Estate planning in Latvia, explained from the ground up

Estate planning in Latvia sits inside a civil-law system whose core private law is the Civil Law (Civillikums) of 1937, restored in force in 1992 and supplemented by the Commercial Law and special statutes. Whether you own property in Riga, hold assets across borders or need to settle an inheritance arising in Daugavpils, Liepāja or Valmiera, the documents you sign today shape what your family can do later. An estate planning lawyer in Latvia reads your situation against that framework, explains the instruments available to you and shows you where the risks are. We do not practise law ourselves: we listen to your case and match you with a Latvian advocate whose practice covers succession, inheritance and estate matters, free of charge and usually within 24 to 48 hours.

Latvia in detail

How estate and succession matters actually work in Latvia

Latvian succession sits in a codified civil-law framework with its own limitation periods, language rules and cost structure. These are the practical points that shape an estate file, drawn from the official sources listed below.

The 1937 Civil Law frames every estate plan

Latvia is a civil-law jurisdiction. Its core private law is the Civil Law (Civillikums) of 1937, whose force was restored in 1992, supplemented by the Commercial Law and special statutes. An advocate reads your will, gifts or family arrangements against that framework rather than against common-law habits, and explains what each instrument actually does. Procedure is codified separately in the Civil Procedure Law.

An inheritance action runs on a five-year clock

Latvian law sets a specific limitation period for the inheritance action — the claim by which an inheritance is recovered: five years. Ordinary claims arising from obligation rights carry a general ten-year prescription under the Civil Law. If you are weighing up a dispute with other heirs, dates matter a great deal, and a Latvian advocate will establish the relevant date for your file.

Your court file has to be in Latvian

Civil proceedings are conducted in the official language, Latvian, and foreign-language documents must be filed together with a Latvian translation under Section 13 of the Civil Procedure Law. For families spread across Europe this is a real cost and timetable factor, not a formality. A Latvian advocate coordinates the translation and keeps your evidence admissible.

When an advocate is compulsory — and when it is not

In civil procedure a natural person may conduct a case personally or through an authorised representative (Civil Procedure Law, Sections 82 and 83). Representation through an advocate becomes mandatory only in defined situations: cases within the jurisdiction of the Economic Court and cases arising from obligation rights where the amount claimed exceeds EUR 150 000 (Section 82.1).

Fees are contractual, but recovery is capped

Advocates’ fees are agreed between advocate and client; there is no State tariff for advocacy services. If you win, the losing party reimburses your advocate’s assistance only within the ceilings of Section 44 of the Civil Procedure Law — for example not more than EUR 2 850 where the amount claimed is between EUR 8 501 and EUR 57 000. State fees are charged separately in progressive bands.

Legal aid and the route through the courts

State ensured legal aid is open to natural persons under the State Ensured Legal Aid Law, for instance those holding low-income or needy status or facing a sudden situation that prevents them from protecting their rights; it is administered by the Legal Aid Administration. If a first-instance judgment goes against you, appeal lies to the regional court and, on legality, to the Senate.

Key time limit — Inheritance, Probate & Wills

Inheritance action (recovery of an inheritance) — 5 years. A dedicated shorter period applies to claims for recovery of an inheritance.

All figures and procedural statements above come from official Latvian sources (likumi.lv — Law on Judicial Power, Civil Procedure Law, Civil Law, Criminal Procedure Law, State Ensured Legal Aid Law) and the Latvian Council of Sworn Advocates, consulted in 2025.

What clients bring us

The estate problems people actually arrive with

Most enquiries are not about elegant planning. They are about a document nobody can interpret, a family spread over three countries and a deadline that is closer than it looks.

01

Documents nobody can interpret

A will, a gift deed or a family arrangement was signed years ago, possibly in another language. You need to know what it means under the Latvian Civil Law before you rely on it or discuss it with relatives.

02

Heirs in different countries

One heir lives in Riga, another in Germany, a third in Estonia, and the property sits in Latvia. Court files must be in Latvian with translations, which turns a family conversation into a procedural project with a timetable.

03

Not knowing whether a court is needed

You may not need litigation at all, or you may be closer to a limitation period than you think. An inheritance action carries its own five-year period, so the first conversation should establish the facts.

How we help

A calmer route to the right Latvian advocate

We are not a law firm and we do not give legal advice. We take your description of the matter and route it to advocates whose practice matches it.

Succession-focused matching

We match you with a Latvian advocate who handles inheritance, succession and estate matters, rather than a generalist who would have to learn the file alongside you.

You explain it once

One written description of your situation replaces the same introductory call with five different chambers. You decide afterwards which advocate you instruct.

Knowledge of local procedure

Your matched advocate works with the Civil Procedure Law, the Latvian-language filing rules and the statutory cost ceilings as a matter of routine, not as an exception.

Free and without pressure

Getting matched costs nothing and creates no obligation. If you later instruct an advocate, the fee agreement is between you and that advocate, as Latvian law requires.

Cross-border estates

Families we help across Europe

Latvian property, Latvian heirs abroad and foreign heirs with Latvian assets are common combinations. We regularly receive enquiries connected with these countries.

Questions

Estate planning in Latvia: frequent questions

Do I need an estate planning lawyer in Latvia if I live abroad?

Not automatically, but it is usually sensible. Latvian civil procedure allows a natural person to act personally or through an authorised representative, so foreign residence alone does not create a mandatory requirement. What does matter is that court files must be in Latvian with translations, and that limitation periods such as the five-year inheritance action run regardless of where you live.

How long do I have to bring an inheritance claim in Latvia?

The inheritance action — the claim by which an inheritance is recovered — is subject to a five-year period under the Civil Law. Other claims arising from obligation rights follow a general ten-year prescription. Because the starting point depends on your particular facts, an advocate should date the claim before you decide whether to negotiate or to litigate.

In what language will a Latvian court handle my estate file?

Proceedings are conducted in Latvian, the official language of the courts. Under Section 13 of the Civil Procedure Law, documents in a foreign language must be filed together with a translation into Latvian. Budget for translation and allow time for it, because evidentiary material that arrives without a translation cannot simply be used as it stands.

Must I be represented by an advocate in a Latvian civil case?

Generally no. Under Sections 82 and 83 of the Civil Procedure Law a natural person may conduct a case personally or through an authorised representative. Representation through an advocate is mandatory in defined situations only, including cases within the jurisdiction of the Economic Court and obligation claims exceeding EUR 150 000.

How are advocates’ fees regulated in Latvia?

There is no State tariff for advocacy services; fees are agreed between the advocate and the client. If you win a civil case, the losing party reimburses your advocate’s assistance only within the statutory ceiling of Section 44 of the Civil Procedure Law — for instance a maximum of EUR 2 850 for claims between EUR 8 501 and EUR 57 000. Expect part of your costs to remain your own.

Can I obtain State-funded legal aid in Latvia?

State ensured legal aid is available to natural persons under the State Ensured Legal Aid Law, for example where the applicant holds low-income or needy status, or faces a sudden situation and material condition preventing them from protecting their rights. The system is run by the Legal Aid Administration, and aid is refused on the exhaustive grounds set out in Section 6 of that law.
