A civil-law claim, handled by the right representative

If a defective or unsafe product has caused you injury, damage or financial loss in Azerbaijan, the route to compensation runs through the ordinary civil courts. Azerbaijan is a civil-law country: the legal framework rests on the Constitution and on codified legislation, principally the Civil Code, and judicial power is exercised only by the courts. First-instance district (city) courts hear the case, appeals go to one of five regional courts of appeal and the highest instance is the Supreme Court. Because representation in court is reserved to advocates who are members of the Azerbaijani Bar Association, the choice of representative matters early. We match you free of charge with a product liability lawyer in Azerbaijan who handles these claims and can explain the periods within which they must be brought.

Azerbaijan in practice

How a civil claim is handled in Azerbaijan

Claims of this kind are dealt with inside the ordinary civil-law system of Azerbaijan, where the framework rests on the Constitution and codified legislation and judicial power is exercised only by the courts. The points below set out how that system is organised, who may stand before it and which periods and costs are relevant.

Which courts hear the claim

First-instance district (city) courts — 86 of them across the country — hear civil claims, alongside grave crimes, military, administrative and commercial courts. Appeals are heard by the courts of appeal in Baku, Ganja, Sumgayit, Shirvan and Sheki, and the Supreme Court of the Republic of Azerbaijan acts as the cassation instance.

The periods that shape a claim

The general limitation period in Azerbaijan is 10 years under Article 373.1 of the Civil Code, while contractual claims are limited to 3 years, or 6 years where the contract concerns immovable property. Periodically performable obligations carry a 3-year period. This asymmetry matters when deciding how a claim is structured and how evidence is preserved.

Who may represent you in court

Following amendments of 31 October 2017 to the Civil Procedure and Administrative Procedure Codes and to the Law ‘On Lawyers and Lawyers’ Activity’, representation of parties in civil and administrative proceedings is reserved to advocates who are members of the Azerbaijani Bar Association. The Association currently has about 3,003 members, with 103 law offices in Baku and 41 in the regions.

How an advocate is admitted

Becoming an advocate requires a higher legal education, at least three years of work experience in a legal field, and success in a qualification examination made up of a written test and an interview before the Lawyers’ Qualification Commission. Candidates must also complete compulsory training at the Justice Academy of the Ministry of Justice.

What the proceedings cost

Court proceedings are subject to a state duty under the Law ‘On State Duty’. For civil claims concerning property it is calculated as a percentage of the value of the claim on a sliding scale, subject to statutory minimum and maximum amounts, and an official calculator is provided at e-mehkeme.gov.az. There is no statutory tariff for advocates’ fees, which are freely agreed.

Language, documents and legal aid

The official language of the Republic, including the language of the courts, is Azerbaijani under Article 21 of the Constitution, so documents and evidence may need translation. State-funded legal assistance is provided through the Legal Aid Centre operated by the Azerbaijani Bar Association for persons entitled to it under the Law ‘On Lawyers and Lawyers’ Activity’.

The country details on this page are taken from official Azerbaijani sources — the Supreme Court of the Republic of Azerbaijan, the Azerbaijani Bar Association and the Civil Code of the Republic of Azerbaijan — together with ILO NATLEX records, as published at the URLs listed.

What makes these claims difficult

Three problems clients run into in Azerbaijan

None of them is unusual, and all of them are easier to manage with the right representative from the start.

01

You are unsure which period applies

The general limitation period is 10 years, but contractual claims are limited to 3 years, or 6 years for contracts concerning immovable property. Filing on the wrong basis can decide whether a claim survives at all.

02

Court representation is restricted

Since the amendments of 31 October 2017, representation of parties in civil and administrative proceedings is reserved to advocates who are members of the Azerbaijani Bar Association. An adviser outside the Bar cannot stand before the court for you.

03

Costs are hard to anticipate

Property claims attract a state duty calculated on a sliding scale, within statutory minimum and maximum amounts, while advocates’ fees are freely agreed with no statutory tariff. Without an early view of both, budgeting becomes guesswork.

How we help

Matched with an advocate who knows the Azerbaijani courts

We are not a law firm. We listen to your situation and introduce you to advocates who practise in the relevant area — the decision to instruct is always yours.

Bar-registered advocates only

Every advocate we introduce practises through the Azerbaijani Bar Association, whose membership is compulsory for representation in civil and administrative court proceedings under the Law ‘On Lawyers and Lawyers’ Activity’.

Time limits reviewed early

Your account is considered against the 10-year general period, the 3-year contractual period and the 6-year period for contracts concerning immovable property, so that evidence can be secured while it still exists.

A clear view of court fees

You receive guidance on the state duty payable under the Law ‘On State Duty’, which for civil claims concerning property follows a sliding scale with statutory minimum and maximum amounts.

Free and without obligation

Describing your situation costs nothing and commits you to nothing. We pass it to advocates who handle civil claims in Azerbaijan, and you decide whether to proceed or to stop there.

Common questions

Product liability claims in Azerbaijan

How do I find a product liability lawyer in Azerbaijan?

Start by describing the product, the damage it caused and when the events happened. We match you free of charge with advocates who are members of the Azerbaijani Bar Association, since only Bar members may represent parties in civil and administrative proceedings. You then speak to them directly and decide whether to instruct.

How long do I have to bring a civil claim in Azerbaijan?

The general limitation period in Azerbaijan is 10 years under Article 373.1 of the Civil Code. Contractual claims are limited to 3 years, and contractual claims concerning immovable property to 6 years, while periodically performable obligations carry a 3-year period. Because the periods differ, an advocate should establish which basis your claim rests on well before it is filed.

Can someone who is not an advocate represent me in an Azerbaijani court?

Since amendments of 31 October 2017, representation of parties in civil and administrative proceedings is reserved to advocates who are members of the Azerbaijani Bar Association. Admission requires a higher legal education, at least three years of legal work experience, the qualification examination and compulsory training at the Justice Academy of the Ministry of Justice.

What does taking a case to court cost in Azerbaijan?

Court proceedings are subject to a state duty under the Law ‘On State Duty’. For civil claims concerning property it is calculated as a percentage of the value of the claim on a sliding scale, within statutory minimum and maximum amounts, and the judicial authorities provide an official calculator at e-mehkeme.gov.az. There is no statutory tariff for advocates’ fees; they are freely agreed.

In which language are proceedings conducted in Azerbaijan?

The official language of the Republic of Azerbaijan, and the language of the courts, is Azerbaijani under Article 21 of the Constitution. Hearings are conducted in Azerbaijani, and written documents and evidence may therefore need to be translated. Your advocate corresponds with the court in that language on your behalf.

Is free legal assistance available in Azerbaijan?

The Azerbaijani Bar Association operates a Legal Aid Centre that provides state-funded legal assistance to persons entitled to it under the Law ‘On Lawyers and Lawyers’ Activity’. Whether you qualify depends on the statutory conditions, which your advocate can explain. Outside legal aid, fees are freely agreed between the advocate and the client.
