Criminal defence in France
How criminal law works in France
France’s criminal justice system operates within the judicial order, which is separate from the administrative order. Criminal disputes are heard by professional judges, and a lawyer is mandatory for the accused in the most serious trials. Below are key points to understand when seeking a criminal lawyer in France.
Court structure for criminal matters
French criminal cases fall within the judicial order, which handles private-law and criminal disputes. Cases are heard at first instance, with appeals to one of 36 cours d’appel, which re-examine the facts and the law. The Cour de cassation in Paris is the highest court of the judicial order and reviews questions of law only, without re-trying the facts. Proceedings are conducted in French.
Qualified criminal lawyers (avocats)
In France, a criminal lawyer must be an avocat registered with a local bar. Since 1 January 2025, entry requires a Master 2 degree in law, the CAPA certificate after 18 months of training and an entrance exam, an oath before the cour d’appel, and registration on the roll of a local bar. Lawyers must also complete 20 hours of continuing education each year.
Mandatory representation in felony trials
For an accused person in a cour d’assises, which tries the most serious offences (felonies), French law requires representation by an avocat. This means you cannot appear without a lawyer in such trials. In other criminal proceedings, having a lawyer is strongly advisable to protect your rights, but the verified rules only make representation mandatory at that level.
Lawyer’s fees and legal aid
Lawyers’ fees are freely agreed between the avocat and client, and are usually set out in a convention d’honoraires. There is no statutory tariff outside the legal-aid scale. Fees may be time-based, fixed-fee, or include a success fee. Aide juridictionnelle can cover all or part of the lawyer’s fees, depending on income. For total legal aid in 2025, the reference taxable income threshold is €12,862 for a single person.
Language of proceedings
All French court proceedings are conducted in French. Your criminal lawyer must be able to communicate effectively in French with the courts, prosecutors and other parties. If you do not speak French, discuss with your lawyer how to manage language barriers, as the court record and hearings will be in French.

Challenges you may face
The difficulties of handling a criminal matter alone
Without local legal support, your rights and options may be unclear.
Facing a criminal charge without representation
Being questioned or charged in a foreign legal system is daunting. You may not know your rights or how to respond, and a mistake can have serious consequences.
Language and procedure barriers
French criminal proceedings are conducted in French. Without a lawyer who speaks your language or can guide you through the process, you risk misunderstanding key steps and deadlines.
Unclear costs and legal aid options
Lawyer’s fees are freely negotiated, and legal aid may be available, but the rules are complex. You need someone to explain what applies to your income and case.
