Why a Hungarian attorney matters for intellectual property work
Intellectual property assets rarely stay in one country. A trade mark used across the region, a software licence signed with a foreign client or a design copied by a competitor can all end up in a Hungarian dispute, and the way that dispute is handled depends on written rules rather than on case law built up by judges. Hungary follows the continental civil-law model: its private law was re-codified in the Civil Code (Act V of 2013), in force since 15 March 2014, and judges are bound by the law while the Curia issues decisions that keep practice consistent. If you are looking for an intellectual property lawyer in Hungary, describe your situation below. We review it and match you with an attorney whose practice covers the kind of right you need to protect.
How it works in Hungary
The Hungarian framework in practice
Hungary is a codified civil-law jurisdiction: the rules that decide your case are written in statutes, and procedural steps follow a four-tier court structure headed by the Curia in Budapest. These are the structural points that shape an intellectual property dispute here, taken from official Hungarian sources.
Codified law rather than precedent
Hungarian private law is codified rather than built on judicial precedent. The Civil Code (Act V of 2013, Polgári Törvénykönyv) entered into force on 15 March 2014 and replaced the 1959 code, uniting rules on persons, property, obligations, companies and succession in eight Books. The Curia issues uniformity decisions binding on lower courts, but judges remain bound by the law and their own conviction.
Four tiers of courts
The judiciary comprises 158 courts in four tiers: district courts (járásbíróság), administrative and labour courts, regional courts (törvényszék) and regional courts of appeal, headed by the Curia in Budapest. There is no subordination between the levels — higher courts cannot give instructions to lower ones, and judges are independent. Proceedings are conducted in Hungarian.
Compulsory bar membership
Bar membership is compulsory in Hungary. Under Act LXXVIII of 2017, an attorney-at-law may carry out professional activities only as a member of a regional bar association, and those associations are themselves members of the Hungarian Bar Association (Magyar Ügyvédi Kamara), seated in Budapest. Once admitted, an attorney may practise throughout the entire territory of Hungary.
Who may act as your agent
Only attorneys-at-law, law offices and registered in-house legal counsels may act as agents in an action. Representation is mandatory in litigation unless an Act provides otherwise, but it is not required in actions within the subject-matter jurisdiction of the district courts, including appeals and retrial procedures, where parties may appear in person.
What the court itself charges
Court fees are calculated on the value of the claim under Act XCIII of 1990. Following the reform of 28 January 2025, first-instance contentious proceedings use a tiered scale instead of the former flat rate: for example, claims up to HUF 300,000 carry a fee of HUF 18,000. The obligation arises when the action is brought, and appeals and review attract separate fees.
Fees, insurance and legal aid
Lawyers’ fees are freely agreed between attorney and client by mandate; there is no binding statutory tariff for attorneys-at-law. Act LXXVIII of 2017 governs fee agreements, remuneration and the professional guarantee and indemnity insurance attorneys must maintain. Legal aid under Act LXXX of 2003 supports advice, document drafting and representation in civil, labour and administrative matters for persons lacking sufficient means.
The figures and procedural rules above come from official Hungarian sources — the National Office for the Judiciary and the national legislation portal njt.jog.gov.hu — consulted in 2025.
Common difficulties
What makes cross-border IP matters harder than they look
The problem is rarely the right itself; it is knowing how a Hungarian court, a Hungarian attorney and a Hungarian fee scale actually operate.
Rights travel faster than advice
A product copied abroad, a licence signed in another language or a brand used without permission can all end up before a Hungarian court. Without local procedural knowledge, the representation rules and the sequence of steps are easy to misread.
Two legal traditions in one dispute
Cross-border matters mix a codified Hungarian framework with the rules of another country. Which court hears the case, in which language, and at what point a Hungarian attorney must act are questions you cannot settle by assumption.
Fees that are agreed, not published
Hungary has no binding statutory tariff for attorneys-at-law, so what you pay depends on the mandate you agree. Comparing offers is difficult when the court fee scale and the scope of work are not explained in the same terms.
How we help
A shortlist built around your right, not a directory
We do not publish lawyers’ rankings or promise results. We read your situation and match you with an attorney who works with that kind of matter in Hungary.
Bar-admitted attorneys
Practising law in Hungary requires membership of a regional bar association under Act LXXVIII of 2017. Every attorney we propose is admitted to the Hungarian bar and subject to its professional rules.
The right practice for the right right
A trade mark conflict, a copyright question, a design infringement and an unfair competition claim raise different issues. Tell us what is at stake and we look for an attorney who handles that type of matter.
Costs explained in plain terms
Attorneys’ fees are freely agreed by mandate in Hungary, while court fees follow the scale in Act XCIII of 1990. We make sure you know which part of the cost is the court’s and which part is the attorney’s.
Free matching, no pressure
Describing your situation costs nothing and commits you to nothing. You decide whether to instruct anyone after you have spoken with the attorney and understood the proposed scope of work.
Cross-border reach
Matters that touch Hungary and its neighbours
Hungary sits at the centre of a region where rights, licences and distribution agreements routinely cross borders. If your matter also involves one of these jurisdictions, mention it when you describe your case.
Questions clients ask
Intellectual property and Hungarian procedure
How do I find an intellectual property lawyer in Hungary?
Describe your situation in the form on this page: what right is involved, what happened and where. We review it and match you with an intellectual property lawyer in Hungary whose practice covers that type of matter. Because bar membership is compulsory under Act LXXVIII of 2017, any attorney we propose is admitted to a regional bar association.
Do I have to be represented by an attorney in a Hungarian court?
As a general rule, legal representation is mandatory in Hungarian civil litigation, although it is not required in actions within the subject-matter jurisdiction of the district courts (járásbíróság), including appeals and retrial procedures, where parties may appear in person. Only attorneys-at-law, law offices and registered in-house legal counsels may act as agents.
What court fee applies to a civil claim in Hungary?
Court fees are set by Act XCIII of 1990. Since the reform of 28 January 2025, first-instance contentious proceedings follow a tiered scale rather than a flat 6% of the claim value: claims up to HUF 300,000 carry HUF 18,000, and the higher bands add a percentage of the excess. Appeal and review attract separate fees.
Is there a fixed tariff for lawyers’ fees in Hungary?
No. Lawyers’ fees are freely agreed between the attorney and the client by mandate, and there is no binding statutory tariff for attorneys-at-law. Act LXXVIII of 2017 regulates fee agreements, the attorney’s remuneration and the professional guarantee and indemnity insurance attorneys must maintain, so the basis of charging should be agreed clearly from the outset.
How are the Hungarian courts organised?
Hungary has 158 courts arranged in four tiers: district courts, administrative and labour courts, regional courts and regional courts of appeal, headed by the Curia (Kúria) in Budapest. Judges are independent and higher courts cannot issue instructions to lower ones; the Curia ensures consistency through decisions binding on all courts. Court proceedings are conducted in Hungarian.
Can I obtain legal aid for a dispute in Hungary?
Act LXXX of 2003 on legal aid provides support for legal advice, the drafting of documents and representation in civil, labour and administrative matters for persons lacking sufficient means, together with exemption from or deferral of procedural costs in certain cases. Eligibility turns on available monthly net income measured against the social reference base, whose forint value is set annually.
