How we help

Product liability claims in the Netherlands: what to expect

If a defective product has injured you, damaged your property or caused financial loss in the Netherlands, the claim is dealt with as a civil-law matter under the Burgerlijk Wetboek and heard by the ordinary civil courts. Where the amount in dispute is above EUR 25,000 — the usual situation in a serious product case — representation by an advocaat is compulsory, so the choice of lawyer matters. A product liability lawyer in Netherlands will assess what the evidence shows, identify the correct defendant in the distribution chain and set out your position in written submissions, which carry real weight in Dutch litigation. Fees are agreed freely between you and the advocate, court fees (griffierecht) are payable by both sides, and subsidised legal aid may be available. Tell us about your case and we match you with a suitable lawyer.

Netherlands in practice

How product liability claims work in the Dutch legal system

Product liability disputes in the Netherlands are civil-law matters and follow the ordinary Dutch court structure. The notes below set out the framework that shapes a claim of this kind: who may act for you, when an advocaat is compulsory, what court fees and lawyer’s fees look like, and which time limits you need to keep in view.

Civil-law claims decided by professional judges

The Netherlands follows the continental civil-law model, and private law is codified in the Burgerlijk Wetboek, in force since 1992. Claims about defective products are therefore argued on the basis of written law before the ordinary civil courts. There is no jury: first-instance civil cases are heard by professional judges sitting in one of the eleven district courts (rechtbanken).

When an advocaat is compulsory

Whether you must instruct an advocaat depends on the amount and the court. Before the kantonrechter, which handles claims up to EUR 25,000 as well as all employment and tenancy matters, you may conduct your own case. For claims above EUR 25,000 before the civil chamber of the rechtbank, and in every appeal or cassation, representation by an advocaat is compulsory.

Who may practise as your lawyer

Only a person registered on the tableau — the official register of advocates — may practise as an advocaat, and the professional title is protected by Articles 2 and 3 of the Advocatenwet. Qualification requires a Dutch law degree (meester in de rechten), a three-year traineeship as advocaat-stagiair and the oath before the court. Every advocate belongs to the NOvA and a local orde and is subject to disciplinary supervision.

Court fees you should budget for

Court fees (griffierecht) are payable by both the party who starts a civil case and the party who defends it. For natural persons the 2026 rates are EUR 341 where the value is undetermined, EUR 1,414 for claims up to EUR 100,000 and EUR 2,803 above that. Companies pay higher bands, indigent parties EUR 93, and no VAT is charged on griffierecht.

Fees, cost recovery and legal aid

Advocates’ fees are freely agreed between client and lawyer; there is no binding statutory tariff. If you win, the losing party is normally ordered to contribute towards your costs, but on the standardised liquidatietarief scale rather than on the fees actually charged. Lower-income clients may qualify for subsidised legal aid: the advocate applies to the Raad voor Rechtsbijstand for a toevoeging, and the client pays a means-tested own contribution.

Appeal and cassation routes

Appeals (hoger beroep) go to one of the four courts of appeal (gerechtshoven). The Hoge Raad der Nederlanden, seated in The Hague, is a cassation court: it reviews questions of law only and never re-examines the facts, and only specialised cassation advocates may act there. Because there is no jury and no fresh factual hearing at the top, written submissions and legal argumentation carry real weight throughout Dutch litigation.

Key time limit — Consumer & Compensation Law

Consumer purchase of non-conforming goods (defective goods) — 2 years. Applies to a consumer’s claim that the goods bought were not in conformity with the contract.

Common concerns

What makes a product claim in the Netherlands difficult

Three practical problems clients raise before they decide whether to instruct anyone.

01

You do not know who to sue

A defective product may have passed through a manufacturer, an importer, a wholesaler and a retailer before reaching you. Establishing which party can be held liable, and on what basis, is exactly the work a specialist lawyer does at the start of a case.

02

The clock is already running

Dutch law sets limitation periods for damages claims, consumer non-conformity and contractual claims, and they are not generous. Once a period expires your claim can be barred, so early advice on the dates that apply to your situation matters.

03

Costs and compulsory representation

Above EUR 25,000 before the civil chamber of the rechtbank, and in all appeals, an advocaat is compulsory. Court fees are payable by both sides, and a losing party usually contributes only a standardised amount towards the winner’s costs.

Why use our matching

How we help you find the right Dutch advocaat

One short request, and we look for a lawyer whose practice covers your type of case.

Lawyers who actually handle product claims

We work with advocates who take on defective-product and consumer-safety matters, so the lawyer you speak to already knows how Dutch civil procedure and evidence work in this type of case.

Matched on your facts, not on advertising

Tell us what the product was, what happened and what loss you suffered. We use those details to identify a lawyer whose practice fits your situation, rather than sending your case out at random.

Clear about costs from the start

Advocates’ fees in the Netherlands are freely agreed, court fees are set annually and subsidised legal aid may be available. Your lawyer explains the likely costs and the toevoeging route before you commit to anything.

Free, no obligation, no legal advice

Matching is free and you decide whether to instruct anyone. We do not give legal advice ourselves; the assessment of your claim comes from the qualified advocaat you are matched with.

Frequently asked questions

Product liability claims in the Netherlands: your questions

Do I need a product liability lawyer in Netherlands, or can I handle the claim myself?

It depends on the amount and the court. Before the kantonrechter, which deals with claims up to EUR 25,000, you may conduct your own case. For claims above EUR 25,000 before the civil chamber of the rechtbank, and in all appeals and cassation proceedings, representation by an advocaat is compulsory.

How long do I have to bring a claim in the Netherlands?

Dutch law applies different periods. Damages claims in tort and contractual claims are subject to five years, a consumer’s claim that purchased goods were defective can be subject to two years, and a residual period of twenty years applies where no shorter rule fits. An advocate will confirm which period applies to your facts.

What does a civil case cost in the Netherlands?

Both sides pay court fees (griffierecht). For natural persons in 2026 that is EUR 341 where the value is undetermined, EUR 1,414 for claims up to EUR 100,000 and EUR 2,803 above that; companies pay higher bands. Advocates’ fees are freely agreed, and a winning party normally recovers only a standardised contribution.

Can I get financial help with legal costs?

Possibly. Under the Wet op de rechtsbijstand, people whose income and assets fall below statutory thresholds can obtain subsidised legal aid. Your advocate or mediator applies to the Raad voor Rechtsbijstand for a toevoeging, and you pay a means-tested own contribution. Your lawyer can tell you whether you are likely to qualify.

Which court will hear my Dutch product liability case?

First-instance civil cases are heard by one of the eleven district courts (rechtbanken). Within each rechtbank the kanton sector handles claims up to EUR 25,000 through the kantonrechter, while larger claims go to the civil chamber. Appeals go to one of the four courts of appeal, and the Hoge Raad reviews points of law only.

How does your matching service work?

You describe the product, the damage and any correspondence you already have. We look for an advocaat in the Netherlands whose practice covers claims of this kind and put you in contact. Matching is free, there is no obligation to instruct, and any fee arrangement is agreed directly with the lawyer.
