A Dutch tax problem needs a lawyer who knows Dutch procedure

If you have received a tax assessment you disagree with, or you are worried about how the Dutch authorities have treated your income, the practical question is which specialist can really help you. Dutch tax matters sit inside a continental legal order in which public law is set out in the Constitution and specific statutes, and disputes with government bodies are decided by professional judges rather than juries. An income tax lawyer in Netherlands can read the decision with you, identify the grounds of challenge that are genuinely arguable and represent you through the administrative courts. Our role is simpler: you describe the situation once, and we match you with a lawyer whose practice covers Dutch tax and administrative law.

Netherlands in practice

How tax and legal disputes work in the Netherlands

The Netherlands follows the continental civil law model, with private law codified in the Burgerlijk Wetboek and judicial organisation governed by the Wet op de rechterlijke organisatie. Tax matters are disputes with a government body, so they are resolved through the administrative courts rather than by a jury.

Where a Dutch tax dispute is heard

Administrative appeals against government decisions are decided first by the eleven district courts (rechtbanken). On appeal in general administrative law they go to the Afdeling bestuursrechtspraak van de Raad van State; other administrative fields go to the Centrale Raad van Beroep or the College van Beroep voor het bedrijfsleven. Every case is decided by professional judges, never a jury.

Written argument decides the case

The Hoge Raad in The Hague is a cassation court: it reviews questions of law only and never re-examines the facts. Its task is to keep the law uniform rather than to correct individual outcomes. In practice this means that a clear chronology, well-drafted written submissions and precise legal reasoning matter more than courtroom performance.

Who is allowed to represent you

The title ‘advocaat’ is legally protected. Only a person entered on the tableau kept under the Advocatenwet may practise, after obtaining a Dutch law degree, completing the three-year traineeship as an advocaat-stagiair and taking the oath before the court. Every registered advocate belongs to the Nederlandse Orde van Advocaten and is subject to its disciplinary supervision.

When a lawyer is compulsory

For civil claims above EUR 25,000 before the civil chamber of the rechtbank, and in all appeals and cassation, representation by an advocaat is mandatory. Before the kantonrechter, which hears claims up to EUR 25,000 and all employment and tenancy cases, parties may conduct their own case. Larger disputes therefore need a realistic budget for legal fees.

Court fees and the cost of representation

A court fee (griffierecht) is payable by both the party starting a civil case and the party defending it. Advocates’ fees themselves are freely agreed with the client: there is no binding statutory tariff. In civil proceedings the losing party normally contributes only on the standardised liquidatietarief scale, not on the fees actually charged.

Language and documents in Dutch proceedings

Court proceedings in the Netherlands are conducted in Dutch, and the decisions you receive will be drafted in Dutch as well. Where your file involves foreign income, a foreign employer or correspondence in another language, those documents have to be explained or translated for the court, so it pays to collect the originals early.

The problem

Why Dutch tax disputes stall before they even start

Most people lose time not because their case is weak, but because they do not know which professional to instruct or what the procedure expects of them.

01

A decision you cannot fully read

A Dutch assessment arrives with a figure you did not expect and a payment date attached, written in a language and a format you are still decoding. You cannot tell whether it is a simple error or a legal position worth disputing.

02

Too many kinds of adviser

Accountants, tax advisers and advocaten all appear in the same search results, with similar promises. Dutch law reserves the protected title of advocaat for those registered on the NOvA tableau, and court procedure follows rules only they are trained in.

03

Paying for the wrong kind of help

Advocates set their own fees and no statutory tariff exists, while the losing party in civil litigation contributes only on a standardised scale. Instructing a lawyer who does not regularly handle Dutch tax matters can therefore become an expensive detour.

How we help

A matching service built around your actual dispute

We are not a law firm and we do not give legal advice. We do one thing: we connect your situation with lawyers who practise in the field it belongs to.

Matched by practice area, not by advertising

We look at the work a lawyer actually does, so your request reaches advocates who handle Dutch tax and administrative matters rather than generalists who merely mention tax on a web page.

One description, several suitable lawyers

You set out your situation once. We compare it with the practices on our panel and propose lawyers whose experience fits the kind of decision you are challenging and the sums involved.

Free for you, honest about fees

Matching costs you nothing. Any fee agreement is made directly with the lawyer you choose, and if your income and assets are modest you may qualify for subsidised legal aid through a toevoeging.

Dutch procedure explained clearly

Proceedings in the Netherlands are conducted in Dutch in front of professional judges. Our matching is explained in plain English, and we help you find a lawyer who can guide you through a Dutch-language procedure.

Questions

What clients ask before instructing a lawyer in the Netherlands

How do I find an income tax lawyer in Netherlands who handles my type of dispute?

Describe your situation in a few lines: the decision or assessment you received, the amounts involved and anything you have already sent or received. We then match you with a lawyer whose practice covers Dutch tax and administrative law. Matching is free, and you decide for yourself whether to instruct the lawyer we propose.

Am I obliged to instruct a lawyer in the Netherlands?

It depends on the type of case. In civil claims above EUR 25,000 before the civil chamber of the rechtbank, and in all appeals and cassation, representation by an advocaat is compulsory. Before the kantonrechter, which handles claims up to EUR 25,000 and all employment and tenancy cases, parties may conduct their own case.

What will a Dutch court cost me?

In civil cases both the party bringing the claim and the party defending it pay a court fee (griffierecht). For natural persons the 2026 rates are EUR 341 for cases of undetermined value, EUR 1,414 for claims up to EUR 100,000 and EUR 2,803 above that. Indigent parties pay EUR 93, and no VAT applies to the fee.

Is subsidised legal help available in the Netherlands?

Yes, if your income and assets fall below the statutory thresholds. Under the Wet op de rechtsbijstand an advocate or mediator applies to the Raad voor Rechtsbijstand for a toevoeging, and the State then pays part of the costs. You will almost always pay a means-tested own contribution (eigen bijdrage) that depends on your income and assets.

Which time limits should I watch in the Netherlands?

They differ by type of claim: contractual claims and damages generally expire after five years, consumers have two years for non-conforming goods, a dismissal must be challenged within two months, employment termination claims run for six months, and heirs have three months to accept or refuse an estate. Check the decision you received and let a lawyer confirm the period that applies to it.

What happens if the first Dutch court decides against me?

Appeals (hoger beroep) go to one of the four courts of appeal (gerechtshoven), and the Hoge Raad in The Hague reviews only questions of law, never the facts. Because cassation cannot reopen the evidence, the legal argument put on paper at first instance is what shapes the rest of the case.
