Before you file anything

What to do when you receive a removal or entry-ban decision in Azerbaijan

If you are facing removal, an entry ban or a decision that affects your right to remain in Azerbaijan, the first days matter: which authority issued the act, which court can review it, and who is entitled to sign your submissions all influence what follows. Azerbaijan is a civil-law country whose legal framework rests on the Constitution and codified legislation, and representation before the courts in civil and administrative proceedings is reserved to advocates who are members of the Azerbaijani Bar Association. A deportation lawyer in Azerbaijan therefore has to be a qualified advocate, not simply an adviser. We are a free matching service, not a law firm: you explain your situation once and we introduce you to a lawyer whose practice covers immigration and removal work.

Azerbaijan in practice

How the legal system in Azerbaijan shapes a removal or residence case

Azerbaijan’s judiciary is organised in defined tiers, and the rules on who may speak for you in court are strict. Knowing these two things early helps you understand why the choice of representative is not interchangeable.

Who may represent you in court

Under the Law ‘On Lawyers and Lawyers’ Activity’ and following the amendments of 31 October 2017 to the Civil Procedure and Administrative Procedure Codes, representation of parties in civil and administrative proceedings is reserved to advocates who are members of the Azerbaijani Bar Association. Bar membership is therefore effectively compulsory for court advocacy in these proceedings.

How the courts are structured

Judicial power in Azerbaijan is exercised only by the courts, under Article 125 of the Constitution. The system comprises first-instance district (city) courts, grave crimes courts, military, administrative and commercial courts, five courts of appeal — Baku, Ganja, Sumgayit, Shirvan and Sheki — plus the Supreme Court of the Nakhchivan Autonomous Republic, and the Supreme Court as the cassation instance.

The language of proceedings

Azerbaijani is the official language of the Republic and the language of the courts under Article 21 of the Constitution. All documents, hearings and correspondence proceed in Azerbaijani, so a lawyer who can prepare and file in that language — and explain each step to you in your own — is central to a workable case strategy.

What representation costs

There is no statutory tariff for lawyers’ fees in Azerbaijan; fees are freely agreed between the lawyer and the client. Court proceedings themselves are subject to a state duty under the Law ‘On State Duty’, calculated on a sliding scale for property claims, with an official online calculator provided by the judicial authorities at e-mehkeme.gov.az.

Free state-funded legal aid

The Azerbaijani Bar Association operates a Legal Aid Centre that provides legal assistance to persons entitled to it under the Law ‘On Lawyers and Lawyers’ Activity’. Whether you qualify depends on the category of your case and your personal circumstances, so this is one of the first questions to raise with the lawyer you are matched with.

Choosing a lawyer you can verify

The Bar Association is a non-governmental, self-regulating body that includes all advocates in the country, with roughly 3,003 members and 103 law offices in Baku and 41 in the regions. It maintains a public register of lawyers and law offices, so the credentials of the advocate presented to you can be checked.

The difficulty you are facing

Why removal cases go wrong before anyone reaches a courtroom

Most problems in these files are procedural rather than factual. Three of them come up again and again.

01

Short filing windows

A refusal, ban or removal decision usually comes with a limited period in which it can be challenged. If nobody reads the document properly in the first days, options that were open can quietly close.

02

Evidence that is hard to gather

Residence records, family ties, employment history and translated documents have to fit together and be filed in the right form. Assembling them without guidance wastes weeks and can weaken an otherwise solid file.

03

Not every adviser can represent you

Court representation in civil and administrative proceedings in Azerbaijan is reserved to advocates who are members of the Azerbaijani Bar Association. Using an adviser who cannot appear on your behalf is a costly dead end.

How the matching works

A short conversation, then the right advocate for your case

We do not take a position on your case. We make sure it reaches a lawyer who handles this kind of work.

One form, one explanation

You tell us the essentials once — what decision you received, from which authority, when, and what you want to achieve. No repeated retelling of the same facts.

Matched on practice area

We look for an advocate whose work covers immigration, administrative decisions and court procedure in Azerbaijan, rather than a generalist who has never handled such a file.

You keep control

Matching is free and creates no obligation. You decide whether to instruct the lawyer, and the terms of any engagement are agreed directly between the two of you.

Answers you can act on

Once you are in contact, you can expect a clear view of the realistic options, the documents needed and the questions to raise with the authorities in Azerbaijan.

Questions clients ask

Deportation cases in Azerbaijan: frequently asked questions

What does a deportation lawyer in Azerbaijan actually do for me?

An advocate reviews the decision you received, checks which authority issued it and within what period it can be challenged, prepares and files the required submissions, and represents you before the Azerbaijani courts. Because representation in civil and administrative proceedings is reserved to Bar Association members, instructing a qualified advocate is a legal requirement, not a preference.

Who is entitled to represent me before the courts in Azerbaijan?

Representation of parties in civil and administrative proceedings is reserved to advocates who are members of the Azerbaijani Bar Association, following the amendments of 31 October 2017 to the Civil Procedure and Administrative Procedure Codes. Admission to the Bar requires a higher legal education, at least three years of legal experience, a qualification examination and compulsory training at the Justice Academy.

Which courts deal with these matters in Azerbaijan?

Azerbaijan has first-instance district (city) courts, grave crimes courts, military, administrative and commercial courts, five courts of appeal — in Baku, Ganja, Sumgayit, Shirvan and Sheki — the Supreme Court of the Nakhchivan Autonomous Republic and the Supreme Court as the cassation instance. The lawyer matched to you will confirm the competent court for the specific decision you are facing.

Is free legal aid available in Azerbaijan?

The Azerbaijani Bar Association operates a Legal Aid Centre that provides free, state-funded legal assistance to persons entitled to it under the Law ‘On Lawyers and Lawyers’ Activity’. Entitlement depends on the type of case and your personal situation, so ask the lawyer during your first exchange whether your matter can be covered.

How are lawyers’ fees set in Azerbaijan?

There is no statutory tariff for lawyers’ fees: they are freely agreed between the advocate and the client, so scope, stages and payment terms should be confirmed in writing at the start. Separately, court proceedings attract a state duty under the Law ‘On State Duty’, and the judicial authorities provide an official calculator at e-mehkeme.gov.az.

In what language will my case be handled?

Azerbaijani is the official language of the Republic and the language of the courts under Article 21 of the Constitution, so filings and hearings take place in Azerbaijani. Your advocate should be able to prepare everything in that language while explaining each stage to you in a language you understand.
