The Cypriot framework

Cypriot property, read through the facts rather than the assumptions

Property in Cyprus rarely raises one question at a time. A purchase can involve a contract deposited with the Department of Lands and Surveys before the Title Deed is transferred; an inheritance can run into the statutory portion reserved by the Wills and Succession Law, Cap. 195; a mortgage registered over land can stay enforceable for years. Cyprus is also a mixed jurisdiction, applying common law and equity under Article 188 of the Constitution alongside civilian rules on succession and administration. If you are dealing with a Cypriot property and the tax questions that surround it, you do not have to work out alone which tradition applies or which limitation period governs. Tell us what has happened, and we match you free of charge with a property tax lawyer in Cyprus who handles matters of this kind.

Country specifics

How property matters actually work in Cyprus

Cyprus is a genuine mixed jurisdiction: a British colony until 1960, it still applies the principles of common law and equity retained under Article 188 of the Constitution, while succession law draws on continental models and administrative law reflects Greek influence. Property questions therefore sit where land registration, succession and EU law meet.

Title Deeds and compulsory registration

Immovable property in Cyprus is governed by the Immovable Property (Tenure, Registration and Valuation) Law, Cap. 224, administered by the Department of Lands and Surveys. Registration is compulsory, and the certificate of registration — the Title Deed — is the key proof of ownership, recorded property by property in the Land Register.

Searching the Land Register before you act

Any interested person may obtain a search certificate (Form N50) from a District Land Office on payment of the prescribed fee. Sales contracts for property still under development are normally deposited with the Department of Lands and Surveys, and a purchaser is strongly advised not to pay the full price before the Title Deed is transferred.

Succession rules shape how property passes

The Wills and Succession Law, Cap. 195, does not permit unlimited freedom of testation. Where the deceased leaves a child or a descendant of a child, the disposable portion may not exceed one quarter of the net estate, and any testamentary disposition beyond that is reduced and abated proportionately. Family property therefore moves in ways a foreign will may not anticipate.

Mortgages, pledges and long limitation periods

Enforcement of a mortgage or pledge is subject to a twelve-year limitation period in Cyprus, so charges over land can remain actionable for a considerable time. Because contract and tort follow English common law, with English case law treated as persuasive authority, an advocate can reason from both common-law and civilian sources on the same file.

Advocates, stamp duties and costs

Only advocates entered in the Register of Advocates and holding an annual practising licence from the Cyprus Bar Council have rights of audience before the Cypriot courts. Court fees are fixed stamp duties affixed to each pleading, from about €1.75 to about €450 for a writ of summons, and costs generally follow the event.

EU membership and cross-border ownership

Cyprus has been a Member State of the European Union since 1 May 2004, and the Constitution was amended so that EU law takes precedence over national law. Cypriot courts apply directly applicable EU regulations and take part in cooperation instruments such as Brussels I (recast), which matters when owners, heirs or buyers live elsewhere in Europe.

Key time limit — Property & Real Estate Law

Enforcement of a mortgage or pledge — 12 years. Relevant to charges registered over Cypriot land.

The country information on this page is taken from official Cypriot and European Union sources — the Department of Lands and Surveys, the Supreme Court of Cyprus, the Cyprus government portal on advocates, and the European e-Justice Portal — as published at the date of writing.

Common situations

What usually brings people to this page

Most clients arrive with a document, a deadline and an uncertainty. Naming the uncertainty is the first useful step.

01

The paperwork does not tell the whole story

You hold a sale contract, a receipt, or a copy of a will, but not the certificate of registration. In Cyprus the Title Deed recorded in the Land Register is the key proof of ownership, so what you actually hold changes the advice you need.

02

A limitation period may already be running

Cypriot limitation periods range from one year for defamation to twelve years for enforcing a mortgage or pledge. Contract claims carry six years and tort claims three. Waiting can narrow the options, so it is worth clarifying early which period applies to your file.

03

Two legal traditions, one file

Cyprus applies common law and equity under Article 188 of the Constitution, yet succession law follows civilian models and forced heirship limits what a will can achieve. Without experience of both traditions, the interaction between your property and your estate plan is easy to misread.

How matching helps

Why clients use our free matching service

We are not a law firm. We read what you send, identify the practice area, and introduce you to an advocate in Cyprus who handles that work.

Matched to the right specialism

Property tax questions sit between land registration, contract and succession. We ask what your matter actually involves and introduce you to an advocate whose practice covers that ground, rather than sending your file to whoever answers first.

Advocates who can appear in court

In Cyprus only advocates entered in the Register of Advocates and holding an annual practising licence have rights of audience before the courts. The lawyer we match you with prepares and presents the case, with no separate procedural representative in between.

Costs explained before you commit

Advocates’ fees in Cyprus are freely agreed with the client, while court fees are fixed stamp duties affixed to each pleading and recoverable costs are assessed on a scale. Your lawyer can set out how each step is charged, so there are fewer surprises.

Cross-border matters welcome

Cyprus has been a Member State of the European Union since 2004, and EU law takes precedence over national law here. If you live abroad and own, inherit or sell Cypriot property, you can be matched with an advocate used to working with clients outside the island.

Questions

Frequently asked questions about property tax lawyers in Cyprus

How do I find a property tax lawyer in Cyprus?

Describe your situation in a few lines — a purchase, a transfer, a mortgage, an inheritance or a dispute over land. We review what you send and match you with a property tax lawyer in Cyprus whose practice covers that kind of work. The service is free, and you decide whether to instruct.

Can a lawyer from another country represent me before a Cypriot court?

Generally no. Foreign lawyers may not practise before the courts of Cyprus unless they are qualified and registered as advocates in Cyprus, and advocates admitted in other EU Member States are subject to the establishment provisions of the relevant EU directives. Litigation in Cyprus therefore requires an advocate entered on the Cypriot register.

How is ownership of Cypriot property proved?

Immovable property is governed by the Immovable Property (Tenure, Registration and Valuation) Law, Cap. 224, and registration is compulsory. The certificate of registration — the Title Deed — is the key proof of ownership, recorded in the Land Register property by property. A search certificate (Form N50) can be obtained from a District Land Office on payment of the prescribed fee.

What happens to Cypriot property when the owner dies?

Succession law in Cyprus does not permit unlimited freedom of testation. Under the Wills and Succession Law, Cap. 195, part of the estate is reserved by law for close family. Where the deceased leaves a child or a descendant of a child, the disposable portion may not exceed one quarter of the net estate, and any disposition beyond that is reduced proportionately.

How much does it cost to bring a property claim in Cyprus?

Court fees are fixed stamp duties rather than a percentage of the claim, affixed to each pleading or document filed; filing a writ of summons ranges from about €1.75 to about €450 according to the value of the claim. Costs generally follow the event, but recoverable costs are assessed on a scale and are usually lower than the fees actually incurred.

Is free legal aid available for property matters in Cyprus?

Free legal aid is provided under the Legal Aid Law, 165(I)/2002, which covers criminal proceedings, proceedings concerning violations of human rights, family proceedings and other judicial proceedings. The court issues a certificate where both an economic criterion and a merits criterion are met, and there is no partial legal aid: once issued, all the applicant’s costs are covered.
