Why this page

Technology law in Hungary, explained for clients

Hungary’s technology sector operates inside a codified civil-law system, and that shapes how digital businesses contract, licence and litigate. Since 15 March 2014 the Civil Code (Act V of 2013) has governed obligations, property and company matters in a single instrument, so software licences, SaaS subscriptions, IT outsourcing and technology transfer are read against one statutory framework rather than a patchwork of precedents. Data-driven projects add further layers, and disputes over deliverables, payment or source code can end up before the Hungarian courts. Choosing the right adviser early usually keeps those disputes manageable. We match you with a technology lawyer in Hungary who works on IT contracts, licensing, e-commerce, data protection and technology-related litigation, and we do so at no cost to you. You describe your situation, we identify suitable attorneys-at-law and put you in contact.

Hungary in practice

How technology law works in Hungary

Hungarian private law is codified, so technology contracts and disputes are measured against written statutes rather than a body of case precedent. The courts, the bar and the procedural rules each have features that matter when your project, your software or your data is connected to Hungary.

One code behind every tech contract

Hungary replaced its 1959 Civil Code with a new, comprehensive Civil Code (Act V of 2013, Polgári Törvénykönyv) in force since 15 March 2014. It unifies persons, family law, property, obligations, companies and succession in eight Books, so licence terms, service levels, warranties and liability clauses in technology agreements are all tested against the same modern statutory base.

Judges follow the code, not earlier rulings

Hungary follows the continental model: judges are bound by the law and their own conviction rather than by judicial precedent. The Curia (Kúria) in Budapest issues uniformity decisions that bind the lower courts, which means consistency in technology disputes comes from statute and from the Curia rather than from a chain of earlier judgments.

The courts that hear technology disputes

The judiciary consists of 158 courts in four tiers: district courts (járásbíróság), administrative and labour courts, regional courts (törvényszék) and regional courts of appeal (ítélőtábla), headed by the Curia. There is no subordination between the levels — higher courts cannot instruct lower ones — and judges decide independently.

Who may act for you

Practising as an attorney-at-law (ügyvéd) requires membership of a regional bar association; those bodies are members of the Hungarian Bar Association (Magyar Ügyvédi Kamara) seated in Budapest. An admitted attorney may practise across the whole territory of Hungary, and Act LXXVIII of 2017 regulates the profession, including mandatory continuing training and professional indemnity cover.

Representation and court fees

Legal representation is mandatory in litigation as a general rule, but not in actions within the subject-matter jurisdiction of the district courts, where parties may appear in person (Act CXXX of 2016, Section 72). Court fees follow a tiered scale under Act XCIII of 1990, while lawyers’ fees are freely agreed between attorney and client — there is no binding statutory tariff.

Time limits that catch digital businesses

Several Hungarian deadlines are short and unforgiving. A company resolution may be challenged within 30 days, a community action on personality rights must be brought within 30 days, and the general limitation period for debt recovery is five years. Missing a window can extinguish a remedy long before the merits are ever examined.

The country data on this page comes from official Hungarian sources (the courts of Hungary, the Hungarian Bar Association and the national legislation database) consulted in 2025.

Common problems

Where technology projects in Hungary go wrong

Most difficulties we see are not about the technology itself, but about contracts, deadlines and knowing which specialist to instruct.

01

Contracts that do not travel

A licence, SaaS or development agreement drafted for another market may sit awkwardly with Hungarian rules on obligations, liability and company representation, leaving you exposed when a project stalls or a deliverable is rejected.

02

Deadlines that pass quietly

Hungarian law sets short windows for several remedies — 30 days to challenge a company resolution, 30 days for a community action on personality rights, 15 days for an administrative appeal — and missing one can close the door entirely.

03

Finding a genuine specialist

Technology work crosses contract, data, intellectual property and litigation skills. Because practice is regulated through compulsory bar membership, checking who really handles digital matters takes time you may not have.

How we help

Matching you with the right Hungarian attorney

You keep control of the decision; we simply narrow the field to people who handle your kind of matter.

Sector-focused shortlists

We look for attorneys-at-law whose practice includes software licensing, IT services, e-commerce, data protection, technology transfer and disputes arising from digital products and platforms.

Verifiable Hungarian credentials

Every attorney we suggest practises through a regional bar association and belongs to the Hungarian Bar Association, as Act LXXVIII of 2017 requires for anyone acting as an ügyvéd in Hungary.

Clear scope before you commit

You learn what an adviser handles, how they usually work and what a mandate involves, so you can decide with a realistic picture rather than a sales pitch.

No cost, no obligation

Using our matching service is free and creates no commitment. You decide whether to instruct anyone, and any fee agreement is made directly between you and the attorney.

Questions

Technology law in Hungary: frequent questions

When should I instruct a technology lawyer in Hungary?

As soon as a digital matter has a Hungarian element: a local subsidiary, a Hungarian counterparty, staff or users in the country, or a contract governed by Hungarian law. Early advice is most useful before signing, when liability caps, delivery milestones and data clauses can still be shaped rather than argued about later.

Who is allowed to practise as an attorney-at-law in Hungary?

Membership of a regional bar association is compulsory; the regional bodies are members of the Hungarian Bar Association (Magyar Ügyvédi Kamara) in Budapest. Under Act LXXVIII of 2017 an admitted attorney may practise throughout the whole territory of Hungary, and continuing professional training and professional indemnity cover are mandatory.

Must I be represented by an attorney in a Hungarian court?

Representation is mandatory in litigation unless an Act provides otherwise, but it is not required in actions within the subject-matter jurisdiction of the district courts (járásbíróság), including appeals and retrial procedures. Only attorneys-at-law, law offices and registered in-house legal counsels may act as agents, so assistance becomes essential before the regional court and higher courts.

How long do I have to bring a technology-related claim in Hungary?

The general limitation period for debt recovery is five years, which covers many unpaid invoices and contractual claims arising from IT and software projects. Some remedies are far shorter — for example 30 days to seek the setting aside of a company resolution, with a one-year preclusion period, and 30 days for a community action on personality rights.

What does litigation cost in Hungary?

Court fees are calculated on the value of the claim under Act XCIII of 1990; since 28 January 2025 a tiered scale applies to first-instance contentious proceedings instead of the former flat rate. Lawyers’ fees are freely agreed between attorney and client, as there is no binding statutory tariff for attorneys-at-law.

Is legal aid available in Hungary?

Yes. Act LXXX of 2003 on legal aid provides support for legal advice, document drafting and representation in civil, labour and administrative matters for persons lacking sufficient means, together with exemption from or deferral of procedural costs in certain cases. Eligibility is assessed against the social reference base, whose forint value is set annually in the central budget act.
