Sick leave in Italy

An Italian sick leave case needs a lawyer who works in the Italian system

Being off sick should not put your job or your income at risk, yet disputes over sick leave, medical certificates, dismissal and pay during illness are among the most common employment conflicts in Italy. If you are facing a disciplinary procedure, a dismissal letter or a refusal of your sick pay, the practical question is who represents you before the Italian labour courts. That is where we help. We are a European matching platform: you describe your situation in a few minutes, and we put you in touch with a sick leave lawyer in Italy whose practice covers employment and social-security matters. You keep the choice of lawyer and the fee agreed directly with them. Our service is free and carries no obligation to instruct anyone.

The Italian framework

How an Italian sick leave dispute actually works

Sick leave disputes in Italy are civil claims, decided by the ordinary courts under codified rules in the Civil Code and the Code of Civil Procedure. Below is how the system is organised, who may represent you, and the time limits and costs that shape these cases.

Where the case is heard

Italy is a civil law jurisdiction, and employment claims are dealt with as civil claims. The general first-instance court is the Tribunale ordinario, which sits as a single judge or as a three-judge panel depending on the matter. Appeals on the merits go to the Corte d’Appello, while the Corte Suprema di Cassazione in Rome reviews questions of law only.

Who may represent you

Practising as an avvocato requires registration in the albo degli avvocati kept by the territorial Consiglio dell’Ordine, under the national Consiglio Nazionale Forense. Under Law 247/2012, admission requires a five-year law degree, an 18-month traineeship and the State examination. Under art. 82 of the Code of Civil Procedure, a qualified lawyer is mandatory except before the Giudice di Pace for claims up to EUR 1,100.

Deadlines you cannot miss

Where the dispute concerns a dismissal, the notice must be challenged in writing within 60 days of receipt, and the claim must then be filed before the labour judge — or conciliation or arbitration started — within a further 180 days. Italian law treats these procedural terms as decadenza, that is forfeiture: unlike ordinary prescription, they cannot be interrupted, so delay can be fatal.

What it costs

Court proceedings carry the contributo unificato, a fee scaled by the value of the claim from EUR 43 to EUR 1,686, plus a EUR 27 marca da bollo; labour and social-security matters benefit from reduced or exempted fees. Lawyers’ fees are freely agreed, minimum fees having been abolished in 2006. Where annual taxable income does not exceed EUR 12,838.01, patrocinio a spese dello Stato may cover both court fees and the lawyer’s fees.

Mediation and other procedural steps

Before certain civil and commercial claims — condominium, inheritance, leases, medical liability, banking and insurance among them — a first mediation meeting is a condition of admissibility under art. 5 of Legislative Decree 28/2010. The condition is satisfied once that meeting takes place, even without a settlement. Whether your particular claim falls inside that list is something your lawyer can confirm.

Language and cross-border workers

Proceedings are conducted in Italian. German is co-official in Trentino-Alto Adige/Südtirol and French in Valle d’Aosta, so hearings and documents in those regions may involve those languages. If you worked in Italy but now live elsewhere in Europe, the same civil procedure applies, and a lawyer registered in Italy is the person who represents you there.

Key time limit — Employment Law

Employment dismissal claim — 60 days + 180 days. Challenge the dismissal in writing within 60 days of receiving the notice, then file before the labour judge within 180 days.

Common situations

When people start looking for a lawyer

Sick leave problems rarely arrive alone: a certificate is questioned, pay stops, and a letter follows. These are the moments when having the right lawyer matters.

01

A dismissal letter arrives while you are ill

The letter may look final, but Italian law gives you a short window to react in writing and a further period to bring the claim. Those terms run quickly and cannot be interrupted, so the first weeks are decisive.

02

Your pay during illness is stopped or reduced

You may be told that your absence was not justified or that your certificate was not accepted. Understanding what your contract and the applicable rules provide, and how to challenge the decision, needs a lawyer who works with these cases.

03

You don’t know which court or which lawyer

Italian procedure, court structure and language can be confusing, especially if you no longer live in the country. You want a lawyer who knows the labour courts and can tell you honestly what your case is worth.

How matching works

What you get from our service

We are not a law firm and we do not give legal advice. We introduce you to lawyers who practise in the area you need, and you decide what happens next.

A lawyer for your specific problem

We match you with a lawyer whose practice covers employment and social-security matters in Italy, rather than a generalist who rarely sees sick leave cases.

One short form, no charge

You describe what happened in your own words. Submitting your request costs nothing and does not commit you to instructing anyone.

Fees agreed directly with the lawyer

Italian lawyers set fees by agreement with the client, so you discuss and confirm the arrangement with the lawyer before any work begins.

You keep control of the decision

You receive the contact, ask your questions, and choose whether to proceed. If the fit is not right, you are free to walk away.

Questions and answers

Sick leave cases in Italy: what clients ask

Do I need a sick leave lawyer in Italy to bring a claim?

In most civil proceedings in Italy, yes. Under art. 82 of the Code of Civil Procedure, parties may appear in person only before the Giudice di Pace in cases worth no more than EUR 1,100. Before the Tribunale ordinario, representation or assistance by a qualified lawyer is mandatory, so a sick leave lawyer in Italy will normally act for you.

How long do I have to challenge a dismissal connected with sick leave?

The dismissal notice must be challenged in writing within 60 days of receiving it, and the claim must then be filed before the labour judge — or conciliation or arbitration started — within a further 180 days. These are forfeiture terms under Italian law, so they cannot be interrupted, and missing them can bar the claim.

Which court deals with employment and sick leave disputes in Italy?

The general first-instance civil court is the Tribunale ordinario, sitting as a single judge or as a three-judge panel depending on the matter. Appeals on the merits go to the Corte d’Appello. The Corte Suprema di Cassazione in Rome is the court of last resort and reviews questions of law only, not the merits.

What does it cost to bring a claim in Italy?

Court fees are the contributo unificato, scaled by the value of the claim from EUR 43 up to EUR 1,686, plus a EUR 27 marca da bollo; labour and social-security matters benefit from reduced or exempted fees. Lawyers’ fees are agreed freely with the client, and where there is no agreement the court applies the ministerial parameters.

Can I get legal aid for an employment case in Italy?

Patrocinio a spese dello Stato can cover court fees and the lawyer’s fees in civil and administrative cases where annual taxable income does not exceed EUR 12,838.01, under the parameters set by the decree of 10 May 2023. It is open to Italian citizens and to EU and non-EU nationals regularly resident in Italy.

Who is allowed to practise as a lawyer in Italy?

An avvocato must be registered in the albo degli avvocati kept by the territorial Consiglio dell’Ordine, with the Consiglio Nazionale Forense as the national body. Under Law 247/2012, admission requires a five-year law degree, an 18-month traineeship and the State examination. Representation before the Corte di Cassazione is reserved to lawyers on the special cassazionisti roll.
