The Guernsey context

Employment contracts under Guernsey law

Disagreements over a Guernsey employment contract rarely follow the English pattern people expect. Guernsey is a Crown Dependency with its own legislature and its own courts, and the core of its private law is Norman customary law onto which English common law and English-style statute law have been grafted. English case law is persuasive here, not binding. That is why an employment contract lawyer in Guernsey is worth consulting before you sign, vary or challenge a contract. Tell us what happened — a disputed notice period, unpaid commission, a restrictive covenant or a dismissal — and we match you, free of charge, with an Advocate of the Royal Court who handles Guernsey employment work. You decide whether to go ahead.

Local law in practice

How employment contract disputes work in Guernsey

Guernsey is a Crown Dependency and is not part of the United Kingdom. Its courts, its profession and its rules on time limits differ from England, and that shapes how an employment contract dispute is run from the first letter to any appeal.

A Crown Dependency with its own law

Guernsey has its own legislature, the States of Deliberation, its own courts and its own body of law, which applies in the Bailiwick of Guernsey, Alderney and Sark. The core of its private law is Norman customary law, with English common law and English-style statute law grafted on for well over a century. English case law is persuasive but not binding.

Where an employment dispute is heard

First instance in Guernsey lies in the Magistrate’s Court or the Royal Court. The Magistrate’s Court covers debt and damages claims in contract and tort up to GBP 10,000. The Royal Court’s Ordinary Court exercises general civil jurisdiction with a judge and, where facts are in issue, at least two Jurats, who are the judges of fact in civil cases.

Advocates, not solicitors and barristers

Advocacy in Guernsey is a fused profession. Advocates of the Royal Court are members of the Guernsey Bar and act both as instructing lawyer and as court advocate. They are admitted by the Full Court, take their oath in French and are officers of the Court. Non-advocate lawyers may practise Guernsey law only while employed or supervised by a firm of Advocates.

Prescription rather than limitation

Guernsey has no direct equivalent of the English law of limitation. It applies prescription, which is a matter of substantive law: it does not merely bar the remedy, it extinguishes the right of action. For breach of contract, including most employment contracts, the period runs six years from the accrual of the cause of action — normally the date of the breach.

Costs, funding and legal aid

Advocates bill by hourly rates, and Guernsey’s Costs and Fees Rules fix recoverable rates of GBP 351 per hour for Advocates and GBP 235.17 for associates from 1 January 2026, so a successful party typically recovers around 60% to 70% of actual spend. Costs follow the event. Contingency and success fee arrangements are prohibited; third-party litigation funding is permitted, and legal aid is means- and merits-tested.

French procedure, English practice

The court and the profession work in English, but the French legal inheritance remains visible: office and procedure names stay French (Greffe, cause, repliques, saisie), the Advocate’s oath is taken in French, and Advocates wear the toque rather than wigs. Enforcement against Guernsey real property follows the customary procedure known as saisie.

Key time limit — Employment Law

Unfair dismissal (employment) — 3 months from the effective date of termination. This is the period to notify the Employment and Equal Opportunities Service (EEOS) of the intention to complain.

The country data on this page is taken from official Guernsey sources — the Royal Court of Guernsey, the States of Guernsey, the EEOS and the Guernsey Bar — together with published practice guides, as issued by those bodies.

Common problems

Why Guernsey employment contracts cause trouble

Most disputes we see begin with a document drafted on assumptions that do not hold in the Bailiwick, or with a deadline nobody noticed.

01

The contract is drafted on English assumptions

Terms copied from a UK template may not sit comfortably with Guernsey law, prescription or the local courts. Reviewing the document before you sign or vary it is usually cheaper than arguing about it afterwards.

02

Deadlines move quickly

Three months to notify the EEOS of an unfair dismissal complaint; six years for a contractual claim. Guernsey prescription extinguishes the right of action itself, so delay is never a neutral choice.

03

Unclear who may act for you

Solicitors and barristers qualified elsewhere do not automatically have rights of audience in Guernsey. Only Advocates of the Royal Court do, and non-Advocates must work under the supervision of a firm of Advocates.

How we help

Matched with the right Guernsey Advocate

You describe the problem once; we identify the practice that handles it and introduce you.

Matched on your issue, not on a directory

We look at what your matter actually involves — notice, termination, restrictive covenants, pay — and match you with a Guernsey Advocate who handles employment contract work.

Local procedure understood

Your matter is handled with the Royal Court, the Magistrate’s Court and the EEOS notification step in mind, rather than the employment tribunal system used in England.

Costs explained before you commit

Guernsey caps the hourly rates recoverable from a losing party, and we make sure you can see what a dispute may realistically cost before instructing anyone.

No cost to be introduced

Describing your situation and receiving a match is free of charge. You choose whether to instruct the Advocate, and you are under no obligation to proceed.

Questions

Employment contracts in Guernsey: what clients ask

What does an employment contract lawyer in Guernsey actually do?

An employment contract lawyer in Guernsey advises on the contract itself — its terms, notice, restrictive covenants, commission and termination — and can act for you before the Guernsey courts if a dispute arises. Because advocacy here is a fused profession, an Advocate of the Royal Court both advises you and represents you in court.

How long do I have to claim for breach of an employment contract in Guernsey?

Guernsey applies prescription rather than limitation. For contractual claims, including breach of an employment contract, the period is six years from the date the cause of action accrued, normally the date of the breach. Prescription extinguishes the right of action itself rather than merely barring the remedy, so timing matters from the outset.

Is there a shorter deadline for unfair dismissal in Guernsey?

Yes. An unfair dismissal complaint must be notified to the Employment and Equal Opportunities Service (EEOS) within three months of the effective date of termination. That notification step is separate from the six-year prescription period that applies to ordinary contractual claims arising from the same relationship.

Which court will hear my Guernsey employment dispute?

It depends on the amount and the issues. The Magistrate’s Court deals with debt and damages claims in contract and tort up to GBP 10,000. Larger or more complex matters go to the Ordinary Court of the Royal Court, where a judge sits with at least two Jurats when facts are in issue; in civil cases the Jurats are the judges of fact.

Can a lawyer qualified outside Guernsey advise me on a Guernsey contract?

Lawyers who are not Advocates may practise Guernsey law only while employed or supervised by a firm of Advocates, and they must not hold themselves out as Advocates. They must state the jurisdiction in which they are qualified, and failing to do so is a criminal offence. Full rights of audience belong to Advocates of the Royal Court.

What could an employment contract dispute in Guernsey cost?

Advocates charge hourly rates, and the Costs and Fees Rules cap what can be recovered from the losing party: GBP 351 per hour for Advocates and GBP 235.17 for associates from 1 January 2026. A successful party typically recovers around 60% to 70% of its actual spend. Contingency and success fees are prohibited, and legal aid is means- and merits-tested.
