Before you choose a lawyer

Sick leave, employment and social insurance in one dispute

Sick leave in Latvia touches several areas of law at once: the employment relationship, social insurance benefits and, when something goes wrong, the procedural rules that decide the conflict. Most people manage the certificate itself without help, but they often need a lawyer when an employer questions the absence, when a benefits decision is contested, or when a claim has to be filed with a court. This page explains how that legal work is organised in Latvia — which courts hear what, which time limits apply, how fees are set and when the State pays for a lawyer. Describe what happened in a few lines and we match you with a sick leave lawyer in Latvia who handles cases like yours. The matching service is free and commits you to nothing.

Latvia in practice

How sick leave disputes move through the Latvian system

Latvia’s court structure, fixed time limits and cost rules shape how a sick leave conflict is handled in practice. The blocks below summarise the framework that applies, taken from official Latvian sources. They describe the system in general terms, not your individual case.

Where a health-related dispute is decided

Latvia is a civil law jurisdiction, and private-law disputes are decided under the Civil Law of 1937, whose force was restored in 1992, supplemented by the Commercial Law and special statutes. Claims arising from obligations go before district (city) courts or the Economic Court, while challenges to administrative decisions follow the separate administrative court branch.

Who may represent you before a Latvian court

Only a sworn advocate admitted to the Latvian Council of Sworn Advocates may practise as an advocate in Latvia. In civil procedure, however, a natural person may conduct a case personally or through an authorised representative; representation through an advocate is mandatory only in Economic Court cases and in obligation claims exceeding EUR 150 000.

Time limits that decide cases before the merits

Time limits settle many disputes before the facts are even discussed. The general prescription period for obligation rights is ten years, an appeal against a first-instance civil judgment must be filed within 20 days, and a cassation complaint to the Senate within 30 days. Court-ordered mediation may run for up to six months.

What legal costs look like and what can be recovered

Latvian law sets no tariff for advocates’ fees: they are agreed between advocate and client. If you win, the losing party reimburses your advocate’s assistance only within statutory ceilings — for example, not more than 30 per cent of the satisfied part of a financial claim of up to EUR 8 500. Part of your costs normally stays your own.

State ensured legal aid for low-income and crisis situations

State ensured legal aid is available to natural persons only. It covers Latvian citizens, non-citizens and other persons listed in the law who hold low-income or needy status, who face a sudden situation and material condition preventing them from protecting their rights, or who are fully maintained by the State or a local government. Applications are handled by the Legal Aid Administration.

The language in which your case is heard

Proceedings in Latvia are conducted in Latvian, the official language of the courts. Documents in a foreign language must be filed together with a translation into Latvian, and interpreters may be used where the law provides for it. For clients who do not speak Latvian, counsel who works in their own language is a practical necessity.

All country information on this page is drawn from official Latvian legal sources published on likumi.lv, the national legislative database, last consulted in 2025.

Typical situations

When a sick leave problem turns into a legal problem

Three situations we see most often from clients dealing with Latvia.

01

Pay stops and the dispute begins

You are on sick leave and the employer questions the certificate, reduces pay or ends the contract. The medical side is clear, the legal side is not, and you need to know where a claim would actually be filed.

02

A benefits decision you cannot read

A decision on sickness or incapacity benefit arrives full of legal references and a short window for challenge. Without guidance it is easy to miss the one step that keeps the case alive.

03

Deadlines that pass quietly

Latvian procedure works with fixed periods: 20 days for a civil appeal, 30 days for cassation, 10 days for many criminal steps. Missing one can end a strong case before it is examined.

Why use the matching service

Matched with a lawyer who knows the Latvian rules

You describe the problem once; we look for counsel whose practice fits it.

A specialist, not the first name available

Sick leave matters sit between employment law, social insurance and procedure. We look for a lawyer whose practice covers the area your question actually falls into, rather than a generalist.

Clarity on deadlines and fees in advance

Before you commit you can ask what time limits apply in your situation and how fees are usually structured in Latvia, including which part of the cost may be recoverable from the other side.

Latvian-language proceedings covered

Court business is conducted in Latvian and foreign documents need translation. The lawyers we work with file in Latvian and can guide you through translation and interpretation requirements.

State legal aid assessed

If your income or circumstances may qualify you for State ensured legal aid, a lawyer can explain how the application to the Legal Aid Administration is made and what it covers. Matching stays free.

Questions and answers

Sick leave and legal representation in Latvia

What does a sick leave lawyer in Latvia actually handle?

Sick leave itself is certified by a doctor; the legal work sits around it. That can mean a dispute with an employer about pay or termination during absence, a challenge to a benefit decision taken by a State body, or the preparation of a civil claim. Describe your situation and we match you with counsel whose practice covers it.

Do I have to hire a lawyer to deal with a Latvian court?

Not always. In civil procedure a natural person may conduct a case personally or through an authorised representative. Representation through an advocate is mandatory only in defined situations, such as cases before the Economic Court and obligation claims where the amount claimed exceeds EUR 150 000. In criminal matters different rules apply.

How long do I have to appeal a judgment in Latvia?

An appeal against a first-instance civil judgment must be filed within 20 days, and a cassation complaint to the Supreme Court (Senate) within 30 days. In criminal proceedings an appeal runs for 10 working days, which the court may extend to 20. These periods are strict, so early advice matters.

Can the State pay for my lawyer in Latvia?

State ensured legal aid is available to natural persons who hold low-income or needy status, who face a sudden situation and material condition preventing them from protecting their rights, or who are fully maintained by the State or a local government. It covers consultation and representation and is administered by the Legal Aid Administration.

Are lawyer fees in Latvia fixed by law?

No. There is no State tariff for advocacy services; fees are agreed between the advocate and the client. If you win, the losing party reimburses your advocate’s assistance only within statutory ceilings, so a portion of your costs usually remains your own. Agreeing the fee basis in writing at the outset is normal practice.

In what language will a sick leave case be heard in Latvia?

Court proceedings are conducted in Latvian, the official language of the courts, and documents in a foreign language must be filed with a translation into Latvian. Interpreters may be used where the law provides for it. Working with counsel who speaks your language makes the process considerably easier.
