How it works in Latvia
A separate court branch for public-law disputes
Latvian administrative disputes do not follow the same track as ordinary civil claims. They are heard by a dedicated branch of the judiciary: an administrative district court at first instance, an administrative regional court on appeal, and the Department of Administrative Cases of the Supreme Court (Senate) for cassation. Procedure is codified in the Administrative Procedure Law, and the language of the court is Latvian, so documents in a foreign language must be filed together with a translation. Whether you are contesting a decision of a State authority, a local government or a regulator, the practical questions are the same: who represents you, and by when must each step be taken. Below we set out how the system is built, what is mandatory, and how we match you with an administrative law lawyer in Latvia who handles your type of matter.
Latvia in detail
Administrative justice in Latvia: structure, representation and cost
Latvia is a civil law jurisdiction in which procedure is codified separately for civil, criminal and administrative matters. Public-law disputes are therefore resolved by a specialised court branch rather than by the ordinary civil courts. These are the practical features that shape an administrative case in Latvia.
A dedicated administrative court branch
Administrative cases are decided by an administrative district court at first instance and by an administrative regional court on appeal. The final instance is the Department of Administrative Cases of the Supreme Court (Senate), which decides collegially in a composition of three Senators. Cassation there is a review of legality, not a third full hearing of the facts.
Procedure is codified separately
Latvian procedure is set out in distinct codes: the Civil Procedure Law, the Criminal Procedure Law and the Administrative Procedure Law. Administrative disputes therefore run on their own procedural rules, and time limits and formal requirements differ from those in a civil claim. Your advocate will identify the correct procedural track before anything is filed.
Who may practise as an advocate
Practice as a sworn advocate in Latvia requires admission to the Latvian Council of Sworn Advocates, a mandatory self-governing professional body. An advocate must satisfy statutory qualification requirements, take the advocate’s oath and comply with the Code of Ethics of Latvian Sworn Advocates. In criminal proceedings a defence counsel must be a sworn advocate or an assistant of a sworn advocate.
Representation is not always compulsory
In civil procedure a natural person may conduct a case personally or through any authorised representative, subject to statutory restrictions. Advocate representation is mandatory only in defined situations, notably cases within the jurisdiction of the Economic Court and obligation claims exceeding EUR 150 000. In criminal proceedings, defence counsel is mandatory in the cases listed in Section 83 of the Criminal Procedure Law.
Costs, fees and what can be recovered
Court expenses comprise the State fee, the office fee and expenses connected with examination of the case. Advocates’ fees are agreed freely between advocate and client; there is no State tariff. If you win, the losing party reimburses your advocate’s assistance only within statutory ceilings, so part of your legal costs will usually remain your own.
State ensured legal aid
State ensured legal aid is available to natural persons under the State Ensured Legal Aid Law. Those entitled include Latvian citizens, non-citizens and other listed persons who hold low-income or needy status, who face a sudden situation preventing them from protecting their rights, or who are fully maintained by the State or a local government. The system is administered by the Legal Aid Administration.

Why clients hesitate
The doubts that delay a public-law dispute
Administrative cases are won or lost on procedure and timing as much as on argument. These are the concerns clients raise with us most often.
I do not know which court hears this
Administrative disputes go to a separate court branch, not the ordinary civil courts. Choosing the wrong route, or the wrong first instance, costs time that a short appeal period rarely allows you to recover.
The procedure and the language are unfamiliar
Latvian procedure is codified in its own code, and court proceedings are conducted in Latvian. Foreign-language documents must be filed with a translation, which makes local, Latvian-speaking counsel a practical necessity rather than a luxury.
I cannot judge the cost in advance
Advocates’ fees in Latvia are freely agreed and there is no State tariff, while the amount recoverable from the losing party is capped by statute. Without a clear estimate, it is difficult to decide whether to proceed.
What you get
Matched with counsel who knows the Latvian system
We are not a law firm. We are a free matching service that connects you with a Latvian advocate suited to your administrative matter.
Advocates admitted in Latvia
We match you with sworn advocates admitted to the Latvian Council of Sworn Advocates, who are bound by statutory qualification requirements and the Code of Ethics of Latvian Sworn Advocates.
The right court branch from the start
Your advocate will confirm whether the matter belongs before an administrative district court, an administrative regional court on appeal, or ultimately the Department of Administrative Cases of the Senate.
Clear view of fees and recovery
You receive an explanation of how the State fee and the office fee are calculated, how the advocate’s fee is agreed, and what proportion of your costs may realistically be recoverable.
Support in Latvian and in your language
Because proceedings are conducted in Latvian and translations are required, we look for counsel who can work with you in a shared language and manage the translation of your documents.
Cross-border matters
Working with Latvia from elsewhere in Europe
Administrative decisions in Latvia can affect companies, property owners and individuals based anywhere in Europe. We regularly take enquiries from clients in these countries who need Latvian counsel on the ground.
Common questions
Administrative law in Latvia: frequently asked questions
Which courts decide administrative disputes in Latvia?
Administrative courts form a separate branch. An administrative district court hears the case at first instance, an administrative regional court decides the appeal, and the Department of Administrative Cases of the Supreme Court (Senate) is the cassation instance. Cassation there is a review of legality rather than a fresh examination of the facts.
Do I have to instruct a sworn advocate to act in Latvia?
Not always. In civil procedure a natural person may conduct a case personally or through an authorised representative, and advocate representation is mandatory only in defined situations, such as cases within the jurisdiction of the Economic Court and obligation claims exceeding EUR 150 000. In criminal proceedings, defence counsel is mandatory in the cases listed in the Criminal Procedure Law.
How do I choose an administrative law lawyer in Latvia?
Look for a sworn advocate admitted to the Latvian Council of Sworn Advocates who works on public-law and regulatory matters, and who can handle proceedings in Latvian. We take your description of the dispute, match it with an advocate whose practice covers that type of case, and let you decide whether to instruct them.
In what language are Latvian court proceedings conducted?
Proceedings take place in the official language, Latvian. Participants filing documents in a foreign language must submit them together with a translation into Latvian. Interpreters may be used where the law provides for it. In practice this means your counsel needs to work in Latvian, even when your own working language is different.
What does an administrative case cost in Latvia, and what can be recovered?
Court expenses include the State fee, the office fee and expenses connected with examining the case. Advocates’ fees are agreed between advocate and client, as there is no State tariff. If you win, the losing party reimburses your advocate’s assistance only within statutory ceilings, so expect part of your costs to remain your own.
Can I get State ensured legal aid in Latvia?
State ensured legal aid is available to natural persons only, under the State Ensured Legal Aid Law. Those entitled include Latvian citizens, non-citizens and other listed persons holding low-income or needy status, those facing a sudden situation preventing them from protecting their rights, and those fully maintained by the State or a local government. It is administered by the Legal Aid Administration.
