Before you instruct anyone

How legal help works when you are seeking protection in Hungary

Arriving in Hungary with a pending protection claim, or supporting someone who has, usually raises more questions than answers: who decides, what happens next, and what you are expected to do in the meantime. This page explains how the Hungarian legal system is organised, who is entitled to practise here as an attorney, and how legal aid is structured under Hungarian law. It also shows how europeanlawyerfinder.com works: you describe your situation once, and we match you with an asylum lawyer in Hungary whose specialisation fits the stage your case has reached. There is no charge for the matching itself and no obligation to instruct the lawyers we suggest.

Hungary in practice

The Hungarian legal framework in brief

Hungary is a continental, civil-law jurisdiction: rules come from written codes rather than from previous judgments, and judges decide on the basis of the law and their own conviction. Understanding that structure helps you see where your case fits and which professional you need.

A codified legal order

Hungarian private law is essentially codified. The current Civil Code (Act V of 2013) entered into force on 15 March 2014, replacing the 1959 code, and covers persons, family law, property, obligations and succession in eight Books. Courts are bound by the law rather than by earlier rulings, although the Curia issues uniformity decisions that bind the lower courts.

Four tiers of courts, one apex

The judiciary consists of 158 courts arranged in four tiers: district courts, administrative and labour courts, regional courts and regional courts of appeal, topped by the Curia in Budapest. There is no subordination between levels — higher courts cannot instruct lower ones and judges are independent. Roughly 11,000 people work in the court system, just under 3,000 of them judges.

Who may represent you

Legal representation is mandatory in Hungarian litigation unless an Act provides otherwise, but it is not compulsory in actions falling within the subject-matter jurisdiction of the district court (járásbíróság), including appeals and retrial. Only attorneys-at-law, law offices and registered in-house legal counsels may act as agents, so professional help is essential before the regional court and above.

Compulsory bar membership

An attorney-at-law may practise only as a member of a regional bar association, and those associations are themselves members of the Hungarian Bar Association (Magyar Ügyvédi Kamara), seated in Budapest. Once admitted, an attorney may act throughout the whole territory of Hungary, takes an oath, is entered in the bar register and must complete continuing professional training.

Legal aid and where it removes cost

Under Act LXXX of 2003 on Legal Aid, the state bears the cost of legal services where your available monthly net income does not exceed the social reference base and you hold no assets. Certain applicants are deemed needy irrespective of income and assets, and persons in asylum-related proceedings are among them. Where you qualify, legal services involve no cost or the state advances the fee.

Court fees and lawyers’ fees are separate

Court fees in civil proceedings are set by Act XCIII of 1990 and, since 28 January 2025, follow a tiered scale for first-instance contentious claims. Lawyers’ fees are different: they are freely agreed between attorney and client, because there is no binding statutory tariff in Hungary. Fee agreements and the attorney’s mandatory indemnity insurance are regulated by Act LXXVIII of 2017.

Why cases stall

What makes a protection case difficult to handle alone

Most problems we hear about are not about the strength of a case, but about procedure, language and timing. Each of them is easier to manage with an attorney beside you.

01

You are unsure which decision is being made

Notifications may concern your claim, your stay or a related administrative file. Without a clear reading of each document, it is easy to answer the wrong question or to assume that nothing is required of you.

02

Everything arrives in Hungarian

Correspondence, hearing invitations and reasoned decisions are issued in Hungarian. A lawyer explains what each document means and which step follows, so you do not miss a response you were expected to give.

03

Costs feel impossible to work out

Court fees, agreed lawyers’ fees and legal aid operate under separate rules. An attorney can tell you which of them applies to your situation before you commit to anything.

How we help

Why people use europeanlawyerfinder.com

We are not a law firm. We are a matching service that shortens the distance between your question and a lawyer who works with it.

Regulated professionals only

Everyone you are matched with is admitted to practise in Hungary and is a member of a regional bar association, which is compulsory under Act LXXVIII of 2017. You can check registration details before instructing.

Coverage across the country

An admitted attorney may practise throughout the whole territory of Hungary, so your case is not limited to the city you are in. We take into account where you are and where hearings are likely to take place.

One request, relevant profiles

You describe your situation once. We pass it to lawyers whose practice covers asylum-related proceedings, rather than to a general list. You choose whether to reply, and to whom.

You stay in control

Matching is free and creates no obligation. Fees, scope of work and the terms of any mandate are agreed directly between you and the attorney you select, as Hungarian law leaves fee agreements to the parties.

Beyond Hungary

Asylum rules differ from one country to the next, and a claim in one state is not handled the same way as a claim in another. If your situation touches more than one jurisdiction, tell us which countries are involved and we will include lawyers who work with cross-border matters.

Questions

Frequently asked questions

How do I find an asylum lawyer in Hungary?

Describe your situation in the request form on this page: where you are, what stage your asylum-related proceedings have reached and which language you speak. We compare lawyers whose work covers this field and pass your request to those who fit. You then decide whether to instruct one of them. Matching costs you nothing.

Is legal representation compulsory in Hungary?

Representation by an attorney-at-law is mandatory in Hungarian litigation unless an Act provides otherwise, but it is not required in actions falling within the subject-matter jurisdiction of the district court (járásbíróság), including appeals and retrial. Only attorneys-at-law, law offices and registered in-house legal counsels may act as agents, so help matters before the regional court and higher courts.

Can I get free legal aid for an asylum-related case?

Under Act LXXX of 2003 on Legal Aid, the state bears the cost of legal services where your available monthly net income does not exceed the social reference base and you hold no assets. Some applicants are deemed needy irrespective of income and assets, and persons in asylum-related proceedings are listed among them. Where you qualify, services cost nothing or the state advances the fee.

Who is allowed to practise as an attorney in Hungary?

Membership of a regional bar association is compulsory under Act LXXVIII of 2017, and those regional bodies are members of the Hungarian Bar Association seated in Budapest. An attorney admitted in any region may practise throughout the whole territory of Hungary. Attorneys take an oath, are entered in the bar register and must complete continuing professional training.

How are the Hungarian courts organised?

Hungary has 158 courts in four tiers: district courts, administrative and labour courts, regional courts and regional courts of appeal, with the Curia at the top in Budapest. The levels are not subordinate to one another — higher courts cannot instruct lower ones and judges are independent. The Curia ensures consistent justice through decisions binding on the courts.

Which language is used in Hungarian proceedings?

The working language of the Hungarian courts is Hungarian. Notices, submissions and reasoned decisions are produced in that language, so a lawyer who can explain each step to you in a language you share makes a practical difference. Ask at your first contact which languages the lawyer and the office work in.
