Administrative law in Azerbaijan
Challenging decisions taken by public authorities in Azerbaijan
Administrative law in Azerbaijan governs how state bodies make decisions and how you can contest them. If an authority refuses a permit, imposes a fine, withdraws a licence or simply fails to act, the route to a remedy runs through the administrative courts, and representation there is reserved to advocates who are members of the Azerbaijani Bar Association. Finding the right advocate matters, because procedure, the language of the courts and time limits all shape what is realistically possible. We are a European matching platform: you describe your situation, we compare it with the profiles of specialised administrative law lawyers in Azerbaijan, and we connect you with a lawyer who handles this type of dispute. The first introduction is free, with an average response of 24 to 48 hours.
Local framework
How administrative law works in Azerbaijan
Azerbaijan is a civil law country whose legal framework rests on the Constitution of 12 November 1995 and on codified legislation. In practice, an administrative matter turns on four questions: who may represent you, which court hears the case, in what language, and what it costs.
Who may represent you before the courts
Representation of parties in civil and administrative proceedings in Azerbaijan is reserved to advocates who are members of the Azerbaijani Bar Association. This follows amendments of 31 October 2017 to the Civil Procedure and Administrative Procedure Codes and to the Law ‘On Lawyers and Lawyers’ Activity’. In practice, Bar membership is compulsory if you want someone to argue your administrative case in court.
How the administrative courts are structured
Under Article 125 of the Constitution, judicial power is exercised only by the courts. Administrative cases start before the first-instance administrative and district courts, may be reviewed by one of the five courts of appeal — Baku, Ganja, Sumgayit, Shirvan and Sheki — and can reach the Administrative Chamber of the Supreme Court as the cassation instance. The Constitutional Court stands outside the ordinary judiciary.
Language of proceedings
Azerbaijani is the official language of the Republic and the language of the courts under Article 21 of the Constitution. Pleadings, hearings and judgments are conducted in Azerbaijani, so a client who does not work in the language depends on an advocate who can prepare the file and appear in it without friction. Procedural correspondence will also be in Azerbaijani.
Costs, state duty and legal aid
Court proceedings are subject to a state duty under the Law ‘On State Duty’. For civil claims concerning property it is calculated as a percentage of the value of the claim on a sliding scale, and an official calculator is published on e-mehkeme.gov.az. There is no statutory tariff for lawyers’ fees, which are freely agreed. The Bar Association’s Legal Aid Centre provides state-funded assistance to those entitled to it.
How advocates qualify in Azerbaijan
Admission to the Bar requires a higher legal education, at least three years of work experience in a legal field, a qualification examination consisting of a written test and an interview before the Lawyers’ Qualification Commission, and successful completion of compulsory training at the Justice Academy of the Ministry of Justice. Certain candidates are excluded, for example holders of dual citizenship or of unexpunged convictions for serious crimes.
Time limits that shape a case
Azerbaijani civil law sets a general limitation period of 10 years, while contractual claims are limited to 3 years and claims concerning immovable property to 6 years. That asymmetry is unusual and influences how a dispute is framed and how evidence is preserved. Because the periods differ depending on the nature of the claim, timing should be settled with your lawyer at the outset.
The country data on this page comes from official Azerbaijani sources — the Supreme Court of the Republic of Azerbaijan and the Azerbaijani Bar Association — and from national legislation published by the competent state bodies, consulted in 2025.

Common difficulties
Why administrative matters stall
Most delays in Azerbaijani administrative cases come from practical issues rather than from the merits of the dispute.
Unclear procedure
The competent court, the correct form of application and the appeal steps are not always obvious, and a misdirected filing can consume time that is difficult to recover later.
Language and distance
Proceedings are conducted in Azerbaijani, and clients living outside the country often struggle to follow a file, answer requests or appear at hearings in person.
Time limits and evidence
Different limitation periods apply depending on the nature of the claim, and evidence becomes markedly harder to assemble once a file has already been running for some time.
How we help
What the matching service gives you
We are not a law firm. We identify the right advocate for your administrative matter in Azerbaijan and introduce you.
Bar-registered advocates
Everyone we introduce is a member of the Azerbaijani Bar Association, which is compulsory for representing parties in civil and administrative proceedings before the courts.
Administrative focus
We look for lawyers whose practice is built around disputes with public authorities, rather than generalists who take an administrative file only occasionally.
One short brief
You explain the problem once, in your own words, in English or another language you work in. We review it and return an introduction instead of a list of names.
Free and without obligation
Being matched costs you nothing. You decide whether to instruct the lawyer after discussing the scope of work, the likely steps and the fee arrangement.

Questions
Frequently asked questions
Do I need a lawyer who is a member of the Azerbaijani Bar Association?
For court work, effectively yes. Under the Law ‘On Lawyers and Lawyers’ Activity’ and the amendments of 31 October 2017 to the Civil Procedure and Administrative Procedure Codes, representation of parties in civil and administrative proceedings is reserved to advocates who are members of the Azerbaijani Bar Association. Membership is therefore compulsory for anyone appearing on your behalf.
In what language are administrative proceedings conducted in Azerbaijan?
Azerbaijani. Article 21 of the Constitution establishes Azerbaijani as the official language of the Republic, including the language of the courts. Pleadings, hearings and judgments are in Azerbaijani, so if you do not work in the language you will rely on your administrative law lawyer in Azerbaijan to prepare and argue the case.
How long do I have to bring a claim in Azerbaijan?
Azerbaijani civil law sets a general limitation period of 10 years. Contractual claims are limited to 3 years and contractual claims concerning immovable property to 6 years, while periodically performable obligations such as rent are limited to 3 years. Because the periods differ, the framing of a claim should be settled with your lawyer early.
What does an administrative law lawyer in Azerbaijan cost?
There is no statutory tariff: fees are freely agreed between lawyer and client, so you can ask for a fixed fee, an hourly rate or a staged arrangement. Separately, proceedings attract a state duty under the Law ‘On State Duty’, calculated on a sliding scale for property claims. Free state-funded legal aid exists for those entitled to it.
Where are administrative cases heard in Azerbaijan?
Administrative cases begin before the first-instance administrative and district courts. Appeals go to one of the five courts of appeal — Baku, Ganja, Sumgayit, Shirvan and Sheki — and the Administrative Chamber of the Supreme Court of Azerbaijan acts as the cassation instance. The Constitutional Court stands outside the ordinary judiciary.
Can you help if I am not based in Azerbaijan?
Yes. The platform works remotely: you describe the matter in writing and we match you with an administrative law lawyer in Azerbaijan who handles that type of case. Many clients instruct Azerbaijani advocates from abroad in matters involving state authorities, permits or enforcement, and you can review the lawyer’s profile before deciding whether to proceed.
