The starting point

What an arbitration lawyer in Moldova actually does for you

An arbitration lawyer in Moldova works on disputes that the parties have chosen to take out of the ordinary courts and place before an arbitral tribunal, and on the court business that can grow around that choice. The work usually begins with the contract: the clause itself, its scope, and whether your dispute genuinely falls inside it. From there your advocate builds the file, drafts submissions, assembles evidence and manages hearings and correspondence within a Romanian-language procedural framework. Because legal assistance in Moldova is normally given under a contract with an advocate registered by the Union of Lawyers, you know who is responsible for your file and how the fee is calculated before the work begins. This page is general information, not legal advice. We do not argue your case: we match you with a lawyer who handles this kind of work.

The local picture

How arbitration work sits inside the Moldovan legal system

Moldova is a unitary state with a continental-style legal order and codified private law. Even where a dispute goes to arbitration, the surrounding environment — who may represent you, in which language, at what cost, and before which courts if the matter returns to court — is set by Moldovan law. The points below are drawn from verified official sources.

Who may act as your advocate

Legal assistance in Moldova may only be provided by advocates entered in the register of the Union of Lawyers of the Republic of Moldova (Uniunea Avocaților), holding a licence under Law No. 1260/2002 and bound by the Statute of the profession. Advocates may practise individually, through a law office, a jointly owned bureau or a partnership. Representation is normally provided under a legal-assistance contract.

Your mandate and how the fee is set

Advocates act under a legal-assistance contract concluded with you. Fees are not fixed by the State: they are freely agreed between advocate and client, reflecting the independence of the profession. Where costs are later recovered in court, the Code of Civil Procedure requires them to be necessary and reasonable and allows the court to reduce manifestly excessive claims.

The language your file will be handled in

Romanian is the state language and procedural acts are drafted in Romanian. A person who does not speak it is entitled to acquaint themselves with the file and to speak through an interpreter free of charge in court proceedings. Legislation is published in the Monitorul Oficial and consolidated on Legis.md, so the text your lawyer cites can always be checked.

The courts, if the dispute returns to them

Judicial power is exercised by first-instance courts (judecătorii), courts of appeal (curți de apel) and the Supreme Court of Justice. Ordinary remedies are two-tier — appeal (apel) and recourse (recurs) — with no third ordinary instance. The official courts portal currently lists three courts of appeal: Centru, Nord and Sud. Judgments do not become final until the ordinary remedies are exhausted.

Costs on the court track

Judicial fees are governed by Law No. 213/2023 on the state tax, in force since 1 January 2024, with the rates set out in Annex No. 1 to that law. A separate stamp tax (taxa de timbru) of 200 lei applies, and a recourse application costs 70% of the first-instance state tax. Payments are made through the government MPay service and receipts are filed with the court.

Filing documents electronically

Claims, appeals, recourse applications and other procedural documents may be filed with the courts through the Integrated Case Management Programme (e-Dosar / PIGD). Electronic filing coexists with paper filing and requires an authenticated electronic identity — a practical point when a court application has to be lodged alongside an arbitration.

Key time limits — Litigation & Dispute Resolution

Matter Time limit What it covers
Civil — general extinctive prescription 3 years The general limitation period for bringing a civil claim, set by the Civil Code.
Civil — appeal (apel) against a first-instance judgment 30 days The period within which a first-instance judgment may be challenged by appeal.
Civil — recourse (recurs) before the Supreme Court of Justice 2 months Available against an appeal judgment, or against a first-instance judgment of a court of appeal.
Civil — reasoned judgment after an appeal is lodged 45 working days The period within which the court must produce the reasoned text of its decision.

All country details on this page come from official Moldovan sources — the state legal register Legis.md, the Union of Lawyers and the national courts portal — verified at the time of writing; they are general information, not legal advice.

Where files get stuck

Three situations clients bring to us most often

None of these are unusual. Each one is easier to handle when the right advocate sees the papers early.

01

The clause does not say what you thought

Two versions of the contract, a translation that does not match the original, and a counterparty insisting the dispute belongs in court. The first question is what the clause actually covers.

02

You are managing this from abroad

You run the business from outside Moldova and cannot sit through hearings in Chișinău. You need someone who holds the file, reports in your language and appears when required.

03

The budget is a blank page

Tribunal time, translations, experts, travel and correspondence add up quickly. Without a written fee agreement you cannot see the shape of the cost before the case begins.

What you get

How our matching works for your arbitration file

We are not a law firm and we do not advise you. We connect you with an advocate who does this work for a living.

Registered advocates only

In Moldova legal assistance is provided by advocates entered in the register of the Union of Lawyers, holding a licence and subject to the Statute of the profession. We match within that group.

Fees agreed before work starts

Moldovan advocates agree their fee with you in the legal-assistance contract; the State does not fix the amount. That means you can compare scope and price before committing.

A Romanian file, explained to you

Procedural acts are drafted in Romanian, and interpretation is free in court proceedings where the rules provide for it. Your advocate reports to you in the language you work in.

One named point of contact

You deal with the advocate who signs your submissions, not an anonymous desk. You know who is responsible for the file and how to reach them.

Questions we hear

Arbitration in Moldova: practical questions

How do I find an arbitration lawyer in Moldova?

Start by describing the dispute and the clause in writing. We then match you with an advocate registered with the Union of Lawyers of Moldova who handles comparable files. You speak to that advocate directly, agree the scope and the fee in a legal-assistance contract, and decide whether to proceed.

Can any lawyer represent me in Moldova?

No. Legal assistance in Moldova may only be provided by advocates entered in the register of the Union of Lawyers of the Republic of Moldova, holding a licence granted under Law No. 1260/2002 and subject to the Statute of the profession. The law allows only narrow exceptions, for example close relatives acting as representatives.

What language will the file be handled in?

Romanian is the state language and procedural acts are drafted in it. A person who does not speak Romanian is entitled to acquaint themselves with the file and to speak through an interpreter free of charge in court proceedings. Ask your advocate how that applies to your particular hearings and documents.

How are an advocate’s fees set in Moldova?

Fees are not fixed by the State. They are freely agreed between the advocate and the client in the legal-assistance contract, which reflects the independence of the profession. Where costs are later recovered from the other side in court, the Code of Civil Procedure requires them to be necessary and reasonable and allows manifestly excessive claims to be reduced.

If the dispute ends up in the Moldovan courts, what deadlines apply?

A first-instance civil judgment can be challenged by appeal within 30 days, and recourse before the Supreme Court of Justice within 2 months. For an administrative act, the preliminary request must be lodged within 30 days. Your advocate will confirm which period applies to your own file before anything is filed.

Can state-guaranteed legal aid help with my case?

Primary legal aid — information, advice and help drafting documents — is available to everyone irrespective of income. Qualified legal aid, meaning representation by an advocate before the courts, is granted on a means test and in the cases listed by law. The scheme is run by the National Council for State-Guaranteed Legal Aid and its territorial offices, which can confirm whether your situation qualifies.

Next step

Send us the clause and a short summary of the dispute

Two paragraphs are usually enough for us to identify the right advocate: what the contract says about resolving disputes, and what has happened since. We come back with a match, not a bill.
