Before you choose

Why a Latvian specialist matters for a capital gains file

If you have sold property, shares or another asset and the Latvian tax authority questions the result, the practical question is not only how the gain is characterised but who represents you and in which court. A capital gains tax lawyer in Latvia works where tax assessment meets litigation: reviewing the documents behind the disposal, dealing with the tax administration and, where needed, conducting an administrative case. Latvia is a civil law country where procedure is codified separately, tax disputes run through a dedicated administrative court branch, and proceedings are held in Latvian, so foreign-language documents must be filed with a translation. This page sets out how that framework works, what timing applies and how costs are treated. We do not give tax advice here; we match you with a specialised Latvian advocate who handles your file.

Latvia in detail

How a capital gains matter is handled in Latvia

Latvian tax and property litigation is governed by codified statutes rather than by case law, and it does not always follow the ordinary civil route. The points below set out the framework that applies to a capital gains file: who may represent you, which court hears the case, which language is used and how costs are dealt with.

A civil law system with codified procedure

Latvia is a civil law jurisdiction. Private law rests on the Civil Law (Civillikums) of 1937, whose force was restored in 1992, supplemented by the Commercial Law and special statutes, while procedure is codified separately in the Civil Procedure Law, the Criminal Procedure Law and the Administrative Procedure Law. Rulings of the Supreme Court Senate are not formally a source of law, though they develop uniform judicial practice.

Which court hears a tax dispute

Administrative courts form a separate branch of the Latvian judiciary. The administrative district court hears a tax matter at first instance, the administrative regional court decides the appeal, and the Department of Administrative Cases of the Senate of the Supreme Court is the cassation instance. Cassation is a review of legality, not a fresh trial of the facts, so the record built earlier carries real weight.

Who may act for you

Practice as a sworn advocate requires admission to the Latvian Council of Sworn Advocates, the mandatory self-governing body, an oath and compliance with the advocates’ Code of Ethics. In civil procedure a natural person may litigate personally or through an authorised representative; advocate representation is compulsory only in Economic Court cases and in obligation claims exceeding EUR 150 000 (Civil Procedure Law, Section 82.1).

Language of proceedings and translation

Court proceedings in Latvia are conducted in Latvian. Participants must file foreign-language documents together with a translation into Latvian (Civil Procedure Law, Section 13), and interpreters may be used where the law provides for them. For a seller, buyer or investor working in another language, translation is a real step in the timetable rather than an afterthought.

Fees, State fee and what is recoverable

Advocates’ fees are agreed between advocate and client; Latvia sets no State tariff for advocacy services. Court expenses include the State fee, calculated on the amount claimed in progressive bands under Civil Procedure Law, Section 34. If you win, the opponent reimburses your advocate’s assistance only within statutory ceilings — for example, not more than 30 per cent of the satisfied part of a claim of up to EUR 8 500.

State ensured legal aid

State ensured legal aid is available to natural persons only, under the State Ensured Legal Aid Law, and is administered by the Legal Aid Administration. It covers consultation and representation for persons with low-income or needy status, for those facing a sudden situation and material condition preventing them from protecting their rights, and for persons fully maintained by the State or a local government; Section 6 lists the grounds for refusal.

Common difficulties

What makes these files harder than they look

Most problems in a Latvian capital gains matter come from timing and from the structure of the court system, not from the substance of the transaction.

01

The correspondence arrives in Latvian

The tax administration writes in Latvian and cites codified statutes. By the time a letter is translated informally, part of the response window may already have gone, and the documents behind the disposal still need to be assembled in order.

02

Three procedure codes, three routes

Latvian procedure separates civil, administrative and criminal tracks, each with its own code and its own time limits. Filing in the wrong branch, or appealing to the wrong instance, consumes the shortest and most valuable weeks of a case.

03

Costs are only partly recoverable

Latvia sets no State tariff for advocates, but if you win, the opponent reimburses your legal costs only up to statutory ceilings. Clients who budget on the assumption of full recovery are often surprised by the gap between the invoice and the award.

How matching works

What you get from a matched Latvian advocate

We are not a law firm and we do not give advice. We identify the right specialist for your file and put you in direct contact, free of charge.

Advocates admitted in Latvia

Every advocate we introduce practises through the Latvian Council of Sworn Advocates, having met the statutory qualification requirements, taken the advocate’s oath and accepted the Code of Ethics.

The right branch of the court

Your matter is routed to someone who knows the difference between the administrative court branch, the Economic Court and ordinary civil litigation, and who can act before the relevant term runs out.

Documents prepared for Latvian filing

Foreign-language documents must be filed with a Latvian translation. Your advocate coordinates the file so that exhibits, translations and submissions reach the court in the form it expects.

Costs explained before you commit

Because fees are agreed rather than tariffed, and reimbursement is capped by statute, you receive a clear picture of what is payable and what is realistically recoverable before any work starts.

Cross-border

Also matching in other European jurisdictions

If your disposal, holding structure or residence touches more than one country, we can look for counsel in the other jurisdictions involved as well as in Latvia.

Questions and answers

Frequently asked questions

Do I always need a capital gains tax lawyer in Latvia to challenge an assessment?

Not in every case. In civil procedure a natural person may act personally or through an authorised representative, and advocate representation is compulsory only in Economic Court cases and in obligation claims above EUR 150 000. Tax files are nonetheless document-heavy and tightly timed, so we match you with an advocate who handles them routinely.

Which courts deal with tax disputes in Latvia?

Administrative courts form a separate branch. The administrative district court hears the matter at first instance, the administrative regional court decides the appeal, and the Department of Administrative Cases of the Senate of the Supreme Court is the cassation instance. Cassation reviews legality rather than re-hearing the facts.

Can the proceedings be conducted in English?

No. Court proceedings are held in Latvian, and documents in a foreign language must be filed together with a Latvian translation (Civil Procedure Law, Section 13). Interpreters may be used where the law provides for them. Your advocate handles the Latvian filings and keeps you informed about what the file requires.

How long do I have to appeal in Latvia?

In civil proceedings an appeal against a first-instance judgment must be lodged within 20 days, and a cassation complaint to the Senate within 30 days. Administrative procedure follows its own codified rules, so the applicable term should be confirmed for your specific case before anything is filed.

Will I recover my legal costs if I win?

Only in part. Latvia sets no tariff for advocates’ fees, but reimbursement is capped by Civil Procedure Law, Section 44: for a financial claim of up to EUR 8 500, the actual cost but no more than 30 per cent of the satisfied part, and for claims between EUR 8 501 and EUR 57 000, no more than EUR 2 850.

Is State legal aid available for a tax matter?

State ensured legal aid is available to natural persons under the State Ensured Legal Aid Law and is administered by the Legal Aid Administration. It covers consultation and representation for those with low-income or needy status, for sudden situations preventing you from protecting your rights, and for persons fully maintained by the State or a local government. Section 6 lists the refusal grounds.
