charge, with a specialist whose practice is built on tenancy and housing disputes in the relevant entity.

Local framework

How tenancy matters work in Bosnia and Herzegovina

Tenancy relationships are shaped by entity legislation rather than by a single State-wide private-law code, and the courts that hear disputes are organised along the same lines. The structural points below are the ones that most often decide how a tenant or landlord case is run.

Three legal orders in one country

Bosnia and Herzegovina has no single body of private law. The State, the Federation of BiH with its ten cantons, the Republika Srpska and the self-governing Brčko District each legislate on matters such as obligations, real property, notaries and civil procedure. Which rules apply to a lease therefore depends on where the property is located.

Which court will hear the dispute

In the Federation of BiH, first-instance jurisdiction lies with the Municipal Courts, with Cantonal Courts on appeal and the Supreme Court of the Federation of BiH as the highest court. In the Republika Srpska, Basic and District Courts sit at first instance, with the Supreme Court of the Republika Srpska as the highest instance. The Brčko District has its own Basic Court and Appellate Court.

Who is entitled to represent you

Admission to a bar association is compulsory in order to practise law, and the Federation of BiH, the Republika Srpska and the Brčko District each keep their own register. Under the Law on the Legal Profession of the Federation of BiH, admission requires citizenship, a completed law degree, the bar examination and the attorney examination, at least two years of legal work experience and suitable office premises. Only attorneys entered in these registers may represent parties before the courts.

Time limits are not uniform

Limitation periods differ by entity and by the type of claim, so the first step in any arrears or damages file is to identify the applicable law. General contractual claims are limited in five years in the Federation of BiH and ten years in the Republika Srpska, while rent and other periodic payments follow a three-year period and household utility claims one year.

Notarial form for property transactions

Under the Law on Notaries of the Federation of BiH, the transfer and encumbrance of immovable property, and other acts requiring solemn form, must be executed as a notarial deed. The notary verifies identity and capacity, controls legality and gives the act public and executory force; the notarial deed is also a precondition for registration in the land register. Equivalent notary laws apply in the Republika Srpska and the Brčko District.

Costs and access to free legal aid

Attorneys’ fees follow the official tariffs adopted by the bar associations, which set minimum or guideline rates, while the parties may agree a different fee in writing. The losing party may be ordered to reimburse the prevailing party’s costs, including attorney fees assessed under the applicable tariff. Court fees are governed by the respective court-fee laws, and free legal aid is available before State institutions and the Court of Bosnia and Herzegovina, with entity and cantonal schemes and possible cost exemptions in civil cases.

Key time limit — Property & Real Estate Law

Rent and other periodic payments, including interest — 3 years. Periodic claims accrue instalment by instalment, so part of an arrears claim may already be time-barred.

Typical situations

Tenancy disputes we are asked about most

Most files start with a practical problem rather than a legal question. These are the three we see most often from tenants and landlords in Bosnia and Herzegovina.

01

Rent arrears and disputed bills

Unpaid instalments, contested utility charges or an invoice that arrives years later. Because periodic payments and household utility claims carry different time limits, the calculation has to be done claim by claim before anything is sent. 02

Deposit kept without explanation

A tenancy ends, the keys are returned, and the deposit is not. Whether the retention is justified depends on the lease, on the condition of the property and on the evidence gathered at handover — all of which a specialist will assess before advising on next steps. 03

Termination notices and pressure to leave

A notice arrives with a short deadline and unclear reasoning. The applicable entity law and the procedure actually followed both matter, so the notice and the surrounding correspondence should be reviewed before you respond or move out. How matching helps

Why clients use our free matching service

We are not a law firm. We are a matching platform that shortens the distance between your tenancy problem and a specialist who already works on that kind of file in Bosnia and Herzegovina.

Entity-matched expertise

Your case is routed to a specialist who practises in the entity or district where the property is located, so the applicable obligations law, court and limitation period are familiar territory from the first call.

Focused on tenancy work

You are matched with a professional whose practice regularly covers leases, rent arrears, deposits, maintenance duties and termination, rather than a generalist encountering housing law occasionally.

Clear first step, no cost

You describe the situation once, in your own words. We compare it with the practices available and propose a match; you decide whether to continue, and no fee is charged for the matching itself.

You keep control of the fee

Fees are agreed directly between you and the specialist, within the framework of the bar association tariff for the relevant entity, and any written fee agreement is yours to negotiate and approve.

Questions and answers

Frequently asked questions about tenancy law in Bosnia and Herzegovina

What can a lawyer tenant law in Bosnia and Herzegovina do that I cannot do alone?

A specialist identifies which entity law governs your lease, which court has jurisdiction and which time limits are running, then drafts demands, negotiates or represents you in proceedings. Only attorneys entered in a bar association register may represent parties before the courts, so contested files normally require that step.

Does it matter whether the flat is in the Federation of BiH, the Republika Srpska or the Brčko District?

Yes. The State, the Federation of BiH with its ten cantons, the Republika Srpska and the Brčko District each legislate on obligations, real property, notaries and civil procedure. The substantive rules, the court hearing the case and sometimes even the limitation period depend on where the property is connected.

How long do I have to pursue unpaid rent?

Rent and other periodic payments, including interest, are subject to a three-year limitation period, and each instalment is assessed separately, so part of an arrears claim may already be time-barred. General contractual claims run for five years in the Federation of BiH and ten years in the Republika Srpska.

Can I be removed from the property without a court decision?

How a tenancy may be brought to an end and what has to happen before possession changes is set by the entity or district law that applies to your lease, and the procedure actually followed in your case matters as much as the notice itself. Have the notice and the correspondence reviewed before you respond.

Who is allowed to represent me in court in Bosnia and Herzegovina?

Admission to a bar association is compulsory in order to practise law. The Federation of BiH, the Republika Srpska and the Brčko District each maintain their own register, and admission requires citizenship, a law degree, the bar examination and the attorney examination, at least two years of legal work experience and suitable office premises.

What will representation cost, and is there any free legal aid?

Attorneys’ fees follow the official tariffs adopted by the entity bar associations, which set minimum or guideline rates, while a different fee may be agreed in writing with the attorney. The losing party may be ordered to reimburse the prevailing party’s costs. Free legal aid exists for proceedings before State institutions and the Court of BiH, with entity and cantonal schemes and possible cost exemptions in civil cases.
