You describe your situation once, and we send you profiles of suitable local lawyers, usually within 24–48 hours. There is no fee to get matched and no obligation to instruct.
Local context
How family law works in Italy
Family law in Italy is based on the Civil Code and the Code of Civil Procedure, with ordinary courts and notarial formalities playing a central role. Below you will find the key rules that shape separation, divorce, property, children and inheritance matters.
Civil-law family courts
Family matters are heard by the ordinary civil courts: the Tribunale ordinario as the general first-instance court, with appeals to the Corte d’Appello and points of law to the Corte Suprema di Cassazione. The system is governed by the Constitution and the civil procedure code, with Italian as the main language.
Who may represent you
In almost all family proceedings you must be represented by an avvocato registered with the territorial Ordine degli Avvocati. Only claims before the Giudice di Pace up to EUR 1,100 may be conducted in person. Before the Cassazione, only lawyers on the special albo dei cassazionisti may act.
Community property and separation
Unless you have a notarised prenuptial agreement choosing separation of property, the default regime in Italy is community of assets acquired after marriage (comunione legale dei beni). Assets acquired during marriage are common, while those owned before marriage or received by gift or inheritance remain personal.
Divorce timeframes
After a legal separation, divorce may be requested six months after a consensual separation or twelve months after a judicial separation. These are statutory periods, so your lawyer will first verify which type of separation applies and calculate the relevant date.
Forced heirship and reserved shares
Spouses, children and (without children) ascendants are legittimari with a reserved share of the estate. A sole child is reserved one half; two or more children are reserved two thirds divided equally. Only the remaining quota disponibile may be freely disposed of, and an aggrieved legittimario can bring the azione di riduzione.
Mediation before certain claims
Before bringing certain civil claims, including division or inheritance disputes, the parties must first attempt mediation as a condition of admissibility under Legislative Decree 28/2010. A lawyer can confirm whether your family matter falls within this requirement and prepare you for the first meeting.
Key time limit — Family Law
Divorce after legal separation — 6 months (consensual) / 12 months (judicial). Period runs from the conclusion of the separation.

Common challenges
What makes Italian family law difficult
You may recognise one of these situations.
Italian procedure feels opaque
You may be unsure whether separation, divorce or child arrangements start with the court, a notary or mediation. A local avvocato clarifies the steps, documents and realistic timelines before you commit.
Property and inheritance worries
Community property, reserved shares and notarial deeds create complexity. Without a specialist, you risk overlooking forced heirship rights or signing an instrument that cannot be transcribed.
Language and local court rules
If you do not speak Italian or are abroad, terms like comunione legale, legittima and quota disponibile are daunting. We match you with a lawyer who can explain and act.
