Why this page
Product liability claims through the Latvian courts
A defective product can cause injury, property damage or purely financial loss, and in Latvia such disputes are resolved as civil claims before the ordinary courts. Whether you bought the goods in Riga, Daugavpils or Liepaja, or ordered them online from another Member State, the practical questions are the same: which court hears the case, how long the proceedings take, what the State fee will be, and whether you must instruct an advocate at all. This page explains how a product-related claim travels through the Latvian court system under the Civil Procedure Law and the Civil Law, and what costs you can realistically expect to recover. If you want a product liability lawyer in Latvia who already handles these claims, describe your situation and we will match you with a specialist.
Latvia in practice
How a product liability claim works in Latvia
Latvia is a civil law jurisdiction. The core private law is the Civil Law of 1937, restored in 1992 and supplemented by the Commercial Law and special statutes, while procedure is codified separately in the Civil Procedure Law. Product-related disputes follow that civil track, not a separate consumer court.
Three instances, one route
Product liability disputes are civil matters and follow the ordinary three-instance structure. A district (or city) court hears the case first, a regional court decides an appeal, and the Supreme Court (Senate) acts as the cassation instance. Cassation is a review of legality rather than a fresh trial of the facts, so the evidence you build at first instance matters most.
The Economic Court in Riga
A specialised Economic Court sits in Riga and covers the whole territory of Latvia for the categories of cases assigned to it by the Civil Procedure Law. Where a claim falls within its jurisdiction, the parties must conduct the case personally or through an advocate, so an authorised company representative alone is not enough.
When an advocate is compulsory
In civil procedure a natural person may litigate in person or through an authorised representative. Representation through an advocate becomes mandatory only in defined situations: cases within the jurisdiction of the Economic Court and cases arising from obligation rights where the amount claimed exceeds EUR 150 000. That threshold decides whether you must retain a Latvian advocate.
Proceedings are held in Latvian
Latvian is the official language of court proceedings. Documents drawn up in another language must be filed together with a translation into Latvian, and interpreters may be used where the law provides for them. For a foreign claimant this makes a Latvian-speaking advocate and reliable translations part of the practical preparation rather than an afterthought.
State fee and recoverable costs
Court expenses combine the State fee, the office fee and expenses connected with the examination of the case, while litigation expenses include the cost of advocates’ assistance and interpreters. The State fee is calculated on the amount claimed in progressive bands. If you win, the other side reimburses your advocate’s fees only up to statutory ceilings, so plan for a shortfall.
Legal aid if you qualify
State ensured legal aid is open to natural persons who hold low-income or needy status, who find themselves suddenly in a situation preventing them from protecting their rights, or who are fully maintained by the State or a local government. It covers both consultation and representation and is administered by the Legal Aid Administration.
The country information on this page is taken from official Latvian sources — likumi.lv, which publishes Latvian legislation, and the Latvian Council of Sworn Advocates — consulted for the current version of this page.
Common problems
What usually makes a defective product claim difficult
These are the practical obstacles clients raise before we introduce them to a Latvian advocate.
The responsible party is unclear
Imported goods often pass through a distributor, an importer and a retailer before reaching you, and the commercial chain behind the product is not always documented well enough to identify the right defendant.
Costs feel unpredictable
Latvian advocates agree their fees with the client, and statutory recovery of those fees is capped, so part of what you spend may never be reimbursed even if the claim succeeds.
Evidence sits abroad
Invoices, expert reports and correspondence produced in another country must be translated into Latvian before a court can rely on them, and gathering that material takes time.
How we help
Matching you with the right Latvian advocate
You describe the problem once, and we route it to advocates whose practice covers it.
Specialists in defective goods
We match you with advocates whose practice includes claims arising from products that caused damage, so you are not explaining the basics from scratch.
Local procedural knowledge
Your advocate works with the Latvian court structure every day: which court hears the case first, when an appeal is possible and how cassation differs from appeal.
Clear cost expectations
You are told how advocates structure their fees, what the State fee bands look like and why statutory ceilings mean only part of your costs may be recovered.
Free, no-obligation matching
Being introduced to a lawyer costs you nothing. You decide afterwards whether to instruct the advocate and on what terms.
Cross-border reach
Claims with a Latvian and a foreign element
Products sold in Latvia are frequently manufactured or distributed elsewhere in Europe. We work with advocates who handle matters involving clients and defendants from other jurisdictions.
Questions
Product liability in Latvia: what clients ask
Do I have to instruct a product liability lawyer in Latvia, or can I act alone?
In civil procedure a natural person may conduct a case personally or through any authorised representative. Advocate representation becomes mandatory only in specific situations: cases within the jurisdiction of the Economic Court, and cases arising from obligation rights where the amount claimed exceeds EUR 150 000.
Which Latvian court will hear my claim?
First-instance civil claims go to a district (or city) court, with the Economic Court in Riga handling certain categories nationwide. A regional court hears appeals, and the Supreme Court (Senate) is the cassation instance, reviewing legality rather than re-deciding the facts.
How long do I have to bring a civil claim connected with a defective product?
Under the Civil Law, obligation rights are generally prescribed after 10 years. That is the outer framework for civil claims, but specific circumstances can change how it applies to your matter, so an advocate should assess the dates early.
In what language will the proceedings take place?
Latvian is the official language of court proceedings. Documents in a foreign language must be filed with a translation into Latvian, and interpreters may be used where the law provides. This is why Latvian-speaking counsel and accurate translations matter in practice.
What will it cost to start a claim?
Court expenses comprise the State fee, the office fee and case-related expenses, and the State fee is calculated on the amount claimed in progressive bands. Advocates’ fees are agreed freely with the client; there is no State tariff for advocacy services.
Can I recover my legal costs if I win?
Only within statutory ceilings. Reimbursement of an advocate’s assistance is capped, for example at 30 per cent of the satisfied part of a financial claim of up to EUR 8 500, or a maximum of EUR 2 850 where the amount claimed is between EUR 8 501 and EUR 57 000.
