Matching service
One country, several legal orders, one matching service
Tax questions in Bosnia and Herzegovina rarely have a single answer, because the country’s legal order is not a single one either. The State, the Federation of BiH and its ten cantons, the Republika Srpska and the Brčko District each have their own legislature, executive and judiciary, and the rules that apply to your file depend on where it is connected. An income tax lawyer in Bosnia and Herzegovina starts by establishing which legal order governs your matter, which court or authority is competent, and which language the proceedings will use. We are a matching service: we listen to your situation, then introduce you to a lawyer whose practice covers your type of case in the relevant entity or district. You decide whether to instruct.
Country context
How the legal framework in Bosnia and Herzegovina shapes your case
Bosnia and Herzegovina does not operate a single, uniform legal order, so the path a tax-related file takes depends on the level of government it touches. The notes below set out the structural facts that any adviser will need to establish before assessing your position.
A country of several legal orders
The Constitution of Bosnia and Herzegovina divides the territory into the State, the Federation of BiH — itself made up of ten cantons — the Republika Srpska and the self-governing Brčko District. Each level has its own legislature, executive and judiciary, so substantive rules on many matters are enacted and applied separately. Which law applies depends on where your case is connected.
Where your case is heard
There is no unified judiciary. In the Federation of BiH, Municipal Courts hear cases at first instance and Cantonal Courts on appeal, with the Supreme Court in Sarajevo at the top. In the Republika Srpska, Basic and District Courts sit at first instance and the Supreme Court is in Banja Luka. The Brčko District has its own Basic and Appellate Court, and the Court of Bosnia and Herzegovina exercises the jurisdiction State law assigns to it.
Who may practise and represent you
Admission to a bar association is compulsory in order to practise law. An attorney is entered in the directory of the regional bar association covering the seat of their office, and thereby becomes a member of the entity-level bar association; there is no direct admission to the umbrella association. Only attorneys entered in these registers may provide representation in court proceedings.
Fees, tariffs and recovery of costs
Lawyers’ fees are governed by the official tariffs adopted by the bar associations, which set minimum or guideline rates, while the parties remain free to agree a fee by written agreement with the attorney. Court fees are set by separate laws at State, entity and district level. The losing party may generally be ordered to reimburse the prevailing party’s costs, including attorney fees assessed under the applicable tariff.
Free legal aid and relief from costs
Free legal aid before State institutions and the Court of Bosnia and Herzegovina is regulated by the Law on Free Legal Aid and administered through the Office for Free Legal Aid of the Ministry of Justice. It covers legal information, advice, drafting of submissions and representation before administrative bodies and the Court, including appeal drafting. Eligibility rests on status or on a poor financial situation; entity and cantonal institutions provide aid separately.
Language and Convention rights
Proceedings and official documents may be conducted in Bosnian, Croatian or Serbian — three mutually intelligible standard varieties written in both Latin and Cyrillic script. Under Article II of the Constitution of Bosnia and Herzegovina, the European Convention on Human Rights and its Protocols apply directly and have priority over all other law, so Convention rights, including the Article 6 right to a fair trial, can be invoked before domestic courts.

Common difficulties
Why a tax file here is rarely straightforward
Most of the uncertainty clients bring to us is structural rather than technical, and it can be clarified in a single conversation.
You cannot tell which rules apply
Bosnia and Herzegovina has no single body of private law. The Federation of BiH, the Republika Srpska and the Brčko District legislate separately on many matters, so the rules behind your file depend on where it is connected.
The procedural route is unclear
First-instance jurisdiction sits with different courts depending on where you are: Municipal and Cantonal Courts in the Federation, Basic and District Courts in the Republika Srpska, and separate courts in the Brčko District.
Costs and language add pressure
Bar tariffs, court-fee laws and the language of proceedings are not identical across the country’s legal orders. Knowing in advance how fees are set and how documents will be served removes a large part of the stress.
How we help
Matched to a practice that fits your file
We do not advise you ourselves. We identify the right practice for your situation and make the introduction.
Practitioners by legal order
We match you with lawyers whose practice covers the legal order relevant to your file, whether that is the Federation of BiH, the Republika Srpska or the Brčko District.
Clarity on competence first
Before you instruct anyone, you can discuss which court or authority is competent for your matter and which substantive rules are likely to apply to it.
Costs explained up front
You hear how fees are set under the applicable bar tariff and how the losing party’s costs may be treated, so you can decide with your eyes open.
Free and non-committal
Describing your situation costs nothing and commits you to nothing. We come back with an introduction, usually within one to two working days.
Cross-border matters
We also match clients with lawyers elsewhere in Europe
Many tax files in Bosnia and Herzegovina have a cross-border element, whether through a company, property or family connection abroad. We can introduce you to practices in the following countries as well.
Questions clients ask
Income tax matters in Bosnia and Herzegovina
Can I choose which court handles my case in Bosnia and Herzegovina?
No. Competence follows the legal order to which the matter is connected. In the Federation of BiH, Municipal Courts sit at first instance with Cantonal Courts on appeal; in the Republika Srpska, Basic and District Courts, with the Supreme Court in Banja Luka at the top; the Brčko District has its own Basic and Appellate Court.
Do I need an income tax lawyer in Bosnia and Herzegovina, or can I handle it myself?
In civil and commercial proceedings a party may in principle appear in person or through a representative, but representation in contentious proceedings must normally be undertaken by an attorney admitted to a bar association, and extraordinary remedies before the supreme courts require one. For anything beyond routine correspondence, instructing an admitted attorney is the safer route.
How are lawyers’ fees regulated here?
Lawyers’ fees are governed by the official tariffs adopted by the bar associations for each entity, which set minimum or guideline rates. The parties remain free to agree a fee by written agreement with the attorney, and no binding State-wide tariff applies. Where you win, the losing party may be ordered to reimburse costs assessed under the applicable tariff.
What court fees should I expect?
Before the Court of Bosnia and Herzegovina, the fee for a statement of claim is calculated on the value in dispute: 5% on the first 1,000 KM, 4% up to 5,000 KM and 3% on the amount over 5,000 KM, capped at 10,000 KM. A lawsuit in an administrative dispute carries a fixed fee of 100 KM and a judgment 200 KM. Entity courts apply their own fee laws.
Is free legal aid available for tax-related disputes?
Free legal aid before State institutions and the Court of Bosnia and Herzegovina is regulated by the Law on Free Legal Aid and administered through the Office for Free Legal Aid of the Ministry of Justice. It covers legal information, advice, drafting of submissions and representation before administrative bodies and the Court, including appeal drafting. Eligibility rests on status or on a poor financial situation.
Which language will my proceedings be conducted in?
Bosnian, Croatian and Serbian are the official languages, and court proceedings and official documents may be conducted in any of them. All three are mutually intelligible standard varieties written in both Latin and Cyrillic script, so settling the language of your file early is a practical step worth taking.
