Lithuania at a glance

How divorce works in Lithuania

Lithuanian law offers both court-based and notarial divorce, with specific rules on property, children and procedure. Below are the key points you should understand before engaging a divorce lawyer.

Legal framework

Divorce is governed by the Civil Code of Lithuania. Most civil cases, including divorce, are heard at first instance by district courts. Court proceedings are conducted in Lithuanian; if you are not fluent, you may need an interpreter or a lawyer who can communicate in your language.

Notarial divorce since 2023

Since 1 January 2023, spouses can dissolve their marriage by mutual consent before a notary, without court involvement, if: the marriage has lasted more than one year; both spouses have concluded an agreement on the consequences of the divorce; both have full legal capacity; they have not lived a married life for more than one year; and they have no common minor children.

Property division

The default matrimonial property regime is joint community property: assets acquired by either spouse during the marriage for a consideration become joint property, unless they were owned before marriage or received by gift or inheritance. On divorce, the joint property is divided, with equal shares as the starting point, unless a marriage contract provides otherwise.

Role of a divorce lawyer

You are not legally required to have an advocate for a divorce at first instance, but a lawyer can assist with drafting the agreement on consequences, negotiating property division, and representing you in contested proceedings. For any appeal to the Supreme Court in cassation, representation by an advocate is mandatory.

Court fees and legal aid

Divorce proceedings are subject to court stamp duty, which for non-pecuniary cases is a fixed lump sum. Advocates’ fees are freely agreed between you and your lawyer. If your income and property are below statutory thresholds, you may qualify for state-guaranteed secondary legal aid, covering part or all of the costs.

Lawyer qualifications

To practise as an advocate in Lithuania, a person must be enrolled on the register kept by the Lithuanian Bar Association, hold a law degree, pass the advocate’s qualification examination, and be of impeccable reputation. Lawyers qualified in other EU Member States may also provide services under EU rules.

Key time limit — Family Law

Divorce (minimum marriage duration, mutual consent) — More than 1 year from celebration of the marriage. Marriage must have lasted more than one year for a mutual-consent divorce, including notarial divorce.

The information on this page is based on official Lithuanian legal sources and European e-Justice data, verified as of 2025.

Common challenges

Pain points in Lithuanian divorce

Divorce can be stressful. Here are the issues our lawyers help you overcome.

01

Property division disputes

The default community property regime can lead to disagreements over which assets are joint and which are personal. A lawyer can help you trace ownership and negotiate a fair settlement under the Civil Code.

02

Child custody and support

Decisions about children’s residence and maintenance are often the most emotionally charged part of a divorce. An advocate can help you understand the legal criteria and present your case effectively.

03

Language and procedural hurdles

All court proceedings are in Lithuanian, and unfamiliarity with local procedures can put you at a disadvantage. A bilingual divorce lawyer can guide you and ensure your documents are correctly filed.

FAQs

Frequently asked questions

Do I need a lawyer to get divorced in Lithuania?

No, you are not legally required to have an advocate for a divorce at first instance. However, a divorce lawyer can help you draft agreements, negotiate property division and represent you if the case is contested. For a cassation appeal, representation by an advocate is mandatory.

What is the minimum marriage duration for a mutual-consent divorce in Lithuania?

The marriage must have lasted more than one year from its celebration. This applies to both court divorces based on mutual consent and the newer notarial divorce procedure introduced on 1 January 2023.

Can I get divorced at a notary in Lithuania?

Yes, since 2023 spouses can divorce by mutual consent before a notary if they have no common minor children, both have full legal capacity, have concluded an agreement on consequences, and have not lived a married life for more than one year.

How is property divided in a Lithuanian divorce?

The default regime is joint community property: assets acquired during the marriage for consideration are joint, while pre-marital assets, gifts and inheritances remain personal. On divorce, joint property is divided, with equal shares as the starting point, unless a marriage contract states otherwise.

What are the court fees for a divorce in Lithuania?

A court stamp duty applies. For non-pecuniary cases like divorce, it is a fixed lump sum. The exact amount is set by legislation; if you qualify financially, you may receive state-guaranteed legal aid covering up to 100% of costs.

Can a lawyer from another EU country represent me in Lithuania?

Lawyers qualified in other EU Member States may provide services in Lithuania under the rules for temporary or permanent establishment set out in the Law on the Bar. They must comply with Lithuanian procedural requirements and, for court representation, may need to work with a local advocate.
