Employment discrimination

Why the Croatian setting matters

Workplace discrimination follows you through the whole working day: the promotion that never arrives, the remarks dismissed as a joke, the contract that quietly ends after you raise a complaint. Employment disputes in Croatia are decided by the regular courts, and the rules on how — and how quickly — you must act are national rather than generic. That is why a workplace discrimination lawyer in Croatia reads your facts before anyone talks about what your case is worth. On this page you describe what happened in a few sentences, at no cost. We then match you with a lawyer whose practice covers employment and discrimination work in Croatia, so your first conversation is with someone who already knows the local procedure, the local courts and the local time limits.

Croatia in practice

How employment claims work in Croatia

Croatia is a civil-law country where codified legislation, not judicial precedent, is the primary source of law, and employment disputes are handled by the regular courts. The practical details below explain who may represent you, where your case is heard and which periods apply.

How employment disputes move through the courts

Croatia follows the continental civil-law tradition, so codified legislation — not judicial precedent — is the primary source of law. Employment claims start at first instance before one of the 34 municipal courts (općinski sudovi). An appeal is decided by the competent county court (županijski sudovi, 15 in total), and the Supreme Court of the Republic of Croatia is the court of last instance.

Who is entitled to act as your lawyer

Practising as an odvjetnik in Croatia requires membership of the Croatian Bar Association (Hrvatska odvjetnička komora), which is both the professional organisation and the regulator under the Attorneys Act. A candidate must hold a law degree (mag. iur.), complete the lawyer-trainee period and pass the bar examination before entry in the Register of Attorneys. CEPEJ counted 4,979 Croatian lawyers in its 2024 evaluation.

The tight 15-day window in employment protection

Where a dispute involves a dismissal or another infringement of employment rights, Croatian law sets a 15-day period for seeking protection of employment rights under the Labour Act. Employment timings are short, and the correct starting point depends on your own facts, so Croatian employment lawyers assess early whether that route — or a longer limitation period under the Civil Obligations Act — applies to your situation.

Court fees, the electronic-filing discount and legal costs

Court fees (sudske pristojbe) are governed by the Court Fees Act and the Court Fee Tariff, and combine fixed amounts with percentages of the value in dispute. A submission filed electronically through the court’s information system is charged at half the prescribed fee. Lawyers’ fees follow the Bar’s Tariff of 25 November 2023, plus VAT and expenses; the losing party may be ordered to reimburse the other side’s costs.

Free legal aid for those who qualify

The Free Legal Aid Act (Zakon o besplatnoj pravnoj pomoći) creates a two-tier system for socially and economically disadvantaged citizens. Primary legal aid covers general information, advice and the drafting of submissions; secondary legal aid covers full representation in court proceedings, including exemption from costs and court fees. Applications are handled by the administrative bodies of the counties and of the City of Zagreb.

Croatia inside the European framework

Croatia has been a member of the European Union since 1 July 2013, and its legal system shares significant similarities with the German and Austrian tradition. Judicial authority is exercised autonomously by the courts within the scope prescribed by law, and the Constitutional Court safeguards constitutionality outside the ordinary judiciary. For a client this means codified procedure — and a lawyer who knows how it is applied in practice.

Key time limit — Employment Law

Challenge of dismissal / protection of employment rights — 15 days. Set by the Labour Act; employment claims are heard by the municipal courts at first instance.

The problem

Workplace discrimination rarely announces itself

It arrives as a pattern rather than a single event, and Croatian employment law protects you only if you act within the periods it sets.

01

You are unsure whether it counts as discrimination

Jokes, exclusion, being passed over, a sudden change of duties after you complain: it is rarely one obvious incident. A Croatian employment lawyer helps you separate what is legally relevant from what simply feels unfair.

02

You are afraid of what happens at work

Raising a complaint can feel riskier than staying silent, especially in a small team or a small town. Lawyers who handle these cases in Croatia know how to protect your position while a claim is prepared.

03

The deadlines seem designed to catch you out

Fifteen days, three years, five years — the periods differ by type of claim, and the clock does not wait until you feel ready. Early advice is what keeps your options open.

Questions

Workplace discrimination in Croatia: common questions

What does a workplace discrimination lawyer in Croatia actually do?

A lawyer working in this field reviews the facts of your employment — your contract, your duties, how colleagues and managers behaved — and identifies which Croatian provisions and procedures apply. They advise on evidence, handle correspondence with your employer, prepare submissions and represent you before the competent municipal court, and explain what a realistic outcome looks like before you commit.

How long do I have to act in Croatia?

It depends on the claim. Where employment rights, including a dismissal, are at stake, the Labour Act sets a 15-day period for seeking protection of those rights. Other claims follow the limitation periods of the Civil Obligations Act — generally five years, and three years for periodic payments or compensation for damage. Croatian lawyers check which period fits your facts.

Do I need a lawyer to take an employment case to a Croatian court?

In civil proceedings a party may in principle act in person at first instance, but representation by an odvjetnik is mandatory for extraordinary legal remedies before the Supreme Court and for certain steps prescribed by the Civil Procedure Act. In practice, employment cases turn on procedure, evidence and timing, which is why most clients instruct a Croatian lawyer from the outset.

Which court will hear my case?

Employment claims begin at first instance before a municipal court (općinski sud). Appeals are decided by the competent county court (županijski sud), and the Supreme Court of the Republic of Croatia is the court of last instance. Croatia follows the continental tradition, so codified legislation rather than judicial precedent guides the outcome.

What can a Croatian lawyer cost?

Lawyers’ fees follow the Tariff on Remuneration and Reimbursement of Costs for Lawyers’ Work, adopted by the Croatian Bar Association and in force since 25 November 2023. Fees are calculated in tariff points, plus VAT and out-of-pocket expenses, and are borne by the client. If you win, the losing party may be ordered to reimburse your costs.

Can I get free legal aid?

The Free Legal Aid Act provides primary aid — information, advice and help drafting submissions — and secondary aid, which covers representation in court, including exemption from costs and court fees. It is intended for socially and economically disadvantaged citizens, and applications are handled by the county administrative bodies and the City of Zagreb.
