Why this matters

Turkish tax disputes reward early, precise action

If you have received a tax notice, an assessment or a penalty decision from the Turkish revenue authorities, the way you respond in the first weeks usually shapes the whole file. Turkish procedure runs on strict deadlines, every filing must be drafted in Turkish, and the courts apply a codified civil-law framework in which the Court of Cassation’s decisions guide interpretation rather than bind as precedent. An income tax lawyer in Turkey can read the decision with you, check the figures and the procedure behind it, and explain whether discussion with the administration, mediation where it applies, or an administrative action is the sensible route. We do not give legal advice ourselves. We listen to your situation and match you with a lawyer who handles Turkish tax and administrative disputes, so you can compare experience and fees before committing.

Country specifics

How tax and administrative disputes are handled in Turkey

Turkey is a civil-law jurisdiction whose private law was codified on the model of the Swiss codes in the 1920s, with judges applying statutory texts and the Court of Cassation offering unifying guidance. Proceedings are conducted in Turkish before state courts, and the practical steps that matter most for a tax matter are the notification date, the competent court and the language of the file.

The 60-day window for an annulment action

Where the dispute concerns an administrative decision, Turkish procedure provides for an annulment action (iptal davası) that must be brought within 60 days of notification under Law No. 2577. A first-instance judgment you wish to challenge goes to appeal (istinaf) within two weeks of notification under Law No. 6100. These are short periods, so the notification date on your document is the first thing a lawyer will establish.

Only Bar-registered lawyers may act for you

Membership of a local Bar Association (Baro) is compulsory to practise law in Turkey, and all Bars belong to the Union of Turkish Bar Associations (Türkiye Barolar Birliği). Under the Attorneyship Law (Law No. 1136, Article 3) admission requires Turkish citizenship, a Turkish law degree or a recognised equivalent, a two-stage one-year internship, full legal capacity and good standing; the Bar then issues the licence (ruhname).

Turkish is the only language of the courts

Under Article 3 of the 1982 Constitution, Turkish is the official language of the State, and all proceedings, filings and court documents are conducted and drafted in Turkish. Foreign-language documents must be accompanied by a certified translation, foreign public documents generally need an apostille, and a party who does not speak Turkish requires an interpreter appointed by the court.

Court fees and the minimum fee tariff

Court fees (harçlar) are governed by the Fees Law No. 492. Civil, commercial and administrative actions carry a proportional judgment-and-decision fee of 68.31 per thousand of the amount in dispute plus a fixed application fee, with one quarter of the proportional fee paid on filing; rates are adjusted annually. Lawyers’ fees are freely agreed, but the Union of Turkish Bar Associations publishes a binding annual minimum-fee tariff.

Mediation before commercial money claims

Since 1 January 2019, commercial disputes concerning monetary claims and compensation must go to mediation before litigation under Article 5A of the Commercial Code (Law No. 6102, as amended by Law No. 7155). A claim filed without first attempting mediation is dismissed on procedural grounds, which makes mediation a central early step in debt-recovery and payment disputes that sit alongside a tax file.

Personal appearance is possible, but rarely wise

Representation by a lawyer is not generally mandatory in Turkish civil, commercial or administrative first-instance proceedings, and parties may litigate in person. In practice, professional assistance by a Bar member is the norm in commercial disputes and is always advisable before the Court of Cassation and the Council of State, where the technical quality of the written submissions decides the outcome.

Common situations

Where clients usually need help first

Most tax files we see start with a document that has a date on it and very little explanation.

01

A notice you cannot fully read

The decision is in Turkish, the figures are itemised, and the reasoning is compressed into a few paragraphs. Without a translation you cannot tell what is being asserted or by when you must respond.

02

Deadlines running quietly

Annulment actions are tied to a 60-day period from notification and appeals to two weeks. Time lost at the start is rarely recoverable later, whatever the merits of the underlying position.

03

Two countries, one income stream

You may live or trade outside Turkey while the income, property or company sits inside it. That raises questions about where a decision must be contested and which documents need translation or legalisation.

How we help

A shortlist built around your file, not a directory

We do not publish legal advice, and we do not pretend every lawyer fits every matter.

You describe, we shortlist

You tell us what the document is, what has happened so far and what you want to achieve. We then identify lawyers whose practice covers Turkish tax and administrative disputes.

Bar registration is checked

Because practising law in Turkey requires membership of a local Bar and a licence (ruhname) issued on admission, we only propose lawyers who are properly registered to act before the Turkish courts.

Fees explained up front

Lawyers’ fees are freely agreed in Turkey but must respect the Union of Turkish Bar Associations’ binding minimum tariff. You discuss scope and cost directly with the lawyer before instructing anyone.

Matching costs you nothing

There is no charge to be matched and no obligation to proceed. If the lawyer’s approach or the fee arrangement does not suit you, you simply do not instruct them.

Cross-border reach

Clients reach Turkish counsel from across Europe

Tax questions rarely stop at a border. We regularly receive enquiries from clients based in these countries with interests, income or family assets in Turkey.

Questions

Frequently asked questions

How can I check that the person I am hiring may actually act in Turkey?

Practising law in Turkey requires membership of a local Bar Association, and all Bars belong to the Union of Turkish Bar Associations (Türkiye Barolar Birliği). On admission the Bar issues a licence (ruhname) and enters the lawyer in its register. Ask for the lawyer’s Bar and registration details and verify them before instructing anyone.

Do I have to attend a Turkish court in person?

Not necessarily. Representation by a lawyer is not generally mandatory in Turkish civil, commercial or administrative proceedings at first instance, and parties may litigate in person. Professional assistance by a Bar member is nonetheless the norm in commercial disputes and is always advisable before the Court of Cassation and the Council of State. Criminal cases follow separate rules.

In what language will my file be handled?

Turkish is the official language of the State, and all proceedings, filings and court documents are drafted in Turkish under the 1982 Constitution. Foreign-language documents need a certified translation and foreign public documents generally require an apostille. If you do not speak Turkish, the court appoints an interpreter.

What does an income tax lawyer in Turkey do at the start of a case?

The first task is factual and procedural: establish the notification date, identify the type of decision and confirm which period applies, including the 60-day window for an annulment action. The lawyer then reviews the figures and the reasoning, explains the options in your own language, and prepares any filing in Turkish.

How are legal fees set for a Turkish tax matter?

Lawyers’ fees are freely agreed between lawyer and client, but the Union of Turkish Bar Associations publishes a binding annual minimum-fee tariff that also determines what a losing party may be ordered to pay towards the winner’s costs. Contingency arrangements are permitted within legal limits, and the fee may not exceed a capped percentage of the amount recovered.

Does mediation apply to tax-related commercial disputes?

Mediation has been a mandatory precondition for commercial disputes concerning monetary claims and compensation since 1 January 2019 under Article 5A of the Commercial Code (Law No. 6102, as amended). A claim filed without first attempting mediation is dismissed on procedural grounds, so the sequencing of mediation and litigation should be planned early.
