Employment law in the Netherlands
Dutch employment contracts, Dutch courts, Dutch deadlines
If you work in the Netherlands, or you are about to sign, change or end a Dutch employment contract, the rules that apply are Dutch and the procedure runs in Dutch. Employment disputes are heard by the kantonrechter, the subdistrict judge sitting inside one of the eleven rechtbanken, where you may appear without a lawyer; for civil claims above EUR 25,000 before the civil chamber of the rechtbank, representation by an advocaat is compulsory. Whether you are an employee facing dismissal, an employer preparing a termination, or an expatriate negotiating a contract, an employment contract lawyer in Netherlands can position your case against the Burgerlijk Wetboek, the preventive dismissal check and the deadlines that are already running. We do not give legal advice: we match you, free of charge, with a specialised Dutch advocate.
Netherlands in practice
How employment contract matters actually work in the Netherlands
The Netherlands is a civil-law jurisdiction: private law is codified in the Burgerlijk Wetboek and applied by professional judges without juries. For employment matters this means a short set of statutory deadlines, a compulsory pre-dismissal check, and a specialist subdistrict court that most employees can address directly.
Where employment cases are heard
Each of the eleven district courts (rechtbanken) contains a subdistrict sector, and the kantonrechter there handles all employment matters regardless of the amount in dispute. Contract, dismissal and wage claims are decided by professional judges; there is no jury. Parties may litigate before the kantonrechter without a lawyer, but written submissions usually shape the outcome.
The preventive dismissal check
An employer cannot simply terminate a Dutch employment contract. Dismissals for economic reasons or long-term incapacity require permission from the UWV employee-insurance agency; dismissals for personal reasons such as dysfunction, culpable conduct or a disturbed working relationship require an order of the kantonrechter dissolving the contract. A dismissal without the required permission is invalid and may lead to reinstatement or a fair compensation (billijke vergoeding).
Deadlines that are already running
Dutch employment timelines are short. A dismissal can be challenged within two months, the lapse period for vernietiging opzegging, while other termination-related claims must be brought within six months. General contractual claims lapse after five years, and damages claims based on onrechtmatige daad also expire after five years. Missing these dates normally ends the claim.
Who is allowed to represent you
The professional title advocaat is protected. Only lawyers entered on the tableau, the official register kept by the Nederlandse Orde van Advocaten, may practise; qualification requires a Dutch law degree, a three-year traineeship as advocaat-stagiair and the oath before the court. Before the kantonrechter representation is optional, but above EUR 25,000 in the civil chamber it is compulsory.
What a Dutch employment case costs
Advocates agree their fees freely with the client; the Netherlands has no binding statutory hourly tariff. Court fees (griffierecht) are payable by both parties, with lower rates for natural persons. Where income and assets fall below the statutory thresholds, a lawyer can apply for a toevoeging from the Raad voor Rechtsbijstand, so the State pays part of the costs and the client pays a means-tested own contribution.
Cross-border and expatriate contracts
Many Dutch employment contracts, especially in Amsterdam, Rotterdam and The Hague, involve a foreign employer, international mobility or a choice-of-law clause. Which court has jurisdiction, which law applies and whether Dutch mandatory employment protection reaches you are separate questions. Dutch proceedings run in Dutch before professional judges, so documents and legal argumentation matter greatly.

What employees and employers run into in the Netherlands
Most problems are not about the merits alone. They are about timing, procedure and knowing which Dutch body decides your case.
The clock is already running
In the Netherlands a dismissal can be challenged within two months and other termination claims within six months. Waiting to see how things develop often means losing the claim entirely, however strong the facts were.
Dutch procedure, Dutch language
Cases are decided by professional judges sitting in Dutch, with no jury. Without a lawyer who appears before the kantonrechter regularly, presenting facts and legal grounds in the form the court expects becomes difficult.
Fees feel unpredictable
Advocates set their own rates and court fees are payable by both sides. Comparing quotes is hard, and few people know that a toevoeging may cover part of the cost for lower incomes.

Questions and answers
Employment contracts in the Netherlands: common questions
Do I need an employment contract lawyer in Netherlands for a kantonrechter hearing?
Before the kantonrechter, the subdistrict judge who hears all Dutch employment cases regardless of value, you may conduct your own case without a lawyer. Representation is not compulsory, but an employment contract lawyer in Netherlands can prepare the written submissions, evidence and hearing where these cases are usually decided.
How long do I have to challenge a dismissal in the Netherlands?
Two months. A dismissal given without the required UWV permission or a dissolving order from the kantonrechter can be challenged within the two-month lapse period, and other termination-related claims must be brought within six months. These periods are short and generally cannot be extended.
What is the preventive dismissal check (preventieve ontslagtoets)?
An employer may not simply terminate a Dutch employment contract. Economic dismissals and dismissals for long-term incapacity need permission from the UWV; dismissals for personal reasons need the kantonrechter to dissolve the contract. Without that permission or order the dismissal is invalid and may lead to reinstatement or a fair compensation.
How much does an employment lawyer cost in the Netherlands?
Advocates agree their fees freely with the client, as there is no binding statutory tariff. Court fees (griffierecht) are payable by both parties, with lower rates for natural persons. If income and assets fall below the statutory thresholds, your lawyer can request a toevoeging, so the State pays part of the costs and you pay a means-tested contribution.
Can a foreign employer be brought before a Dutch court?
Often the real question is jurisdiction and applicable law rather than the substance. Dutch employment rules are mandatory in many situations, and cross-border contracts signed in Amsterdam, Rotterdam or The Hague frequently end up before a Dutch court. A lawyer can assess which forum and which law govern your contract.
Do Dutch courts follow earlier judgments?
Dutch court decisions are not formally binding precedent. The Hoge Raad in The Hague reviews points of law only, to keep the law uniform, and never re-examines the facts. Judges decide without a jury, so written argument and legal reasoning carry the weight in Dutch employment litigation.
