Tenant law in Cyprus

What a lawyer tenant law in Cyprus actually does for you

Disagreements between landlords and tenants rarely stay small. A delayed rent increase, a deposit that is not returned, a lease whose terms nobody can agree on, or a property that is sold while you are still living in it can all turn into a dispute that needs professional handling. A lawyer tenant law in Cyprus works within a legal system that mixes English common law with continental traditions, so the way leases are interpreted and disputes are argued can surprise tenants and landlords who come from elsewhere. Cyprus also has dedicated Rent Control Tribunals sitting at first instance alongside the District Courts. Rather than reading general guides, describe your situation once and we match you with an advocate who deals with tenancy and property matters in Cyprus — free of charge and with no obligation to proceed.

Cyprus in practice

How tenant law works in Cyprus

Tenancy questions in Cyprus sit at the meeting point of contract law, land registration and a court system that was substantially reshaped in 2023. The points below set out how the framework actually works on the island, so you can judge what is relevant to your own situation before you speak to anyone.

Two legal traditions in one courtroom

Cyprus was a British colony until 1960 and its courts still apply the principles of common law and equity retained under Article 188 of the Constitution. Contract, tort and commercial law follow English common law, and English case law is treated as persuasive authority. Public and administrative law reflect continental influence, and since the 2004 accession EU law has supremacy.

Rent Control Tribunals and the District Courts

Civil claims at first instance are heard by the District Courts, one per administrative district, before a single judge and without a jury. Rent Control Tribunals also sit at first instance. The 2023 reform divided the former Supreme Court and created a sixteen-judge Court of Appeal, which now hears appeals rather than the Supreme Court.

Who may represent you before a Cypriot court

Advocates are the only practitioners with rights of audience in Cyprus, and they both prepare and present a case — there is no separate procedural representative. To practise, an advocate must be entered in the Register of Advocates kept by the Chief Registrar of the Supreme Court, hold an annual licence from the Cyprus Bar Council and belong to the Cyprus Bar Association.

Court fees are stamp duties, not a percentage

Filing fees are fixed stamp duties paid by affixing revenue stamps to each document, set by Rules of the Supreme Court under the Courts of Justice Law 14/1960. The stamps required for a writ of summons range from roughly €1.75 to roughly €450 depending on the value of the claim, and they accrue at each procedural step.

Free legal aid and what it covers

Under the Legal Aid Law 165(I)/2002, legal aid covers criminal proceedings, proceedings concerning violations of human rights, family proceedings and other judicial proceedings. A certificate is granted only where the applicant lacks sufficient means and the merits of the case justify it. There is no partial legal aid: once issued, the applicant’s costs are covered.

Title Deeds and the Land Register

Immovable property is governed by the Immovable Property (Tenure, Registration and Valuation) Law, Cap. 224, administered by the Department of Lands and Surveys. Registration is compulsory and the Title Deed is the key proof of ownership. Any interested person may obtain a search certificate (Form N50) at a District Land Office for the prescribed fee.

Key time limit — Property & Real Estate Law

Enforcement of a mortgage or pledge — 12 years. Applies where a lender moves to enforce security registered over a property.

Common situations

What usually goes wrong before people ask for help

Most tenancy problems in Cyprus do not begin in court. They begin with a document nobody re-read, a payment nobody receipted, or a time limit that quietly runs out.

01

The lease says less than you thought

Old contracts, handwritten addenda and verbal agreements are common. When rent, repairs or notice terms are disputed, someone has to read the document against Cypriot contract law and say where you actually stand.

02

Money claims cost more than expected

Court fees in Cyprus are stamp duties charged at each procedural step, and the losing party normally pays the winner’s costs on a fixed scale. Knowing the applicable limitation period changes what is realistically recoverable.

03

The owner or tenant is abroad

A large share of Cypriot property is held from outside the island. If you cannot travel, you need an advocate who can file, appear and report back before the District Courts or a Rent Control Tribunal on your behalf.

Why us

Why clients use our matching service

We are not a law firm and we do not give legal advice. We do one thing well: we put you in front of an independent advocate who handles tenancy and property disputes in Cyprus.

Registered advocates only

Every advocate we match is entered in the Register of Advocates and holds a valid practising licence from the Cyprus Bar Council — a mandatory requirement for anyone representing you before a Cypriot court.

Free and without obligation

You describe your situation once. We compare it with the practices of independent advocates who handle tenancy and property matters, and you decide whether to instruct anyone at all.

Costs explained before you commit

Advocates’ fees in Cyprus are agreed freely with the client rather than fixed by a binding tariff. Your matched advocate can set out the likely steps, the stamp duties involved and how recoverable costs are assessed.

One island, two legal traditions

Common law and equity apply alongside continental influences, and EU law has taken precedence since 2004. A specialist knows which statute, principle or line of authority is relevant to your tenancy question.

FAQ

Questions clients ask us about tenant law in Cyprus

Do I need a lawyer tenant law in Cyprus, or can I handle a dispute myself?

In civil proceedings parties are normally represented by an advocate, although a natural person may appear in person in certain small-claims matters. Because tenancy disputes usually turn on the wording of a contract and on limitation periods, most tenants and landlords prefer an advocate to prepare and present the case.

Which Cypriot court hears a tenancy dispute?

Civil claims are normally heard at first instance by the District Courts, one per administrative district, sitting before a single judge without a jury. Rent Control Tribunals also sit at first instance and deal with rent-control matters. Appeals now go to the Court of Appeal created by the 2023 judicial reform.

How much does it cost to be matched with an advocate?

Nothing — matching is free and carries no obligation. If you decide to instruct an advocate, fees are agreed directly with that advocate, because advocates’ fees in Cyprus are not fixed by a binding official tariff. Court fees are separate and are paid as stamp duties step by step.

How long do I have to bring a tenancy-related claim?

It depends on the claim. General contractual claims are subject to six years, civil wrongs such as negligence or nuisance to three years, and the general residual period for any cause of action is ten years. Defamation claims must be brought within one year. An advocate will identify which period fits your facts.

Can a foreign advocate represent me in Cyprus?

Foreign lawyers may not practise before the Cypriot courts unless they are qualified and registered as advocates in Cyprus. Advocates are the only practitioners with rights of audience, and membership of the Cyprus Bar Association is mandatory for practice. Advocates admitted in other EU Member States are subject to the relevant EU establishment provisions.

Is free legal aid available for a tenancy dispute?

Legal aid is governed by the Legal Aid Law 165(I)/2002 and covers criminal proceedings, proceedings concerning violations of human rights, family proceedings and other judicial proceedings. The court issues a certificate where the applicant lacks sufficient means and the merits justify it. There is no partial legal aid: once granted, costs are covered.
