Why this page

Sanctions work needs a lawyer who handles it every week

Sanctions work sits at the crossroads of EU restrictive measures, criminal law and administrative enforcement, and a wrong response can affect your assets, your business and your freedom of movement. If you have received a freezing notice, a reporting request, a delisting refusal, or a bank has blocked your funds without a clear explanation, the first step is to speak to a lawyer who handles these files regularly. On this page you can set out your situation in a few lines and we will match you with a sanctions lawyer in Italy — someone registered with the Italian bar and used to working with international counterparts, national authorities and EU-level proceedings. The matching service is free, confidential and does not commit you to instructing anyone.

The Italian framework

How sanctions-related work is handled in Italy

Sanctions files touch banking practice, export controls and, at times, criminal or administrative procedure, so the lawyer you instruct needs to know how the Italian system is built. This section sets out who may act, which courts hear what, what proceedings cost and which time limits are unforgiving.

Who may act as your sanctions lawyer in Italy

Practising as an avvocato requires registration in the albo degli avvocati kept by the territorial Consiglio dell’Ordine, with the Consiglio Nazionale Forense as the national body. Under Law 247/2012, admission requires Italian or EU citizenship, a five-year laurea magistrale in giurisprudenza, an 18-month pratica forense with a qualified lawyer and the Esame di Stato. Registration is the legal precondition to practise and to use the title.

The court structure your lawyer works within

Italy is a civil law jurisdiction whose core sources are codified. The judicial function is exercised by ordinary magistrates under articles 101–113 of the Constitution, and jurisdiction divides into ordinary (civil and criminal) and special (administrative, accounting and tax). Civil first instance sits before the Giudice di Pace for minor claims and the Tribunale ordinario, the general first-instance court, sitting as a single judge or a three-judge panel.

Appeals and the Cassazione route

Appeals on the merits against a Tribunale judgment go to the Corte d’Appello, while appeals against Giudice di Pace decisions stay before the Tribunale. The Corte Suprema di Cassazione, seated in Rome, is a court of legitimacy only: it reviews questions of law, not the merits, and performs a nomofilattica function of ensuring uniform interpretation. Representation there is reserved to lawyers on the special albo dei cassazionisti.

Administrative acts and the 60-day window

Administrative acts are challenged before the TAR at first instance, with appeal to the Consiglio di Stato; the annulment claim must be filed within 60 days. Special jurisdiction also includes the Corte dei conti for accounting matters and the Corti di giustizia tributaria for tax. The Corte Costituzionale reviews the constitutionality of laws and sits outside this ordinary ladder.

What proceedings cost and who can get legal aid

Court proceedings carry the contributo unificato, scaled by claim value from EUR 43 to EUR 1,686, increased by half on appeal and doubled before the Cassazione, plus a EUR 27 marca da bollo. Since minimum fees were abolished in 2006, lawyers’ fees are freely agreed; without agreement the court applies the ministerial parametri forensi. Legal aid covers fees and court costs where annual taxable income does not exceed EUR 12,838.01.

Prescription, forfeiture and why dates matter

Italian law distinguishes prescrizione, which may be interrupted or suspended, from decadenza, where the term is strict and cannot be interrupted. The ordinary limitation period is ten years; tort claims and claims for periodic payments, interest and rents prescribe in five. Many procedural challenge terms — administrative appeals, dismissal challenges — are forfeiture terms, so a compliance or sanctions file needs a dated chronology from the outset.

Key time limit — Administrative & Regulatory Law

Administrative appeal (annulment before the TAR) — 60 days. A strict forfeiture term for asking the TAR to annul an administrative act.

What clients face

The problems that bring people to a sanctions lawyer

Sanctions questions arrive suddenly and usually through a third party — a bank, a counterparty, an authority. Here is what we see most often.

01

Funds blocked without a clear explanation

An account or payment is stopped and the reference to restrictive measures is vague. You need to know quickly whether you are designated, whether a reporting duty has been triggered and what may lawfully be released.

02

Not knowing whether you face criminal exposure

Compliance files can move into criminal investigation, and in Italy the assistance of a defence lawyer in criminal proceedings is always mandatory. Early advice shapes how the record is built from the first interview.

03

Advisers who only know half of the picture

You may find counsel strong on EU measures but unfamiliar with Italian procedure, or Italian lawyers without sanctions experience. Matching by specialism is what closes that gap.

How we help

Matching that starts from your actual problem

You do not need to know which area of law applies. Describe the measure, the date and who contacted you, and we take it from there.

Specialist matching

We look for lawyers whose practice genuinely covers sanctions, export controls, asset freezes and delisting work, rather than generalists taking the file as an exception.

Italian procedure, understood

Your lawyer knows the difference between ordinary and administrative jurisdiction, the route to the Cassazione and the strict forfeiture terms that govern challenges.

Cross-border coordination

Sanctions files often touch more than one country. We can match you with counsel used to working alongside foreign advisers and with EU-level proceedings.

Free and confidential

Setting out your situation costs nothing and commits you to nothing. We review what you send and come back with lawyers who handle this type of matter.

Cross-border files

We also match sanctions counsel in these countries

If your file involves more than one jurisdiction, matching works the same way: tell us which countries are concerned and we look for counsel who can coordinate across them.

Questions

Sanctions lawyers in Italy: common questions

What does a sanctions lawyer in Italy actually do?

Typically: advising on EU restrictive measures and their implementation, responding to freezing or reporting requests, preparing delisting and exemption applications, handling export-control questions, and defending clients when a compliance file turns into a criminal or administrative investigation. Because these matters cut across several areas of law, the lawyer often coordinates with foreign counsel.

Can a lawyer from outside Italy represent me in an Italian court?

To practise as an avvocato you must be registered in the albo degli avvocati kept by the territorial Consiglio dell’Ordine; registration under Law 247/2012 is the legal precondition to practise and to use the title. Where your matter also involves another country or EU-level proceedings, your Italian lawyer will normally work alongside advisers qualified there.

Is a lawyer compulsory in Italian criminal proceedings?

Yes. In criminal proceedings the assistance of a defence lawyer is always mandatory, so you cannot face an interview or hearing without counsel. Representation before the Corte di Cassazione is reserved to lawyers on the special albo dei cassazionisti, which means a file reaching the court of last resort needs counsel with that specific registration.

How are legal fees and court costs calculated in Italy?

There is no binding statutory tariff: since minimum fees were abolished in 2006, fees are agreed freely with the client, and where there is no agreement the court applies the ministerial parametri forensi (D.M. 55/2014). Court proceedings carry the contributo unificato, and legal aid (patrocinio a spese dello Stato) is available where annual taxable income does not exceed EUR 12,838.01.

Which Italian courts deal with these matters?

Italy divides jurisdiction into ordinary (civil and criminal) and special (administrative, accounting and tax). Civil first instance sits before the Tribunale, with appeal to the Corte d’Appello; administrative acts are challenged before the TAR, with appeal to the Consiglio di Stato. The Cassazione in Rome reviews questions of law only. Measures adopted at EU level follow a separate route.

How long do I have to act?

It depends on the act. An administrative act can be challenged before the TAR within 60 days, a strict forfeiture term rather than a limitation period that can be interrupted. The ordinary limitation period for civil claims is ten years, with five-year terms for tort claims and periodic payments. Put a dated chronology in front of a lawyer early.
