The framework

How succession works in Azerbaijan

An estate in Azerbaijan is rarely purely domestic. Property may sit in Baku or Ganja while the heirs live in Berlin, Istanbul or London; a will may be drafted in one language and have to work in another; and a single missing entry in the property register can hold everything up for months. Wills lawyers in Azerbaijan work with the Civil Code, the notary system and the State Register of real estate rights, and they know what the civil courts expect from an inheritance file. On this page you describe your situation once, free of charge, and we match you with an advocate who handles succession matters in the city or region concerned — whether you need a will prepared, an estate transferred, or a dispute argued.

Azerbaijan in detail

Wills and inheritance in the Azerbaijani legal system

Azerbaijan is a civil-law jurisdiction: the Constitution of 1995 and codified legislation, above all the Civil Code, set the framework. Estate work therefore turns on written law, notarial form and public registers rather than on case law, and it usually runs in Azerbaijani.

Judicial power and where estate cases are heard

Under Article 125 of the Constitution judicial power is exercised only by the courts. Civil proceedings begin before the first-instance district (city) courts, of which there are 86 across the country. Appeals go to the five courts of appeal — Baku, Ganja, Sumgayit, Shirvan and Sheki — and the Supreme Court acts as the cassation instance.

Notarial acts and state duty

Wills and estate paperwork pass through the notary system, which is maintained by the Chamber of Notaries of Azerbaijan (Azərbaycan Notariat Palatası). Notarial acts performed by notaries and state bodies attract state duty under the Law ‘On State Duty’, and a range of notarial services can be completed electronically — useful when the heirs are abroad.

Registering inherited property

Ownership and other property rights to real estate, including rights acquired by inheritance, are subject to compulsory state registration. The State Register of real estate rights is the authoritative record of title. State duty is AZN 50 for an extract confirming registered ownership and AZN 75 for technical documents (technical passport and plan).

Who may represent you before the courts

Since the amendments of 31 October 2017 to the Civil Procedure and Administrative Procedure Codes, representation of parties in civil and administrative proceedings is reserved to advocates who are members of the Azerbaijani Bar Association. The Association has around 3,003 members, with 103 law offices in Baku and 41 in the regions.

Language of the proceedings

The official language of the Republic, including the language of the courts, is Azerbaijani under Article 21 of the Constitution. Files, hearings and judgments are in Azerbaijani, which is why heirs living abroad normally instruct an advocate rather than filing documents themselves. Interpretation and translation are practical necessities, not formalities.

Time limits and evidence

Civil claims in Azerbaijan enjoy an unusually long general limitation period of 10 years, while contractual claims are limited to 3 years and to 6 years where the contract concerns immovable property. The asymmetry matters when an estate dispute is structured and when documents are preserved for later use.

Common problems

What tends to hold an Azerbaijani estate up

Most delays are procedural rather than contested. Three patterns appear again and again.

01

The heirs live in different countries

One heir in Baku, another in Germany, a third in Turkey. Documents must be produced, translated and coordinated across time zones, and each step usually depends on the one before it. An advocate used to cross-border estates can sequence the work.

02

The property is not properly registered

Inherited rights to real estate in Azerbaijan must be entered in the State Register, and the authority will ask for the extract of registered ownership and, where relevant, technical documents. If the title chain has a gap, the transfer stalls until it is addressed.

03

The family does not agree

Will contests rarely stay inside the family. Once positions harden, the matter moves before the civil courts, where representation is reserved to advocates who are members of the Azerbaijani Bar Association. Structured advice early is almost always cheaper than litigation later.

Why use the matching service

How we find the right advocate for your estate

We are not a law firm. We are a matching service that reads your situation and introduces you to lawyers who already work in this field.

Specialists rather than generalists

We look for advocates whose practice actually includes succession and property work in Azerbaijan, not firms that accept whatever matter arrives at the door.

Describe it once

You set out the will, the property and the heirs a single time. We pass that summary to lawyers who handle this type of file, and they come back to you.

Local knowledge counts

Court practice, notarial procedure and registration formalities differ between Baku and the regions. We try to find someone who works where your matter will actually be handled.

Free to be introduced

Being matched costs you nothing. You decide whether to instruct, and fees are agreed directly with the lawyer — Azerbaijani law sets no statutory tariff for legal fees.

Questions

Frequently asked questions about wills in Azerbaijan

What do wills lawyers in Azerbaijan actually handle?

Typically three strands of work: preparing a will or succession document and taking it through the notary, moving inherited property into the State Register of real estate rights, and representing heirs in disputes before the civil courts. Because court representation is reserved to Bar members, one advocate can often cover all three.

Is Bar Association membership required to represent me in an Azerbaijani court?

In practice, yes. Following the amendments of 31 October 2017 to the Civil Procedure and Administrative Procedure Codes and the Law ‘On Lawyers and Lawyers’ Activity’, representation of parties in civil and administrative proceedings is reserved to advocates who are members of the Azerbaijani Bar Association. Admission to the Bar also requires compulsory training at the Justice Academy.

How is inherited real estate recorded in Azerbaijan?

Ownership and other property rights to real estate, including rights acquired by inheritance, are subject to compulsory state registration, and the State Register of real estate rights is the authoritative record of title. The state duty is AZN 50 for an extract confirming registered ownership and AZN 75 for technical documents such as the technical passport and plan.

Does a marriage celebrated abroad or religiously affect an inheritance in Azerbaijan?

Under the Family Code of Azerbaijan only marriages registered with the state civil-status authorities are recognised; religious marriages have no legal value. How a foreign marriage certificate is treated, and what it means for a surviving spouse’s position in an estate, depends on the documents and is something a lawyer assesses case by case.

In which language will proceedings be conducted?

Azerbaijani. Article 21 of the Constitution establishes Azerbaijani as the official language of the Republic, including the language of the courts. Files, hearings and judgments run in Azerbaijani, so heirs abroad normally work through an advocate who can handle the language and the formalities.

What will a lawyer cost, and what court fees apply?

There is no statutory tariff for lawyers’ fees in Azerbaijan; they are freely agreed between lawyer and client. Civil claims carry a state duty calculated as a percentage of the claim value on a sliding scale, with an official online calculator provided by the judicial authorities. Free state-funded legal aid is available through the Legal Aid Centre for those entitled to it.
