Why this page exists

A Hungarian property matter needs a Hungarian lawyer

If a tax decision concerns land, a flat or another piece of real property in Hungary, the paperwork quickly turns technical: the assessment itself, the deadline for challenging it, the fee payable to bring the matter before a court, and the question of who may represent you at each level. That is where a property tax lawyer in Hungary earns their keep. Hungarian private law has been gathered in a single Civil Code since 15 March 2014, and administrative decisions — including tax decisions — are contested through a separate procedure with very short timetables. Our role is not to advise you: it is to listen to your situation, confirm the essentials, and match you with an attorney-at-law whose practice covers property and tax disputes in Hungary. Matching is free and takes minutes.

Local framework

How property and tax matters work in Hungary

Hungary is a codified, continental jurisdiction: ownership, obligations and succession live in one Civil Code, while challenges to administrative decisions follow a separate procedure with strict timetables. In practice, the first question in any property tax file is not what the law says, but which deadline has already started to run.

One codified Civil Code since 15 March 2014

Hungarian private law was re-codified in Act V of 2013, the Polgári Törvénykönyv, which entered into force on 15 March 2014 and replaced the 1959 Civil Code. Property, obligations, family law, companies and succession now sit in a single instrument of eight Books. For owners, that means questions about a property, its transfer and its inheritance are read together rather than in isolation.

Administrative decisions: a 15-day appeal window

Where a decision is issued in an administrative procedure — the route by which most tax matters reach the taxpayer — the statutory appeal period is 15 days. Hungarian practitioners treat the days immediately after notification as decisive, because the appeal must be prepared and lodged inside that window. Anyone weighing a challenge should therefore take a first legal view early rather than waiting for the complete picture.

Four tiers of courts, without subordination

Hungary has 158 courts arranged in four tiers: district courts (járásbíróság), administrative and labour courts (közigazgatási és munkaügyi bíróság), regional courts (törvényszék) and regional courts of appeal, headed by the Curia (Kúria) in Budapest. Higher courts may not instruct lower ones and judges are independent; the Curia secures consistency through decisions that bind the courts. Around 11,000 people work in the system, just under 3,000 of them judges.

Who may act for you, and when it is compulsory

Only attorneys-at-law, law offices and registered in-house legal counsels may act as agents in an action, and every practising attorney must belong to one of the regional bar associations that form the Hungarian Bar Association (MÜK). Representation is mandatory in Hungarian civil litigation as a general rule, but not in actions within the jurisdiction of the district courts, where parties may appear in person.

Court fees and lawyers’ fees

Court fees in contentious civil proceedings follow a tiered scale under Act XCIII of 1990, reformed on 28 January 2025, instead of a flat percentage of the claim. Where the claim concerns residential property valued between HUF 10,000,001 and HUF 250,000,000, only half of the calculated amount is payable. Lawyers’ fees are freely agreed between attorney and client by mandate — there is no binding statutory tariff.

Succession and matrimonial property

Hungarian succession law limits testamentary freedom through the compulsory share (kötelesrész): the descendant, spouse and parent of the estate leaver may claim one-third of what intestacy would have given them, and that claim lapses after five years. Unless a matrimonial property contract says otherwise, a community of property exists between spouses during the marriage. Both rules shape who ultimately owns a property, which is often the first question in any dispute about it.

Typical situations

What clients bring to us about Hungarian property tax

Most people do not arrive with a neatly defined legal question. They arrive with a document, a date and a worry.

01

A decision you do not understand

The assessment arrives, the figures look wrong, and nobody explains which part of the calculation can actually be challenged. By the time you find out, part of the appeal window may already have gone.

02

Nobody tells you who can represent you

Representation rules change from one court level to the next in Hungary, and a misplaced filing can be refused. You need to know whether your matter requires an attorney-at-law from the outset, before you spend money on the wrong route.

03

Costs that are hard to predict

Court fees are tiered rather than flat, and lawyers’ fees are freely negotiated instead of being fixed by a tariff. Without a comparison it is hard to tell whether the fee you have been quoted is ordinary for the work involved.

How matching helps

Why clients use our matching service for Hungary

We do not practise law and we do not give advice. We do one thing: put your matter in front of the right Hungarian attorney, quickly and without cost.

Attorneys admitted in Hungary

Every lawyer we match you with is a member of a regional bar association and practises under Act LXXVIII of 2017, with mandatory continuing training and professional indemnity cover. You can verify registration before you commit to anything.

Property and tax focus

We ask about the substance of your matter first and match on it: assessments, ownership questions, succession and property division. You are not handed to a general practice that happens to answer the phone.

Deadlines flagged early

Short procedural windows, such as the 15-day administrative appeal, are the first thing a Hungarian practitioner will check with you. Flagging them early is what stops a good case from being lost through silence.

Free and without obligation

Describing your situation costs nothing and commits you to nothing. If one of the matched lawyers is a fit, you decide whether to instruct them and on what terms; if not, you walk away.

Cross-border matters

Property in Hungary, life somewhere else

Many of the files we see involve owners, heirs or spouses resident outside Hungary. A Hungarian attorney can act in proceedings in Hungary, while questions about your home country may need a lawyer there as well.

Questions clients ask

Property tax and property disputes in Hungary

How quickly must I act if I disagree with a tax decision in Hungary?

Where a decision is issued in an administrative procedure, the statutory appeal window is 15 days. That period runs from notification, not from the moment you find time to study the file, which is why Hungarian practitioners advise speaking to an attorney-at-law as soon as the decision arrives.

Do I need a property tax lawyer in Hungary, or can I act on my own?

Representation by an attorney-at-law is mandatory in Hungarian civil litigation as a general rule, but not in actions falling within the subject-matter jurisdiction of the district courts (járásbíróság), where parties may appear in person. Before the regional court and the higher courts, only an attorney, a law office or a registered in-house legal counsel may act.

What does it cost to bring a property claim before a Hungarian court?

Court fees follow a tiered scale under Act XCIII of 1990, reformed on 28 January 2025. Where the claim concerns residential property valued between HUF 10,000,001 and HUF 250,000,000, only 50% of the calculated amount is payable. Lawyers’ fees are freely agreed — there is no binding statutory tariff.

Is legal aid available in Hungary?

Act LXXX of 2003 on legal aid provides support for advice, document drafting and representation in civil, labour and administrative matters for persons without sufficient means, and can cover exemption from or deferral of procedural costs. Eligibility is measured against the social reference base, whose forint value is set each year in the central budget act.

Who inherits a property in Hungary, and can a will leave me out?

Hungarian succession law protects a compulsory share (kötelesrész): the descendant, spouse and parent of the estate leaver are entitled to one-third of what they would have received on intestacy. A compulsory-share claim lapses after five years, and a beneficiary may only be excluded by a valid disinheritance on statutory grounds.

If I am married, does my spouse automatically own part of the property?

Unless the spouses agree otherwise in a matrimonial property contract, a matrimonial community of property exists between them during the marital community of life under the Civil Code. That default regime is decisive in divorce and asset division, including where the property, or the spouses, have a cross-border element.
