Why this page exists

Property tax problems in Slovakia are rarely only about tax

Property tax questions in Slovakia seldom arrive alone. An assessment on land or buildings, a dispute over how a charge has been calculated, the tax side of an inheritance, or a sale where the Land Register entry has still not gone through — each of these mixes tax procedure with civil and administrative law. That is where a property tax lawyer in Slovakia earns their place: someone who reads the decision, identifies which time limit applies and drafts the challenge before it lapses. Our platform introduces you to Slovak-qualified lawyers who work in this field, and we do not charge you for the introduction. You describe the problem once, we match you with a lawyer who handles property and tax matters, and you decide whether to instruct them.

Local context

How property tax and property rights work in Slovakia

Slovakia is a civil-law country whose legal order rests on written codes, including the Constitution, the Civil Code and the procedural codes. Property and tax questions are decided by ordinary courts and, for public-administration decisions, by a separate administrative judiciary.

Who may act for you

Legal services are reserved to lawyers entered in the register of the Slovak Bar Association (SAK), an independent self-governing body supervising practice under Act No 586/2003 Coll. on the Legal Profession. Notaries and enforcement officers act within their own fields. A property tax lawyer in Slovakia therefore holds a Slovak qualification and answers to the SAK’s disciplinary system.

Reviewing a tax decision

Since 2023 a self-standing administrative judiciary — the Supreme Administrative Court of the Slovak Republic and three administrative courts established by Act No 151/2022 Coll. — reviews the legality of public-administration decisions and protects against unlawful interference by public authorities. An administrative appeal must generally be lodged within 15 days, and the authority has 30 days, or 60 in complex cases, to decide.

No inheritance, gift or transfer tax

Slovakia abolished inheritance tax and gift tax from 1 January 2004 and repealed real-estate transfer tax from 1 January 2005. No inheritance, estate, gift or stamp duty applies when real property passes, whatever the value or the heir’s relationship to the deceased. Succession itself is handled in court-supervised probate proceedings under the Civil Code and the Code of Non-Contentious Civil Procedure.

Registration, not signature, transfers ownership

The Land Register (kataster nehnuteľností) applies the constitutive principle: ownership and other rights to real property are acquired only on registration, not when the contract is signed. Entries are made by district offices. Registering an ownership right costs a flat EUR 66, or EUR 33 for electronic filing, and registration is what makes the transfer effective against third parties.

Costs and language before the authorities

Court fees follow Act No 71/1992 Coll.: generally 6% of the value in dispute, with a minimum of EUR 25 and a cap of EUR 33,000 for ordinary civil claims, plus fixed fees for other acts, and no VAT. Slovak is the language of judicial and administrative proceedings, so parties who do not command it are entitled to an interpreter and documents are served in Slovak.

Representation and legal aid

In civil proceedings a natural person may act in person before district and regional courts, but representation is mandatory for a dovolanie to the Supreme Court and before the Constitutional Court. Where means are limited, the Centre for Legal Aid, established under Act No 327/2005 Coll., may provide a state-funded lawyer in civil, commercial and administrative-justice matters, deciding within 30 days of a complete file.

Common situations

What brings clients to us

These are the patterns we see most often when a Slovak property matter also involves a tax authority, a register or an estate.

01

Deadlines move faster than you expect

An administrative appeal against a first-instance decision generally has to be filed within 15 days. If it is missed, the decision may become final and you are left looking for other remedies.

02

Tax questions are entangled with title

Slovak property rights pass only on registration in the Land Register, so a tax dispute often sits alongside an unfinished ownership entry, an inherited share or a settlement of community property between spouses.

03

Language and procedure are unfamiliar

Slovak is the language of judicial and administrative proceedings and documents are served in Slovak. Owners and heirs living abroad often find they need a Slovak-speaking professional to read the decision and respond in time.

How we help

What matching through our platform gives you

We are not a law firm. We introduce you to Slovak-qualified lawyers and leave the legal work, the fees and the strategy to them.

Slovak-qualified specialists

Every lawyer we introduce is entered in the register of the Slovak Bar Association under Act No 586/2003 Coll. on the Legal Profession, which supervises practice and exercises disciplinary power.

One introduction across several fields

Property files touch administrative procedure, the Civil Code, succession and the Land Register. We look for a lawyer whose practice covers the combination your matter actually needs.

Clear costs before you instruct

Slovak lawyers’ fees follow Implementing Decree No 655/2004 or a contract fee agreed with the client. You discuss the basis of charging with the lawyer directly, before any engagement begins.

Explanations in your language

Proceedings before the authorities run in Slovak and documents are served in Slovak. We look for lawyers who can explain each procedural step to you in English while acting for you in Slovak.

Cross-border matters

Property in Slovakia, owner elsewhere

Owners, heirs and buyers living outside Slovakia often need a Slovak-qualified professional. We also work with clients and lawyers in these countries.

Frequently asked

Questions about property tax matters in Slovakia

Do I need a property tax lawyer in Slovakia to deal with the tax authority?

Not in every case: in civil proceedings a natural person may act in person before district and regional courts. Representation is mandatory for a dovolanie to the Supreme Court and before the Constitutional Court. In a first-instance tax dispute, a Slovak-qualified lawyer can read the decision, prepare the appeal and manage the 15-day deadline.

Which courts review Slovak tax and property tax decisions?

Since 2023 a separate administrative judiciary — the Supreme Administrative Court of the Slovak Republic and three administrative courts created by Act No 151/2022 Coll. — reviews the legality of public-administration decisions and protects against unlawful interference by public authorities. The Constitutional Court remains the guardian of constitutionality and hears individual constitutional complaints.

Is there inheritance or gift tax on Slovak property?

No. Slovakia abolished inheritance tax and gift tax from 1 January 2004 and repealed real-estate transfer tax from 1 January 2005. No inheritance, estate, gift or stamp duty applies when real property passes, whatever its value or the heir’s relationship to the deceased. Succession is handled in court-supervised probate proceedings.

Must a lawyer in Slovakia be registered with the Bar?

Yes. Practice is reserved to lawyers entered in the register maintained by the Slovak Bar Association (SAK) under Act No 586/2003 Coll. on the Legal Profession, which supervises proper practice and exercises exclusive disciplinary power. In-house lawyers are not members of the Bar and are not regulated as a profession.

What does registering a property right in the Land Register cost?

A flat EUR 66 for an entry of an ownership right, or EUR 33 when filed electronically. The Land Register applies the constitutive principle, so rights pass only on registration and not when the contract is signed — which is why an unfinished entry often sits at the centre of a property dispute.

Do I need Slovak to deal with the authorities in Slovakia?

Slovak is the state language and the language of judicial and administrative proceedings. Parties who do not command it are entitled to an interpreter, but documents are served in Slovak. A lawyer who works in Slovak and can explain each step in English is therefore a practical advantage.
