Where to start

How employment discrimination disputes are handled in Lithuania

Discrimination at work can leave you unsure whether your treatment is unlawful and what to do next. This page explains how employment disputes actually move through the Lithuanian system, and how our matching service connects you with a workplace discrimination lawyer in Lithuania who deals with unequal treatment, harassment, pay differences and dismissal after a complaint. You describe your situation in a short form; we pass it to a specialised advocate whose practice covers Lithuanian labour law, including the mandatory pre-trial Labour Dispute Commissions. The match costs you nothing, there is no obligation to instruct anyone, and the conversation is confidential. If your income and property are limited, your advocate can also advise you on state-guaranteed legal aid.

Country context

Lithuania: labour disputes, courts and costs

Lithuania is a continental civil-law jurisdiction where statutes, not judicial precedent, are the primary source of law, although the uniform case law of the Supreme Court guides interpretation. The Labour Code of 2016 has been in force since 1 July 2017 and governs individual employment disputes.

A Labour Dispute Commission comes first

Individual labour disputes must be brought before a Labour Dispute Commission (Darbo ginčų komisija), which operates under the territorial divisions of the State Labour Inspectorate, before you can go to court. Since 1 July 2017 these commissions also decide disputes about dismissal, removal from work and non-pecuniary damage. The commission must resolve the dispute within one month of receiving the application, extendable by a further month in individual cases.

Deadlines shape the whole strategy

An employment dismissal claim must be brought within one month, while general labour claims carry a three-year limitation period. Deciding which period governs your discrimination complaint is one of the first questions a Lithuanian advocate will assess, because a missed deadline can end the case before the merits are examined.

Who may represent you

The title of advocate (advokatas) is reserved to persons on the register kept by the Lithuanian Bar Association (Lietuvos advokatūra). An advocate must be a Lithuanian or EU citizen, hold a Master’s degree in law, be of impeccable reputation, command Lithuanian, pass the qualification examination and take the advocate’s oath, usually after practice as an advocate’s assistant.

Where the case is heard

Civil claims start in the twelve district courts (apylinkių teismai), which hear most civil cases at first instance. Appeals go to the five regional courts and then to the Court of Appeal of Lithuania; the Supreme Court of Lithuania is the sole court of cassation and forms uniform case law. Administrative matters follow a separate court system.

What it costs and who pays

Advocates’ fees are freely agreed between advocate and client, as there are no binding official tariffs; non-binding Ministry of Justice recommendations set maximum reimbursable amounts. Court proceedings attract a stamp duty (žyminis mokestis), but employees are among the categories exempt from it. As a rule the losing party bears the successful party’s litigation costs.

State-guaranteed legal aid

Lithuania runs a two-tier legal aid system. Primary legal aid — information, consultation and help drafting simple documents — is free for everyone through the municipalities. Secondary legal aid, covering procedural documents, representation in court and litigation costs, is provided by advocates through the State-Guaranteed Legal Aid Service to applicants below statutory income and property thresholds, with the state covering 100% or 50%.

Key time limits — Employment Law

Matter Time limit Practical note
Employment dismissal claim 1 month Dismissal disputes must be brought promptly, starting with the Labour Dispute Commission.
General labour claims 3 years Covers labour claims that are not dismissal disputes.

Country information on this page is drawn from official Lithuanian sources — the Lithuanian courts portal, the Lithuanian Bar Association framework, the State Labour Inspectorate, the State Tax Inspectorate and the e-Justice portal — consulted in 2025.

Common situations

What people bring to us

Discrimination at work rarely arrives as a single clear event. These are the situations clients most often describe when they ask for a Lithuanian advocate.

01

Treatment that changed after a complaint

You raised a concern internally, and shortly afterwards your duties, shifts or evaluation changed. Linking that change to your complaint is a question of evidence and timing that an advocate can assess.

02

Pay and promotion differences

You suspect colleagues in comparable roles earn more or are promoted faster. In Lithuania the first step is usually the Labour Dispute Commission, where representation by a lawyer is optional but useful.

03

Dismissal with a short deadline

Dismissal claims must be brought within one month. Many people only discover this after the period has run, so early advice matters more than a perfect case file.

Why use the service

How our matching works

We are not a law firm and we do not give legal advice. We connect you with an advocate who practises in the area you describe.

Specialisation, not a general list

We match on your actual problem — discrimination, harassment, unequal pay or dismissal — so you speak to an advocate whose practice already covers Lithuanian labour disputes rather than a generalist.

Free and without obligation

Submitting your situation costs nothing and does not instruct anyone. You decide whether to proceed after the first conversation with the advocate we introduce.

One clear point of contact

You complete one short form instead of contacting several offices. We pass your details to a single matched advocate, who then contacts you directly to discuss the next steps.

Coverage across Lithuania

Whether you work in Vilnius, Kaunas, Klaipėda, Šiauliai, Panevėžys or a smaller town, we look for an advocate who can handle your case and the relevant Labour Dispute Commission.

Questions

Workplace discrimination in Lithuania: frequently asked questions

How do I find a workplace discrimination lawyer in Lithuania?

Describe your situation in our short form and we match you with a workplace discrimination lawyer in Lithuania whose practice covers employment disputes. The match is free and you are not obliged to instruct the advocate we introduce. You then speak directly with that advocate about your case and the next steps.

Do I have to go to a Labour Dispute Commission before court?

Yes. Individual labour disputes in Lithuania must first be brought before a Labour Dispute Commission, which operates under the territorial divisions of the State Labour Inspectorate, before recourse to the courts. Since 1 July 2017 the commissions also decide disputes concerning dismissal, removal from work and non-pecuniary damage. Representation by a lawyer at that stage is optional.

How long do I have to bring a claim?

An employment dismissal claim must be brought within one month, while general labour claims carry a three-year limitation period. Because the applicable period depends on how the dispute is characterised, it is worth having your situation reviewed early rather than counting the days yourself.

Can an advocate from another EU country represent me in Lithuania?

Lawyers qualified in another EU Member State may provide services in Lithuania under the rules for temporary or permanent establishment set out in the Law on the Bar. The title of advocate remains reserved to persons on the register kept by the Lithuanian Bar Association, and command of the Lithuanian language is a requirement.

How much does an advocate cost, and who pays?

Advocates’ fees are freely agreed with the client, as there are no binding official tariffs, though non-binding recommendations set maximum reimbursable amounts. Employees are exempt from the stamp duty in civil proceedings. As a rule the losing party bears the successful party’s costs, so costs follow the outcome.

Is free legal aid available in Lithuania?

Yes. Primary legal aid — information, consultation and help with simple documents — is free for everyone through the municipalities. Secondary legal aid, which covers procedural documents, representation in court and litigation costs, is provided by advocates through the State-Guaranteed Legal Aid Service, with the state covering 100% or 50% depending on income and property.
