Your situation
What a theft lawyer in North Macedonia actually does for you
If you are facing a theft allegation in North Macedonia — as a suspect, an accused person, or a victim trying to recover what was taken — the first days shape everything that follows. A theft lawyer in North Macedonia can read the case file, explain what the offence you are charged with requires, identify which evidence is strong and which is not, and set out your realistic options before you sign a statement or agree to anything. Our platform is not a law firm and does not give legal advice. We listen carefully to your account and match you with an attorney-at-law registered with the Bar Association of the Republic of North Macedonia who regularly handles theft and property-crime matters. Being matched costs you nothing.
The local framework
Theft cases inside the North Macedonian court system
North Macedonia follows the continental civil-law tradition inherited from the former Yugoslav system, where comprehensive codes — including the Criminal Code and the Law on Courts — govern procedure rather than judicial precedent. Criminal work is handled by the ordinary courts, and understanding which court hears your file helps you prepare realistically.
Who may represent you
Membership of the Bar Association of the Republic of North Macedonia (AKRM) is compulsory in order to practise law. Under the Law on Advocacy, an advokat must hold a recognised law degree, have passed the bar examination, have completed the prescribed traineeship as an attorney trainee and be entered in the register of attorneys maintained by the Bar Association, which also disciplines the profession.
Defence is a constitutional guarantee
Legal assistance is guaranteed by the Constitution (1991), and in criminal proceedings the accused must be assisted by a defence counsel in the cases prescribed by law — the situations known as mandatory defence. A lawyer checking at the outset whether your case falls into one of those situations is the first practical step in building a defence strategy.
The courts that hear criminal files
The ordinary judiciary is three-tiered: 27 First-Instance Courts (Basic Courts), four Courts of Appeal and the Supreme Court, which is the highest instance, decides on legal remedies against appeal-court decisions and protects the right to a trial within a reasonable time. Court practice of the Supreme Court ensures the uniform application of the law across the country.
Costs and how lawyers charge
Court fees are governed by the Law on Court Fees, with fixed amounts set in denars (MKD) in the annexed tariff rather than ad-valorem percentages. Attorneys’ fees are freely agreed between lawyer and client; the Bar Association publishes a Tariff on attorneys’ fees that serves as the reference, and the losing party may be ordered to reimburse the successful party’s costs.
Free legal aid
The Law on Free Legal Aid (Official Gazette No. 101/2019) sets up two tiers: primary legal aid — general information, initial advice and help with forms — delivered by the Ministry of Justice and its regional units, authorised associations and legal clinics, and secondary legal aid, meaning representation by a lawyer and exemption from procedural costs, for persons lacking sufficient means within statutory income thresholds.
Language in the courtroom
Proceedings are conducted in Macedonian. Under the Law on the Use of Languages (Official Gazette No. 7/2019), in municipalities where at least 20% of the population speaks another language — in practice mainly Albanian — that language may also be used in judicial and administrative proceedings, and documents are issued in both languages.

Common concerns
What people worried about theft charges ask us first
Three situations we hear repeatedly from suspects, accused persons and victims in North Macedonia.
I was questioned without understanding my position
Records are taken quickly and wording matters later. A lawyer can review what was recorded and tell you whether anything must be corrected or challenged before the file moves forward.
I cannot tell whether I need a lawyer at all
Legal assistance is guaranteed and defence counsel is mandatory in the cases prescribed by law. A short consultation usually settles whether your situation is one of them.
I am the victim and want my money back
Recovering property is often separate from the criminal file. Compensation claims follow their own limitation periods, so the timing of civil steps matters as much as the investigation.

Questions
Frequently asked questions about theft cases in North Macedonia
Do I need a theft lawyer in North Macedonia if I have been questioned?
It depends on the stage and on whether your case falls within the situations of mandatory defence prescribed by law — legal assistance is in any event constitutionally guaranteed. A lawyer can review what has been recorded, explain what the offence requires and advise on your position before you sign anything further. Speaking to one early is rarely wasted.
How do I find a theft lawyer in North Macedonia?
You can check the register of attorneys maintained by the Bar Association of the Republic of North Macedonia, or describe your situation to us. We match you with an advokat who handles theft and property-crime files and who can work with you in Macedonian or, where the law allows, in Albanian. First responses usually arrive within 24 to 48 hours.
What will a lawyer charge for a theft case in North Macedonia?
Attorneys’ fees are freely agreed between lawyer and client; there is no state-imposed binding tariff. The Bar Association publishes a Tariff on attorneys’ fees and reimbursement of costs that acts as the reference for charging and for costs awarded to the successful party, and the losing party may be ordered to reimburse the successful party’s costs. Ask for a written fee agreement.
Can I get free legal aid for a theft case in North Macedonia?
Under the Law on Free Legal Aid (Official Gazette No. 101/2019) there are two tiers. Primary legal aid — information, initial advice and help completing forms — is provided by the Ministry of Justice and its regional units, authorised associations and legal clinics. Secondary legal aid, which includes representation by a lawyer and exemption from procedural costs, is available to persons lacking sufficient means within income thresholds set by law.
Which court will hear my case in North Macedonia?
Criminal files start before the First-Instance Courts — the country has 27 Basic Courts — with appeals going to one of the four Courts of Appeal and, ultimately, the Supreme Court, which decides on legal remedies against appeal-court decisions and protects the right to a trial within a reasonable time. Proceedings are in Macedonian, with Albanian also used in municipalities where at least 20% of the population speaks it.
I am the victim — can I claim compensation at the same time?
Compensation is often pursued separately from the criminal file. Damages claims are subject to their own limitation periods: three years from knowledge of the damage and of the responsible person, with an absolute limit of five years. Because these periods run independently of the investigation, a lawyer should assess the timing early so the claim is not lost.
