Why this page

What to expect from insolvency work in Liechtenstein

Insolvency and debt-enforcement in Liechtenstein are shaped by civil-law rules largely received from the Austrian Allgemeines Bürgerliches Gesetzbuch, and enforcement matters sit with the Fürstliches Landgericht in Vaduz. Whether you are a creditor pursuing an unpaid invoice, a director under pressure from suppliers, or a business owner weighing a restructuring, insolvency lawyers in Liechtenstein can map your position before you commit to a route. Because Liechtenstein is an EEA member, EEA internal-market law and the EFTA Court framework also influence cross-border files. Proceedings and advice are conducted in German. This page sets out the court structure, the limitation periods that decide cases, how costs are calculated and how our free matching service connects you with a lawyer who handles insolvency work.

Liechtenstein in detail

How insolvency and enforcement actually works in Liechtenstein

Liechtenstein combines a compact domestic court system with full participation in the EEA internal market. For insolvency and debt-recovery files, that means German-language proceedings, value-based court fees in Swiss francs, and clear statutory periods that determine whether a claim survives.

Three instances of ordinary jurisdiction

Ordinary jurisdiction runs through three instances: the Fürstliches Landgericht in Vaduz as first instance, which includes an Exekutionsabteilung for enforcement; the Obergericht as second instance, sitting in three senates; and the Oberster Gerichtshof as third instance. The Oberster Gerichtshof also acts as the Verwaltungsgerichtshof. The Staatsgerichtshof is a separate constitutional court that hears constitutional complaints.

Who is allowed to practise as a lawyer here

Only persons entered in the Liechtenstein list of lawyers (Rechtsanwaltsliste), kept by the Liechtensteinische Rechtsanwaltskammer, may practise as Liechtenstein lawyers. The Lawyers Act requires legal capacity, trustworthiness, Liechtenstein or EEA nationality, a bar or aptitude examination or three years of regular practice, a domestic office and professional indemnity insurance. Lawyers qualified elsewhere in the EEA may provide services under free movement rules.

Do you need a lawyer to appear?

The Zivilprozessordnung contains no general obligation to be represented by a lawyer, and section 33(1) expressly permits a party to grant a power of attorney to a person who is not a lawyer. Sections 28 to 31 regulate powers of attorney and the representation of parties, so you may act in person or through an agent. Representation rules for specific high-value or higher-instance matters should be checked case by case.

What court proceedings cost

Court fees follow the Gerichtsgebührengesetz. The assessment base is normally the value in dispute, amounts are rounded up to the next franc, and foreign-currency amounts are converted into Swiss francs at the SIX AG reference rate. If a fee is not paid on time, a Zahlungsauftrag demands payment within two weeks plus a CHF 25 surcharge, after which the order is directly enforceable.

Legal aid and free advice in simple cases

Verfahrenshilfe under section 63 ZPO is available to a party who cannot meet the costs of proceedings without impairing the necessary livelihood. It may exempt you from fees and procedural costs and assign a lawyer as Verfahrenshelfer, and is applied for with the court or authority. Parties granted it are temporarily exempt from court fees under article 16 GGG. Court interns also give free telephone advice in simple cases.

The EEA dimension and the EFTA Court

Liechtenstein is an EEA member bound by EEA internal-market law, and the EFTA Court in Luxembourg has jurisdiction in EEA-law matters involving Liechtenstein. The Oberster Gerichtshof has confirmed that national rules binding courts to rulings of a higher instance cannot prevent a court from using its power to request an advisory opinion from the EFTA Court.

Common problems

Where insolvency files usually go wrong

Most difficulties in cross-border debt and insolvency matters are procedural rather than substantive.

01

The clock ran out

Liechtenstein applies several different limitation periods, from three years for known damages to thirty years for enforceable instruments. A claim can be perfectly valid and still fail because the wrong period was assumed.

02

The wrong forum

Enforcement and insolvency-related disputes begin before the Fürstliches Landgericht in Vaduz, while appeals move to the Obergericht and then the Oberster Gerichtshof. Filing in the wrong place costs time you rarely have.

03

Costs that were never budgeted

Court fees are calculated from the value in dispute in Swiss francs, and lawyers charge according to the statutory tariff. Without an early estimate, a modest dispute can become disproportionately expensive.

How we help

Matched with a Liechtenstein insolvency lawyer

We do not advise you ourselves. We identify the right lawyer for your file and put you in contact.

Practising Liechtenstein lawyers

We match you only with lawyers entered in the Rechtsanwaltsliste kept by the Liechtensteinische Rechtsanwaltskammer, or with EEA-qualified lawyers providing services under free movement rules where that fits your matter.

Insolvency and debt-recovery focus

Your request goes to lawyers whose practice covers creditor claims, enforcement before the Exekutionsabteilung, restructuring and related commercial disputes, rather than to generalists.

Cross-border capability

Because Liechtenstein sits inside the EEA, files often involve parties elsewhere in Europe. We look for lawyers used to EEA internal-market questions and the EFTA Court framework.

Clear on costs before you start

You receive information on how court fees and the statutory lawyers’ tariff work in Liechtenstein, and whether Verfahrenshilfe may be available in your circumstances, before you commit.

Questions

Insolvency and debt recovery in Liechtenstein: FAQ

Do I need insolvency lawyers in Liechtenstein to bring or defend a claim?

Not always. The Zivilprozessordnung establishes no general obligation to be represented by a lawyer, and section 33(1) expressly allows a party to grant a power of attorney to a person who is not a lawyer. Sections 28 to 31 govern powers of attorney and representation. For specific high-value or higher-instance matters, representation rules should be checked case by case.

Which court deals with enforcement and insolvency-related disputes in Liechtenstein?

Ordinary jurisdiction runs through three instances: the Fürstliches Landgericht in Vaduz as first instance, which includes an Exekutionsabteilung for enforcement; the Obergericht as second instance, sitting in three senates; and the Oberster Gerichtshof as third instance. The Oberster Gerichtshof also acts as the Verwaltungsgerichtshof, while the Staatsgerichtshof is a separate constitutional court.

How long do I have to pursue a debt in Liechtenstein?

The general limitation period for civil claims is ten years, shortened from thirty by the 2026 reform. Typical commercial and professional claims are subject to a five-year period, and damages claims where the damage and wrongdoer are known expire after three years from knowledge. Claims established by final judgment, enforceable settlements or enforceable instruments remain subject to thirty years.

What will court proceedings cost in Liechtenstein?

Court fees follow the Gerichtsgebührengesetz. The assessment base is normally the value in dispute, amounts are rounded up to the next franc, and foreign-currency amounts are converted into Swiss francs at the SIX AG reference rate. Lawyers charge according to the statutory Rechtsanwaltstarif, which is based on the value in dispute and lists separate tariff items for individual services.

Can I get legal aid for an insolvency dispute in Liechtenstein?

Verfahrenshilfe under section 63 ZPO is available to a party who cannot meet the costs of proceedings without impairing the necessary livelihood. It can consist of exemption from fees and procedural costs and the assignment of a lawyer as Verfahrenshelfer, and is applied for with the court or administrative authority. Parties granted it are temporarily exempt from court fees under article 16 GGG.

Does EEA membership affect a cross-border insolvency matter in Liechtenstein?

It can. Liechtenstein is an EEA member bound by EEA internal-market law, and the EFTA Court in Luxembourg has jurisdiction in EEA-law matters involving Liechtenstein. The Oberster Gerichtshof has confirmed that national rules binding courts to rulings of a higher instance cannot prevent a court from requesting an advisory opinion from the EFTA Court.
