Why this page

Injury claims in the Netherlands, without the guesswork

If you have been injured in the Netherlands — in a road accident, at work, in a shop or through a defective product — you may be entitled to compensation for damage that was not your fault. Dutch liability claims follow the Burgerlijk Wetboek (Civil Code) and are heard by professional judges in the rechtbanken, with no jury involved. Finding the right representative matters, because the way a claim is framed and evidenced in writing shapes the whole procedure. We are not a law firm: we are a free matching service. Tell us what happened and we introduce you to a personal injury lawyer in Netherlands whose practice covers your type of loss, so you can discuss your options with someone who handles these cases every day.

Netherlands in practice

How injury and liability claims work in the Netherlands

Personal injury and liability claims in the Netherlands run through a codified civil-law system with clear rules on where a case is heard, who may represent you and what the procedure costs. The sections below set out that framework as it applies in this country.

Where injury claims are heard

Civil claims are decided by the eleven district courts (rechtbanken). The subdistrict sector, the kantonrechter, handles claims up to EUR 25,000 as well as all employment and tenancy matters. Above EUR 25,000, before the civil chamber, and in every appeal, representation by an advocaat is compulsory, so the value of the claim determines how the procedure is conducted.

Who is entitled to act as your advocaat

The title ‘advocaat’ is protected by the Advocatenwet. Only lawyers entered on the tableau, the official register kept by the Nederlandse Orde van Advocaten, may practise. Qualification requires a Dutch law degree (meester in de rechten), a three-year traineeship as an advocaat-stagiair and the oath before the court. Every registered advocaat is subject to the NOvA’s disciplinary supervision.

Court fees you may have to pay

In civil cases both the party starting the claim and the party defending it pay a griffierecht. For natural persons the 2026 rates are EUR 341 for cases of undetermined value, EUR 1,414 for claims up to EUR 100,000 and EUR 2,803 above that. Indigent parties pay a reduced EUR 93, and no VAT is charged on griffierecht.

How lawyers’ fees are set

Advocates’ fees are freely agreed between client and advocate; there is no statutory hourly-rate scale binding on Dutch lawyers. If you win, the losing party is usually ordered to contribute towards your costs, but that contribution follows the standardised liquidatietarief published by the judiciary rather than the fees you actually paid. A clear written fee arrangement at the outset is standard practice.

Subsidised legal aid: the toevoeging

Where income and assets fall below statutory thresholds, an advocaat or mediator can apply to the Raad voor Rechtsbijstand for a toevoeging under the Wet op de rechtsbijstand. The State then pays part of the costs, while the client pays a means-tested own contribution (eigen bijdrage) that depends on income and assets. This makes representation accessible for low- and middle-income parties.

Why written argument carries weight

The Netherlands has no juries: all cases are decided by professional judges. The Hoge Raad, the supreme court seated in The Hague, reviews only questions of law and never re-examines the facts, so its role is to ensure legal uniformity rather than to correct individual outcomes. Written submissions and precise legal argumentation therefore sit at the centre of Dutch litigation.

Key time limit — Consumer & Compensation Law

Consumer purchase of defective goods (non-conformity) — 2 years. Applies where a consumer claims that purchased goods do not conform.

Common problems

What makes an injury claim in the Netherlands feel stuck

Most people who contact us describe the same three obstacles before they have even spoken to a lawyer.

01

You cannot tell which lawyers handle injury claims

Search results mix family, criminal and corporate advocaten. Injury and liability work is a distinct specialism, and the professional you choose should have a demonstrable track record in damages claims under Dutch law.

02

The procedure is unfamiliar and conducted in Dutch

Dutch courts work in Dutch, and the Civil Code is codified in a language many injured expatriates and visitors do not read. Court documents, expert reports and settlement offers all arrive in Dutch, and missing a step can be costly.

03

Worry about cost stops people from asking

Advocates’ fees are freely negotiated and court fees are payable by both sides, which makes people hesitate. Subsidised legal aid and a free matching conversation can show you where you stand before you commit to anything.

How we help

A free route to the right Dutch advocaat

We do not practise law. We compare what you describe with the work Dutch lawyers actually do, and introduce you to the ones who fit.

Verified Dutch advocaten

Every lawyer we propose is registered with the Nederlandse Orde van Advocaten, the bar association that keeps the official tableau and exercises disciplinary supervision over its members.

Practices that handle damages claims

We match you with practices working on liability and injury cases, so your questions about causation, evidence and the extent of your loss are answered by someone who deals with them routinely.

Free and without obligation

Describing your situation costs nothing and commits you to nothing. You decide whether to instruct the lawyer we introduce, and any fee arrangement is negotiated directly with that lawyer.

Clarity on fees and legal aid

A first conversation can cover fee structures, the griffierecht payable in your case and whether a toevoeging from the Raad voor Rechtsbijstand could reduce what you pay.

FAQ

Questions about injury claims in the Netherlands

How do I find a personal injury lawyer in Netherlands who fits my case?

Describe your accident, the damage you suffered and where in the country it happened. Our matching service compares that with the practices of Dutch advocaten and proposes one whose work covers liability and damages claims. The service is free and confidential, and you remain free to decide whether to instruct them.

Do I need a lawyer if my Dutch claim is worth less than EUR 25,000?

No. Before the kantonrechter, which hears claims up to EUR 25,000 and all employment and tenancy matters, parties may litigate without an advocaat. Above EUR 25,000, before the civil chamber of the rechtbank, and in all appeals and cassation, representation by an advocaat is compulsory.

How long do I have to bring a damages claim in the Netherlands?

Claims based on an unlawful act (onrechtmatige daad) are subject to a five-year limitation period, and contractual claims to give or to do something also run for five years. A residual period of twenty years applies where the Civil Code sets no specific term. Because periods can lapse, it is worth asking an advocaat early.

Can I get subsidised legal aid for an injury claim in the Netherlands?

Possibly. Under the Wet op de rechtsbijstand, an advocaat or mediator can apply to the Raad voor Rechtsbijstand for a toevoeging where income and assets fall below statutory thresholds. The State then pays part of the costs, while the client pays a means-tested own contribution (eigen bijdrage).

What court fees apply to a civil injury claim in the Netherlands?

Both the claimant and the defending party pay a griffierecht. For natural persons the 2026 rates are EUR 341 for cases of undetermined value, EUR 1,414 for claims up to EUR 100,000 and EUR 2,803 above that, with a reduced EUR 93 rate for indigent parties. No VAT is charged.

What happens if my Dutch case goes to appeal or to the Hoge Raad?

Appeals are heard by one of the four courts of appeal (gerechtshoven), and representation by an advocaat is mandatory at that stage. The Hoge Raad in The Hague reviews questions of law only and never re-examines the facts, and only specialised cassation advocates may act before it.
