Local legal landscape
How family law works in Bulgaria
Bulgaria follows the continental civil-law tradition, with family matters governed by the Family Code. The courts are organised in three tiers of general jurisdiction, and only attorneys admitted to a Bulgarian Bar Association may represent clients in cassation proceedings. Below we summarise the key points that affect family law cases.
Court system for family cases
Family disputes are heard at first instance by district courts (rayonen sad) or regional courts (okrazhen sad), depending on the value and nature of the claim. Appeals go to one of the five appellate courts, and cassation is reviewed by the Supreme Court of Cassation. This structure ensures specialised handling of family matters.
Lawyer admission and representation
Only persons entered in the register of a Bulgarian Bar Association may practise as attorneys-at-law. Admission requires a Master’s degree in law, legal capacity, two years of legal service, passing the bar exam, and good moral character. EU lawyers may also register. Legal representation is mandatory in cassation proceedings.
Matrimonial property regime
The default regime is community of acquests: property acquired during marriage through joint contribution belongs to both spouses equally, regardless of whose name it is in. Joint contribution is presumed. Spouses may instead choose separation of property or a prenuptial contract registered with the Registry Agency.
Divorce procedure
Only civil marriage is recognised, and divorce is exclusively judicial. Spouses may divorce by mutual consent with a joint petition and agreement on children, property and maintenance, or by unilateral petition proving deep and irremediable breakdown. There is no administrative divorce.
Forced heirship
Bulgarian succession law protects descendants, parents and the surviving spouse through a reserved portion that cannot be disposed of by will. The reserved share varies by heir category. This restricts testamentary freedom and must be considered in estate planning and inheritance disputes.
Key time limit — Family Law
Challenge of disposal of common immovable property by the other spouse — 6 months. The non-consenting spouse may challenge the disposal within this period.

Common challenges
What can go wrong without expert guidance
Family law cases are often emotionally charged and legally complex. These are the situations our clients frequently face.
Navigating divorce alone
Divorce in Bulgaria is exclusively judicial. Without a lawyer, you risk mishandling the petition, property settlement or child arrangements, leading to delays and unfavourable terms.
Matrimonial property disputes
The default community of acquests means assets acquired during marriage are jointly owned. Disproving joint contribution or negotiating a fair division is complex without legal expertise.
Inheritance conflicts
Forced heirship rules restrict testamentary freedom. If your will disinherits a protected heir, it may be partially overturned. A lawyer can structure your estate within legal limits.

FAQs
Family law in Bulgaria – practical answers
What do family lawyers in Bulgaria handle?
Family lawyers in Bulgaria advise on divorce, child custody, maintenance, matrimonial property, prenuptial agreements, inheritance and adoption. They prepare petitions, negotiate settlements and represent clients before Bulgarian courts.
Is divorce always granted by a court in Bulgaria?
Yes. Bulgaria has no administrative divorce. Spouses must file a joint petition for mutual-consent divorce (with an agreement on children and property) or a unilateral petition proving irretrievable breakdown. Only a court can dissolve the marriage.
What is the default matrimonial property regime?
The default is community of acquests: property acquired during marriage through joint contribution belongs to both spouses equally. Joint contribution is presumed, but spouses may choose separation of property or a prenuptial contract registered with the Registry Agency.
Can I challenge a will in Bulgaria?
Yes, if the will disregards the reserved (forced) portion. Descendants, parents and the surviving spouse are entitled to a minimum share. A lawyer can assess whether the will is valid and guide you through inheritance proceedings.
How much does a family lawyer cost in Bulgaria?
Lawyers’ fees are freely agreed; there is no binding tariff. Courts may order the losing party to reimburse reasonable costs. State court fees for divorce are 2% of the three-year total of each party’s share under the property settlement.
Do I need a lawyer for cassation proceedings?
Yes, legal representation by an attorney-at-law is mandatory before the Supreme Court of Cassation. The lawyer must be registered with a Bulgarian Bar Association or be a registered EU lawyer.
