The situation

Why a property matter in Andorra needs local counsel

Property tax in Andorra rarely stays a simple annual formality. Whether you own a flat in Andorra la Vella, inherit a building in Ordino or receive a municipal assessment you believe is wrong, the question of who owes what — and how to challenge it — turns on Andorran statutes, local usages and the case law of the Tribunal Superior de Justícia. Catalan is the only official language of the courts, filings and judgments, so non-resident owners often need help simply to understand the documents in front of them. That is where we come in. We run a free matching service: you describe your situation, and we connect you with an independent property tax lawyer in Andorra, admitted to the Col·legi Oficial d’Advocats d’Andorra, who handles this type of work. Matching costs you nothing.

Andorra in practice

How property matters actually run in the Principality

Andorra is a parliamentary co-principality whose 1993 Constitution created a fully separated judicial power, with justice administered in the name of the Andorran people. For an owner, that means a property dispute follows the Andorran courts, the Andorran bar and a file drafted in Catalan.

Which court hears your case

Under the Llei qualificada de la Justícia of 3 September 1993, judicial power in Andorra is exercised by the Batlles, the Tribunal de Batlles, the Tribunal de Corts and the Tribunal Superior de Justícia, organised into civil, criminal and administrative jurisdictions. First-instance civil and administrative property matters come before the Batllia d’Andorra; appeals go to the Tribunal Superior de Justícia.

No single civil code

Andorran civil law is not gathered in one code. Property, leases, obligations, family and succession are governed by statutes, completed by the usages and customs of the Principality and by the case law of the Tribunal Superior de Justícia. A lawyer preparing your file therefore checks legislation and jurisprudence together rather than relying on a single text.

The file is in Catalan

Catalan is the sole official language of the State and of judicial activity. Proceedings, filings and judgments are drafted in Catalan, which matters for foreign and non-resident owners: notices are not automatically issued in another language, and documents intended for the Andorran courts must be prepared in Catalan. Your advocate handles that drafting and explains each step to you.

Judicial fees and procedural costs

Andorra does have judicial fees, governed by the Llei de taxes judicials of 22 June 2000. The claimant or applicant for a court service is the taxpayer, and the fee counts as procedural costs for all purposes. Fees are collected through stamped paper distributed via the Col·legi d’Advocats, and the budget law may adjust the tariff. Advocates’ own fees are freely agreed with the client.

Aid for limited resources

Free legal aid (benefici de justícia gratuïta) is granted by the judge by reasoned order to persons proving insufficient resources, assessed on income, basic expenses, dependent family members and overall patrimonial situation. The judge decides within a maximum of one month from a complete application. The benefit also covers free judicial copies and notarial acts, and you must report any improvement in your economic situation.

One lawyer represents and pleads

Andorra has no separate procurador profession. The advocate admitted to the Col·legi Oficial d’Advocats d’Andorra both represents and defends the client, so procedural representation is exercised by the same lawyer who pleads the case. Admission as a practising member requires the required law degree, the Andorran aptitude certificate obtained after examinations, and a practical traineeship, under Law 48/2014.

Key time limit — Property & Real Estate Law

Minimum duration of a residential lease — 3 years. Mandatory minimum for a dwelling let as habitual and permanent residence, unless the law provides otherwise.

Common situations

When owners go looking for help

Most people who contact us are not litigating for the sake of it — they simply cannot get a clear answer about a charge, a valuation or a deadline in Andorra.

01

The paperwork is unreadable

Assessments, notifications and pleadings arrive in Catalan, the sole official language of the Andorran courts. Non-resident owners often cannot tell whether a document is routine information or the start of a period that will close their options.

02

You disagree with a charge

You believe the basis of a municipal or property-related charge is wrong, or that someone else should be paying it. Knowing whether the point is procedural or substantive, and which Andorran body decides it first, is the first step.

03

A deadline may already be running

Appeal periods are counted in business days, excluding August and the Christmas period, and notifications are issued within five business days of a resolution. It is easy to lose a right without realising a clock had started.

How we help

What the matching service gives you

We are not a law firm. We are a free matching service that puts you in front of an independent Andorran advocate who already works on matters like yours.

Practising members only

Every advocate we match is admitted to the Col·legi Oficial d’Advocats d’Andorra, as Andorran law requires for anyone who represents and defends a client before the courts of the Principality.

Property-focused experience

We look for lawyers whose day-to-day work covers charges on property, leases, inheritance of buildings and administrative challenges, including files that have to be drafted entirely in Catalan.

Clarity on costs from the start

Advocates’ fees in Andorra are freely agreed with the client, and judicial fees may arise in court proceedings. You discuss the basis of fees directly with the lawyer before instructing them.

One contact, no intermediaries

Andorra has no separate procurador, so the advocate who advises you also files and pleads. Communication stays with one professional rather than being split between several offices.

Cross-border owners

Where our clients come from

Many property owners in Andorra live elsewhere in Europe and handle Andorran matters remotely. We match clients from across the continent, in the language they are comfortable with.

Frequently asked

Questions about property tax matters in Andorra

Do I need a property tax lawyer in Andorra if I own only one property?

If a charge, assessment or ownership question is disputed, yes: practice before the Andorran courts is reserved to advocates admitted to the Col·legi Oficial d’Advocats d’Andorra. For routine payment there may be nothing to litigate, but once a formal claim, appeal or enforcement step is on the table, an admitted advocate is the person who can act for you.

In which language will my property matter be handled?

In Catalan, which is the only official language of the State and of judicial activity in Andorra. Proceedings, filings and judgments are therefore in Catalan. Your lawyer prepares documents in Catalan and explains the file to you in the language you share; raise translation needs at the first meeting rather than later.

How long do I have to appeal in a property case?

An appeal against a final judgment is filed within 20 business days of notification, or 13 business days in special procedures. Business days exclude Saturdays, Sundays, public holidays, August and the Christmas period. A motion for reconsideration has 13 business days, and resolutions are notified within a maximum of 5 business days.

Can I obtain free legal aid in Andorra?

Free legal aid is granted by the judge by reasoned order where you prove insufficient economic resources, taking account of income, basic expenses, dependent family members and your overall patrimonial situation. The decision is issued within a maximum of one month of a complete application. It is not automatic, and you must report any improvement in your means.

What does it cost to be matched with a lawyer?

Nothing. Matching is free for you: you describe the situation, we identify an independent Andorran advocate who handles property matters, and you decide whether to instruct them. The lawyer’s own fees are agreed freely between you and the lawyer, and judicial fees may apply where court proceedings are opened.

Is there a procurador in Andorra, as in Spain?

No. Andorra has no separate procurador profession. The advocate admitted to the Andorran bar both represents and defends the client, so the same lawyer files and pleads the case. For owners who do not live in the Principality, that means fewer intermediaries and a single point of contact for the whole file.
