Why this page exists

Tax questions rarely stay tax questions for long

A filing is queried, a notice arrives, a company structure is looked at again — and suddenly you need someone who can read the whole file, understand how the Montenegrin rules apply and deal with the authorities on your behalf. That is where an income tax lawyer in Montenegro comes in. This page explains how legal representation works in the country, who is permitted to practise, what it typically costs and how our free matching service connects you with a lawyer whose work covers income tax matters. You describe your situation in a few lines; we compare it with the specialisations of lawyers enrolled with the Bar Association of Montenegro and introduce you to those who fit. You decide afterwards, with no cost and no obligation.

Montenegro in practice

How the legal side of a tax matter works in Montenegro

Montenegro is a small, codified jurisdiction where procedure matters as much as the substantive question. Before you instruct anyone, it helps to know who is entitled to act for you, what the fee rules are and which court or body is likely to see the file.

Codified law with EU alignment

Montenegro follows the continental tradition inherited from the former Yugoslavia, working from comprehensive codes rather than judicial precedent. As an EU candidate country since 2012 and a Council of Europe member, it is progressively aligning domestic legislation with the EU acquis — relevant when an income tax question overlaps with company law, accounting or cross-border trade.

Who is allowed to act for you

To practise as a lawyer (advokat) a person must hold a university degree in law, pass the state bar examination (pravosudni ispit) and be entered in the Register of Lawyers kept by the Bar Association of Montenegro. Membership of the Bar is compulsory, and the profession is exercised independently under the Code of Professional Ethics of Lawyers.

What representation costs

Lawyers’ fees are not capped by statute. They follow the official lawyer-fee tariff (Advokatska tarifa) published in the Official Gazette, or an agreement between you and the lawyer. In litigation the unsuccessful party generally bears the costs, and the Law on Free Legal Aid (2011) can provide assistance and cost exemptions to applicants of limited means.

Language of the case

The official language is Montenegrin, with Serbian, Bosnian, Albanian and Croatian in official use. Proceedings are conducted in Montenegrin, and a party who does not speak the language of the case may use their own language with an interpreter. For a foreign shareholder or an expatriate director, that makes the working language of your lawyer a practical question.

Which court may see the file

Under the Law on Courts (2015) the judiciary comprises 15 basic courts, two high courts, the Court of Appeal and the Supreme Court, alongside a specialised Commercial Court, an Administrative Court and the misdemeanour courts. The route a matter takes depends on the nature of the dispute, so the first conversation should always start from your facts.

Amounts are in euro

Montenegro uses the euro as its currency without a formal agreement with the EU, so claims, court fees and salary thresholds are denominated in euro. When you prepare a budget or gather documents for a tax-related matter, figures can be discussed directly in euro with the lawyer handling your file.

All country details above are taken from official sources — Montenegro’s official bodies, the Bar Association of Montenegro and the CEPEJ country profile — and were reviewed in 2026.

Where clients get stuck

The three situations that bring people to us

None of them is unusual, and none of them needs to be solved alone.

01

A notice you do not fully understand

Paperwork arrives in Montenegrin, with terms that do not map neatly onto the system you know from home. You need someone who can read it accurately and explain what is actually being asked of you before you reply.

02

Cross-border income and double exposure

You live or work between Montenegro and another country, and it is not clear which side has a claim on which slice of income. Sorting that out takes a lawyer who understands both the domestic rules and the documents you already hold.

03

A business structure under review

A company, a rental property or a shareholding is being looked at more closely, and the accounting file needs legal reading rather than bookkeeping. Choosing representation early usually costs less than reacting late.

What our matching gives you

A shortlist, not a directory

We do the filtering so that your first conversation is already the right one.

Screened for the right practice area

We match on the subject of your matter, not on whoever happens to be nearest. If your question concerns income tax, you are introduced to lawyers whose work covers it.

Registered with the Bar

The lawyers we introduce practise as advokati, enrolled with the Bar Association of Montenegro and bound by its Code of Professional Ethics and the official fee tariff.

Free and without pressure

Being matched costs you nothing and commits you to nothing. You can compare the lawyers introduced, ask about their working languages and decide at your own pace.

One description, several options

You write your situation once. We use it to identify suitable lawyers rather than making you repeat the same history in five separate enquiries.

Questions we hear

Frequently asked questions

What does an income tax lawyer in Montenegro actually do for a client?

They read the file as a lawyer rather than as an accountant: reviewing notices and decisions, checking how the domestic rules apply to your facts, preparing replies and supporting documents, and representing you in dealings with the authorities or before the courts where a matter becomes contentious.

Can a lawyer from another country represent me in Montenegro?

Foreign lawyers may practise in Montenegro only under the conditions set by the Law on the Legal Profession. To act as an advokat a person must hold a law degree, pass the state bar examination and be entered in the Register of Lawyers kept by the Bar Association of Montenegro.

How are legal fees set in Montenegro?

Fees are not capped by statute. They are determined by the official lawyer-fee tariff (Advokatska tarifa) published in the Official Gazette, or by agreement between you and the lawyer. Where a court awards costs to the successful party, those costs are calculated according to that tariff.

Do I have to speak Montenegrin to work with a lawyer there?

Not necessarily. Montenegrin is the official language and proceedings are conducted in it, but a party who does not speak the language of the case is entitled to use their own language and to an interpreter. Many clients look specifically for a lawyer who can discuss the file in their own working language.

Is a lawyer compulsory for every step of a civil dispute?

In civil litigation parties may act in person at first instance, but representation by a lawyer is mandatory for extraordinary legal remedies, including revision before the Supreme Court. Legal entities act through their authorised representatives.

How does the free matching service work?

You describe your situation briefly and tell us which languages you work in. We compare that with the practice areas of lawyers enrolled with the Bar Association of Montenegro and introduce you to those who fit. The introduction is free, and you are under no obligation to instruct anyone.
