How family law works in Denmark
Family law in Denmark is not confined to courtrooms. Most separations and divorces begin with an application to the Agency of Family Law (Familieretshuset), an administrative body, and only move to the family court if the spouses disagree on terms. Family Law lawyers in Denmark therefore guide clients through both administrative and judicial stages, handling matters such as child residence, spousal maintenance, division of assets and succession. The protected title ‘advokat’ guarantees that a lawyer has met the Danish Bar and Law Society’s requirements, including a law degree, practical experience and a mandatory advocate examination. Court proceedings are conducted digitally through minretssag.dk, and forced heirship rules reserve one quarter of an estate for a spouse and descendants. We match you with a specialised advokat for your specific family-law issue.
Denmark-specific rules
Family law practice in Denmark
Danish family law is shaped by administrative decision-making, protected professional titles and a fully digital justice system. The points below summarise how the system works for individuals, drawn from official sources.
Divorce starts with Familieretshuset
In Denmark a divorce or separation is not started by an action in court. Spouses submit an application to the Agency of Family Law (Familieretshuset), which decides on separation and divorce and issues the grant or decision. A fee of 875 DKK (2026) applies. Only when spouses disagree on terms is the matter referred to the family court.
Family courts are district courts
Family law disputes that reach court are heard by the district court acting in family-law matters. Denmark has 24 district courts, with appeals to the Eastern High Court in Copenhagen or the Western High Court in Viborg, and finally the Supreme Court. Most cases require representation by an advokat.
The title ‘advokat’ is protected
Only lawyers appointed by the Minister of Justice may use the title ‘advokat’, and appointment entails membership of the Danish Bar and Law Society (Advokatsamfundet). Admission requires a Danish or EU law degree, at least three years of practical legal work, and completion of mandatory advocate training and examination. This guarantees professional qualification.
Digital court proceedings
All civil cases in Denmark must be brought and conducted through the courts’ digital case portal minretssag.dk. Statements of claim, defences and documents are filed electronically, and judgments are delivered on the portal. Courts may grant exemptions from digital processing only in exceptional cases.
Legal aid and costs
A court fee of 750–1,500 DKK is payable when a civil action is brought, and the losing party is generally ordered to pay the winning party’s legal costs. Free legal aid (fri proces) may cover these costs if your income is below certain thresholds, set at 404,000 DKK for single applicants in 2026.
Forced heirship in succession
Danish succession law reserves one quarter of the estate for the surviving spouse and descendants through ‘tvangsarv’ (forced inheritance); this quarter cannot be disposed of by will. The remaining three quarters may be freely bequeathed. EU Regulation 650/2012 allows a testator to elect national law in cross-border cases.

Common concerns
Family law is rarely simple
These are the situations our clients often face before they contact us.
Uncertainty about the divorce process
Many clients do not know that divorce in Denmark begins with Familieretshuset rather than a court. This can make it hard to understand what to file, when, and what costs to expect.
Disputes over children and assets
When spouses disagree about child residence, contact or the division of property, a family court can be involved. Preparing your position early with an advocate helps avoid unnecessary delay and stress.
Inheritance and forced heirship
Danish forced heirship rules reserve one quarter of an estate for a spouse and descendants. This can surprise non-Danish clients and complicate wills and cross-border succession.
